The reviewed Terms of Service are the non-EEA version, so check the terms governing your account and project before publishing.
When does ElevenLabs allow commercial use?
In the non-EEA Terms of Service reviewed here, free users may use the service only for non-commercial purposes. Paid users may use it commercially, but must still comply with the Terms and the Prohibited Use Policy. These are ElevenLabs’ contract terms, not a legal determination that every use is lawful.

ElevenLabs’ publication guidance adds that commercial use depends on having the necessary intellectual-property rights and following applicable law and platform rules. It also says content generated on a free plan or while signed out must include attribution to ElevenLabs in the title, except for Eleven Music. Content generated using a Beta Service cannot be used commercially under the Beta Services Addendum; check whether the feature you used is designated beta.
Because the reviewed Terms are explicitly for non-EEA users, do not assume the same terms govern every account. Check the terms for your region, plan, service, and feature. Local law can also affect a project, and the answer depends on its facts.

What rights do you need besides a paid plan?
ElevenLabs’ commercial-use permission is not a blanket clearance of everything used to make or distribute the audio. Its publication guidance requires users to hold the necessary rights, while its policy separately restricts voice replication. Check the rights for each part of the project:
- Script: Do you have the right to use the words being spoken?
- Source recording: If you upload or use a recording, do you have permission to use that recording?
- Voice or performance: Does the audio imitate an identifiable person, and do you have the required consent or legal right?
- Finished use: Are the intended platform, audience, territory, and commercial purpose allowed by the relevant terms and law?
ElevenLabs says that, as between the user and the company, users retain rights in their input and output, subject to the Terms. The Terms also grant ElevenLabs a license to use submitted content to provide and improve its services and develop products. Neither provision establishes that you have rights in third-party material included in your inputs or output. Read the applicable Terms alongside the rights and permissions for your project.

Can you clone another person’s voice?
Not simply because you can access a sample or have a paid subscription. ElevenLabs’ Prohibited Use Policy bars intentionally replicating another person’s voice without consent or a legal right. Its product guidance distinguishes two cloning routes:

Instant Voice Cloning (IVC)
ElevenLabs says you need permission to clone the voice. A publicly available recording or an audio file you possess is not, by itself, proof of that permission.

Professional Voice Cloning (PVC)
ElevenLabs’ Professional Voice Cloning documentation says PVC is limited to your own voice and requires verification. It explicitly says you cannot create a PVC of someone else’s voice, even with that person’s consent. A voice owner can create and verify their own PVC and share it through a provider-supported link.
If a project involves an actor, employee, client, or other voice talent, a written agreement is a prudent way to document permission. Consider specifying the synthetic clone, intended commercial uses and platforms, territory, duration, editing and reuse rights, and what happens if either party ends the arrangement or withdraws permission. This is a practical checklist, not a claim that ElevenLabs requires a particular contract form. Applicable consent rules vary by jurisdiction.

Is publishing audio the same as sharing a voice model?
No. Publishing generated audio and making a voice model available to others are separate actions with different conditions.
- Generated audio: Follow the plan, attribution, rights, beta-feature, and other restrictions in the terms and publication guidance that apply to the content.
- Voice Library model: ElevenLabs says only Professional Voice Clones can be published to the Voice Library. Publication involves review, accepting the Voice Library Addendum, and providing required consents and confirmations.
The reviewed Voice Library Addendum is dated 6 March 2026. It says users must consent to voice-data processing under the referenced notices and any additional signup consent forms. Sharing a model is not covered merely by permission to publish audio made with it.

Check these details before release
- Confirm your account and regional terms. Check whether your account is free, paid, or signed out, and read the terms that apply in your region. The non-EEA Terms reviewed here make free use non-commercial and permit paid commercial use subject to their conditions.
- Check the feature’s status. Verify whether the service or feature is a Beta Service; ElevenLabs says beta-generated content cannot be used commercially.
- Identify the voice source. Determine whether you used a standard generated voice, your own clone, or another person’s voice. For IVC, obtain permission; PVC is restricted to your own verified voice.
- Clear the inputs and intended use. Confirm that you have rights to the script and any source recording, and that the planned distribution complies with applicable terms and law.
- Separate audio publication from model sharing. If you plan to publish a voice model to the Voice Library, check the separate addendum, review process, and consent requirements.
- Check attribution requirements. If the content was generated on a free plan or while signed out, ElevenLabs’ guidance requires attribution in the title, except for Eleven Music.
