German data protection authorities have warned that personalized ChatGPT ads could use conversation history to build detailed profiles, including from disclosures about health, mood, plans, and relationships. This is a warning about potential privacy risks—not a finding that OpenAI broke the law. OpenAI says selected chat signals may inform ad selection but advertisers do not receive conversations or personal details.
What German regulators warned about
Berlin’s data protection authority issued its warning on October 2, 2026, and Niedersachsen’s authority issued a similar statement on October 1. Both focused on OpenAI’s planned personalized advertising in ChatGPT. The authorities’ concern is that people may reveal more to a chatbot than they would through ordinary browsing or search, making chat content especially sensitive if it is used to build advertising profiles. Berlin’s statement and Niedersachsen’s statement describe risks, not a ban or a ruling that the practice violates the GDPR.

Berlin said OpenAI had changed its privacy policy at the end of August and was preparing a European rollout after starting outside the EU. The authority described the planned ads as applying to ChatGPT Free and Go users. It warned that combining conversations and other signals could reveal interests or circumstances in ways that users may not expect, potentially even suggesting a person’s mood in real time.

Niedersachsen State Commissioner for Data Protection Denis Lehmkemper said users often entrust AI chatbots with intimate thoughts about health, moods, plans, relationships, and wellbeing. That is his assessment of how people use chatbots, not a measured claim about every user. Berlin also relayed an OpenAI study figure that 49 percent of inputs were classified as questions; its release does not give the study year or methods, so the figure should not be read as a population-wide statistic.
How personalized and contextual ads differ
Berlin’s account distinguishes ads personalized using broader user signals from ads selected for the subject of the current conversation. Its description is an account of the announced model, not proof that either ad mode was live for German users.
| Ad mode | Conversation scope and signals | Profile use | What Berlin says about consent |
|---|---|---|---|
| Personalized | Berlin says selection may draw on previous and current chats, device information, and usage data. OpenAI’s own help page says that, when personalization is enabled, selected signals can include past chats and memory as well as the current thread and ad interactions. | Intended to tailor ads using user-related signals; Berlin’s concern is the possibility of detailed profiling. | Berlin describes it as opt-in. |
| Contextual or “generic” | Berlin says ads may relate to the current chat and use more limited contextual information. | Berlin says this mode does not create or use a user profile. | Berlin says users who do not consent to personalization may still see contextual ads. It describes OpenAI as relying on legitimate interests for processing in this mode; that is the authority’s account, not an adjudication that the legal basis is valid. |
For example, Berlin said a recipe conversation might lead to an ad for a meal kit or food delivery. That illustrates the authority’s description; it does not establish that a particular German user has received such an ad.

What OpenAI says advertisers can see
OpenAI’s Ads in ChatGPT help page says ad signals stay within ChatGPT and are not shared with advertisers to select ads. It says advertisers do not receive chats, chat history, memories, names, email addresses, precise location, IP addresses, or sensitive information such as health, mental-health, or political topics. Instead, OpenAI says advertisers receive aggregated, non-identifying performance information, such as views and clicks. These are OpenAI’s published descriptions of its system.

That distinction does not resolve the regulators’ concern: their warning is about the potential use of conversational information to personalize ads and form inferences, even if advertisers do not directly receive the underlying conversations.

Are ChatGPT ads live in Germany?
The official statements available as of October 7, 2026 do not establish that ads—or personalized ads—were actually live for German users. Berlin described a European rollout as imminent. OpenAI’s help page says personalized ads are not initially available in the European Economic Area or Switzerland. The two statements leave German launch status unresolved; do not treat Berlin’s warning as confirmation of a launch.

- Decline personalization consent where offered. Berlin recommends not consenting if you do not want chats used for personalized ads.
- Review ad settings. OpenAI says users can turn off ad personalization, dismiss ads, see why an ad was shown, and clear ad data. Turning personalization off does not remove contextual ads based on the current thread; OpenAI says it stops using other threads, ad history, and topics to inform ads.
- Use Temporary Chat for sensitive topics. OpenAI says Temporary Chats do not show ads and can be used without using or updating memory. Its EU privacy policy says these chats do not appear in history and are not used to improve OpenAI models; they are automatically deleted within 30 days unless retention is required for safety or legal reasons. Model-improvement use and ad personalization are separate purposes.
- Manage memory and chat history. Berlin recommends disabling memory, deleting existing memories, and regularly deleting chat history. OpenAI’s EU privacy policy describes controls for ad settings, cross-chat personalization, and deleting or archiving chats.
- Clear ad data or choose an ad-free option where available. OpenAI says cleared ad data may remain on its servers for up to 30 days before removal. Its help page lists Plus or Pro as ad-free paid plans and a free no-ads option with additional limits; availability may vary by region and over time.
- Avoid entering confidential information. Berlin advises against sharing information that is confidential or protected by a duty of secrecy. A setting choice is not a guarantee that all processing stops or that the service is confidential.
