Neither ChatGPT nor Claude is universally safest for confidential company data. The better choice depends on the exact enterprise or API product, contract, region, retention schedule, administrator permissions and regulated-data requirements. ChatGPT is often the stronger fit when you need documented workspace controls, data residency, audit logs and an OpenAI Compliance Platform. Claude is compelling when your priority is explicit API retention arrangements, configurable organization retention and Anthropic’s published trust-center reports.
Both vendors state that business content is not used to train models by default, but that does not mean zero retention or zero human access. Safety investigations, abuse detection, legal obligations and compliance logging can create exceptions. Treat certifications and vendor compliance statements as evidence about controls—not as a determination that your own implementation satisfies GDPR, HIPAA or another law.

What you are actually comparing
“ChatGPT” and “Claude” each cover several products. Consumer apps, business workspaces, enterprise contracts and APIs can have different training language, retention periods, administrator tools and legal terms. A privacy decision made from a consumer help page may therefore be wrong for an enterprise API deployment.

Start by naming the SKU and processing path in your procurement record:

- OpenAI API usage, including any connected applications or internal tools;
- Claude for Work or Claude for Enterprise;
- Anthropic API usage, including the Compliance API, Activity Feed or remote-session features; and
- Claude.ai content handled inside an organization.
Then compare the written agreement and configuration for that product, not a vendor-wide slogan. The relevant documents include the data-processing addendum, security exhibit, retention schedule, regional-processing terms, subprocessors, incident-notification terms and any zero-data-retention or HIPAA arrangement.
Training use: both default to no training for business data, with different wording
OpenAI’s business-workspace position
OpenAI states that, by default, it does not use content from ChatGPT Business, ChatGPT Enterprise or ChatGPT Edu workspaces to train its models. The statement includes information accessed through apps connected to those workspaces. This is a business-product commitment; it should not be generalized to consumer accounts or to a different API or account configuration without checking the applicable terms.
Anthropic’s API and organization position
Anthropic’s API documentation says retained API data is never used for model training without express permission. It also documents zero-data-retention arrangements for eligible API customers. That permission-based language is useful when your contract needs a clear prohibition rather than an operational default.
For Claude for Work and Claude for Enterprise, verify the organization agreement and settings that govern workspace content. The presence of a no-training commitment does not answer how long chats are stored, which systems can access them or what is retained for safety and compliance purposes.
What “no training” does and does not mean
No model training means the content is excluded from the vendor’s model-improvement process under the applicable terms. It does not mean the prompt disappears immediately, cannot be logged, or is inaccessible to every vendor employee. Retention for product operation, security monitoring, abuse investigation, legal compliance and audit records can still apply.
Retention and deletion: the material difference
OpenAI retention and compliance logging
OpenAI’s enterprise privacy material says access to stored business data is limited to authorized employees and specialized contractors for engineering support, abuse investigation and legal compliance. Your contract and workspace settings determine the practical retention schedule and deletion workflow.
ChatGPT Enterprise and Edu workspaces can use the OpenAI Compliance Platform for compliance workflows. OpenAI states that the Compliance API cannot delete data logged internally for audit or security. That distinction matters: deleting a user-visible conversation or exporting workspace records does not necessarily erase internal security or audit records that the platform must preserve.

Anthropic organization retention
Anthropic says retention can differ by agreement, including zero-data-retention arrangements. Its organization-retention guidance states that Claude for Work and Claude for Enterprise retain chats and coding sessions to provide a consistent product experience.
Anthropic also describes a safety exception: inputs and outputs may be retained for up to two years when chats are flagged by automated trust-and-safety systems, while trust-and-safety classification scores may be retained for up to seven years. Those periods are not a promise that every conversation is stored for those lengths; they describe the maximums for the specified flagged-content and classification records.
Anthropic API retention components
Anthropic’s API documentation separates retention for several components, including the Compliance API, Activity Feed, remote-session transcripts and Claude.ai content. Ask for the period and deletion behavior for each component you will enable. A zero-data-retention arrangement for one API pathway does not automatically make every related console, transcript or compliance feed zero-retention.
Questions to put in the contract
- What is the default retention period for prompts, outputs, files, embeddings, tool calls, images, coding sessions and administrator logs?
- Which records are deleted on user request, workspace deletion or contract termination?
- Which records are retained for security, fraud, abuse, legal hold or audit, and for how long?
- Can the customer select a shorter period or zero-data-retention option, and does it cover every enabled feature?
- Are backups, disaster-recovery copies and derived safety scores covered by the same deletion deadline?
Safety review creates legitimate access exceptions
Both platforms need systems that detect misuse, investigate abuse and satisfy legal obligations. A prompt can therefore be reviewed or preserved even when business content is excluded from model training. Safety screening may involve automated classifiers first and human investigation in escalated cases.

For Anthropic, automated trust-and-safety flags can trigger the retention periods described above. Treat these pathways as part of your threat model: highly sensitive material should not be pasted into a general workspace merely because the vendor promises no training.
Reduce exposure by restricting who can submit sensitive data, using approved connectors instead of ad hoc uploads, labeling regulated records, and routing exceptional cases through a controlled API or private workflow. Your incident-response plan should identify which vendor team receives a legal request, security escalation or abuse report and who inside your company can authorize disclosure.
Data residency, encryption and key management
OpenAI lists ChatGPT data residency, account security and fine-grained controls among its enterprise security capabilities. The available regions, eligible products and any restrictions on features must be confirmed for the specific contract and deployment.

Anthropic’s published API materials describe retention models and HIPAA-readiness arrangements, but the available data does not establish a universal region list or a single customer-managed-key option across all Claude products. Ask Anthropic to state where prompts, outputs, attachments, backups and support records are processed and whether encryption keys can be customer-controlled, vendor-managed or dedicated.

A residency label is not enough if a support ticket, backup or safety investigation can move data to another jurisdiction.
Audit logs, exports and administrator visibility
OpenAI workspaces
OpenAI lists audit logs and an enterprise Compliance Platform. The platform is designed for compliance workflows in ChatGPT Enterprise and Edu, allowing an organization to export or analyze relevant activity. Its inability to delete data logged internally for audit or security should be reflected in your records policy.
Workspace administrators can generally manage users, authentication, applications and policy controls, while authorized vendor personnel may access stored business data for the limited purposes described in OpenAI’s enterprise privacy material. The exact fields visible to your administrators—such as message content, file names, usage events or application activity—depend on the plan, roles and enabled integrations. Require a field-level administrator-visibility schedule before rollout.
Claude organizations
Anthropic documents an Activity Feed and a Compliance API as separate retention components. These tools can provide organization-level activity and compliance records, but the available events, content fields, export format and retention period should be verified for your plan.

Do not assume that a private conversation inside a company workspace has the same confidentiality as an end-to-end encrypted personal messenger.
Administrator-visibility checklist
- Can administrators read full prompts and outputs, or only metadata?
- Are uploaded files, generated artifacts, tool-call arguments and connector results included?
- Can administrators export records, place legal holds or delegate access to an outside auditor?
- Are user deletion requests visible in audit logs?
- What does the vendor support team see during troubleshooting?
- Are remote-session transcripts and safety classifications exposed through a compliance feed?
Independent attestations and regulated workloads
OpenAI evidence
OpenAI’s security materials report an independent SOC 2 Type 2 examination for relevant API and ChatGPT business services. They also list ISO/IEC 27001:2022 and ISO/IEC 27701:2019 certifications, along with alignment or certification references involving CSA STAR, SOC 2 Type 2 and ISO/IEC 27001, 27017, 27018 and 27701. Check the report scope and covered services; a control report for one service is not proof that every product or feature is included.

OpenAI says its business-data protections support GDPR and CCPA compliance. That describes vendor capabilities and commitments. Your company remains responsible for lawful basis, notices, data-subject rights, retention, access controls and any required transfer mechanism.
Anthropic evidence
Anthropic’s trust center publishes a 2025 Type 2 SOC 2 report and a CSA STAR Level 2 report, together with security, accessibility and compliance resources. Confirm the report period, service scope, exceptions and complementary customer controls before relying on them in a risk assessment.

How to interpret a SOC 2 report
SOC 2 Type 2 is an independent examination of controls over a defined period and service scope. It is not a blanket certification that a vendor, customer or use case complies with every law. ISO certification likewise applies to the audited management system and stated scope. Obtain the report under nondisclosure, map its complementary user-entity controls to your own environment and document any gaps.

A practical decision process
Step 1: Classify the data
Separate public, internal, confidential, personal, health, financial, export-controlled and privileged information. Define whether prompts may contain direct identifiers, customer records, source code, secrets or regulated identifiers. Prohibit categories that your legal or security team cannot approve.
Step 2: Choose the processing route
Decide whether users need a managed workspace, an API behind your application, or both. Record every connected app, retrieval store, remote session, transcript and compliance feed because each can have a separate retention model.

Step 3: Compare written commitments
Build a clause-by-clause matrix for training, subprocessors, residency, incident notice, deletion, legal holds, safety review, administrator access, audit rights and termination assistance. Mark any answer that is only a marketing statement as “unconfirmed” until it appears in the contract or security documentation.
Step 4: Test administrator and export controls
In a non-production tenant, create a test user, submit a labeled sample, attach a file, invoke an approved connector and generate an audit export. Confirm which roles can see content, how quickly events appear, what fields are present and whether deletion removes user-facing and compliance records separately.
Step 5: Validate regulated-use requirements
For personal data, document lawful basis, processor instructions, cross-border transfers and data-subject rights. For health data, obtain the required agreement and verify that the selected API or workspace path—not merely the vendor—supports your HIPAA control set. For security-sensitive code, enforce secret scanning, least privilege and repository-specific access.
Step 6: Set operating controls
- Use single sign-on, multifactor authentication and role-based administration.
- Block consumer accounts for company work unless explicitly approved.
- Apply data-loss-prevention rules to prompts, uploads and connector responses.
- Publish a retention schedule that distinguishes conversations, files, audit events and safety records.
- Train staff that no-training commitments do not override legal holds or safety investigations.
- Review vendor reports, subprocessors and contract changes at least annually.
Common mistakes and how to correct them
Mistake: treating “no training” as “no storage”
Correction: obtain the retention table for every enabled component and document safety, legal and audit exceptions.
Mistake: buying the cheapest or most familiar tier
Correction: compare the enterprise or API SKU that will actually process the data. Consumer and business terms are not interchangeable.
Mistake: writing “SOC 2 certified” in a policy
Correction: name the SOC 2 Type 2 report, examination period, service scope and any exceptions. State which controls your company must operate.
Mistake: assuming administrators see nothing
Correction: require a role-and-field visibility map for messages, files, connectors, transcripts, exports and deletion events.
Mistake: ignoring records that cannot be deleted through a compliance tool
Correction: include internal audit and security logs in your retention notice, legal-hold process and data-subject response analysis.
Mistake: relying on a vendor label for HIPAA or GDPR
Correction: complete your own legal assessment, configure least privilege and obtain the required contractual commitments before processing regulated data.
Bottom line for a security review
Choose ChatGPT when your evaluation gives priority to documented enterprise administration, data-residency options, audit logs and the Compliance Platform, and when the relevant OpenAI contract covers your required region and retention rules. Choose Claude when explicit API data-handling terms, zero-data-retention arrangements, organization-level retention controls and Anthropic’s trust-center reports better match your architecture.
If the data is highly confidential, make the decision on the signed terms and a controlled pilot—not on brand reputation. The winning platform is the one whose exact product, geography, retention schedule, administrator model, safety process and regulated-data commitments you can demonstrate to your security team, auditors and customers.
