Can You Trust a New AI Model With Confidential Information?

Not by default. A new model’s benchmark scores, impressive demos, or “enterprise” label do not prove that your information will remain confidential. Use a model with sensitive material only after verifying its contractual commitments, technical controls, deployment architecture, and data-handling practices against your organization’s data classification. Begin with redacted or synthetic examples; require formal privacy, security, legal, or records-management approval before sending trade secrets, credentials, regulated personal data, privileged communications, export-controlled information, or contract-restricted customer material.

What makes an AI model trustworthy for confidential work?

Confidentiality is a system property, not a model capability. The model may generate accurate text while the surrounding service stores prompts, exposes files to support personnel, routes data through subprocessors, or logs content for debugging. Trust therefore depends on the provider, the exact plan and region, the way you connect to it, the information you submit, and the controls your organization operates.

The Federal Trade Commission (FTC) warned in January 2024 that customers may disclose sensitive or confidential information, including internal documents and their own users’ data, to model-as-a-service companies. It also states that providers must honor privacy promises regardless of how or where those promises were made. A provider that says it will not use customer data to train or update models must follow that commitment.

There is no universal leakage percentage for “a new AI model.” Risk varies with the model, service configuration, account permissions, integrations, personnel access, retention settings, and the data itself. Treat a new service as unapproved until those variables are documented and assessed.

Classify the information before choosing a tool

Do not ask whether an AI service is private in the abstract. Ask whether it is suitable for a particular class of information and a particular task. Record obligations owed to customers, employers, partners, regulators, and courts before an employee uploads anything.

Information class Typical examples Default handling
Public Published documentation, public code, press releases Most tools are acceptable, subject to normal account and copyright controls.
Internal Unpublished procedures, nonpublic schedules, routine internal analysis Use an approved account with access controls and a documented data-use policy.
Confidential Pricing strategy, customer proposals, product roadmaps, source code that is not public Require verified retention, training-use, access, and deletion terms; minimize the prompt.
Personal or regulated Employee records, customer identifiers, health or financial information Obtain privacy review, define a lawful purpose and retention period, and use de-identification where practical.
Privileged or legally restricted Attorney-client communications, litigation strategy, material nonpublic information Require legal approval and a deployment whose contractual and technical controls preserve the applicable protection.
Trade secret, credential, or export-controlled Secret algorithms, API keys, passwords, controlled technical data Do not submit to a new service without formal security and legal authorization; credentials should never be pasted.

Pseudonymization lowers exposure but does not automatically remove data-protection duties. A name replaced with an identifier can remain personal data if your organization can reconnect it to a person.

Compare the deployment, not just the model

A public consumer interface, an enterprise API, a managed private tenant, and a self-hosted model expose different control surfaces. An “enterprise” badge is not a technical specification. Compare the exact service, plan, region, connector configuration, and contract you will use.

Control axis Public consumer interface Enterprise API or tenant Managed private deployment Self-hosted model
Data-use and training terms May vary by account and settings; verify before use. Defined by API and enterprise terms; confirm that prompts and outputs are excluded from training if required. Negotiate terms for the dedicated environment and every support path. Under your operational control, but model licenses, telemetry, and update channels still require review.
Retention and deletion Check chat, file, abuse-monitoring, and backup retention separately. Confirm log categories, deletion workflow, and exceptions in writing. Set tenant retention and verify deletion from backups and support systems. You set storage policies, but must implement deletion across logs, caches, snapshots, and backups.
Access and subprocessors Provider personnel and undisclosed service dependencies may be part of the path. Review administrator roles, support access, subprocessors, and segregation. Require named roles, approval for support access, and tenant isolation evidence. Your administrators and infrastructure suppliers become the access boundary.
Geography and transfers Location may be unclear or change with routing. Confirm processing regions and a lawful transfer mechanism where applicable. Specify residency, failover regions, and support locations. Can remain on selected infrastructure, but external updates or telemetry may create transfers.
Auditability and incidents Limited customer logs and control over investigations. Look for audit logs, alerting, vulnerability management, and incident-notification commitments. Require independent assessments and evidence for the actual tenant. You must build monitoring, response, patching, and forensic capability.
Integrations and prompt-injection exposure Plugins or browser extensions can broaden data access. Connectors, retrieval stores, and tools need allowlists and least privilege. Network and identity boundaries can be tailored, but integrations remain a risk. You control the stack, yet insecure tools or untrusted documents can still manipulate the model.
Contractual remedies and cost Usually limited standard terms and little negotiation. May provide negotiated privacy, security, and incident terms; verify scope and fees. Higher operational and procurement effort in exchange for more control. Infrastructure, engineering, patching, and specialist staffing are your responsibility.

Self-hosting reduces dependence on a hosted provider; it does not make a system automatically secure. A poorly configured server, unrestricted administrator access, or unencrypted backups can expose more data than a well-governed hosted service.

Questions to answer in the provider’s terms

Obtain written answers for the service and plan you will actually deploy. Marketing pages are not a substitute for contract language, security documentation, or a data-processing agreement.

  • Training and product improvement: Are prompts, uploaded files, outputs, feedback, and telemetry used to train, fine-tune, evaluate, or improve models? Is the setting opt-in, opt-out, or fixed by plan? Does the promise cover human review and abuse monitoring?
  • Retention: How long are chats, files, embeddings, request metadata, safety logs, and backups kept? Are failed uploads, temporary exports, and cached copies included?
  • Deletion: Who can request deletion, how is identity verified, what is the service-level time frame, and which legal, security, or backup exceptions apply? Request evidence when the risk warrants it.
  • Human access: Can employees, contractors, support agents, or incident responders read content? Is access logged, approved, time-limited, and restricted to a region?
  • Subprocessors: Which companies handle hosting, storage, analytics, safety review, support, or model inference? How are changes announced and how can you object?
  • Geographic processing: Where are prompts processed and stored, including disaster recovery? What transfer mechanism and supplementary safeguards apply to cross-border processing?
  • Security controls: Confirm encryption in transit and at rest, identity and access management, tenant isolation, key management, vulnerability handling, penetration testing or independent assessments, and secure disposal.
  • Audit and incidents: Are administrator and data-access logs available? How quickly will the provider notify you of a suspected breach, and what cooperation, evidence, and remediation are promised?
  • Legal commitments: Do confidentiality, privacy, indemnity, records, and regulatory terms apply to your plan, region, API, support channel, and connected storage?

  1. Define the output. State exactly what the model must produce, such as a summary of specified clauses or a classification of fictional records. Remove context that does not change the answer.
  2. Remove direct identifiers. Delete names, email addresses, phone numbers, account numbers, exact locations, and dates of birth. Replace them with consistent labels only when the task needs relationships between records.
  3. Strip secrets and unique deal terms. Never include passwords, API keys, private certificates, recovery codes, proprietary cryptographic material, or customer-specific pricing when a generic placeholder will work.
  4. Redact or synthesize. Replace sensitive passages with fabricated examples that preserve structure, length, and edge cases. Test whether the result is still useful before considering real data.
  5. Limit attachments and retrieval. Upload only the pages needed for the answer. Disable broad connectors, automatic mailbox indexing, and unrestricted retrieval from shared drives.
  6. Constrain the session. Use an approved workspace, least-privilege account, short-lived credentials, and a retention setting matched to the task. Turn off unnecessary plugins and external actions.
  7. Inspect the output. Check for copied personal data, secrets, hidden instructions, or unsupported inferences before saving or sharing the result.
  8. Dispose of working material. Delete local exports, intermediate files, prompt logs, and temporary datasets according to your retention policy.

The Information Commissioner’s Office advises documenting data movements, deleting unnecessary intermediate files, and considering de-identification. It also cautions that it is not possible to list every security risk that AI processing can exacerbate.

Understand model-specific privacy attacks

Membership inference

An attacker may try to determine whether a person’s record or a document appeared in training data. The possibility is especially relevant when a model has been trained on sensitive or distinctive material. A provider’s “no training on your prompts” promise addresses one data path; it does not answer how the base model was trained or what outputs may reveal.

Model inversion and memorization

Inversion techniques attempt to recover characteristics of training examples from model behavior. Models can also reproduce memorized fragments, particularly when data is rare, repeated, or highly structured. Do not assume that an output is safe merely because the original file was not displayed verbatim.

Output and retrieval leakage

A model can disclose personal data or confidential text in an answer, citation, autocomplete, or retrieved passage. Review generated content before it enters a report, ticket, source repository, or customer communication.

Prompt injection through documents and tools

Untrusted documents can contain instructions that conflict with your policy. If the model can send email, call APIs, modify files, or search a knowledge base, a malicious instruction may turn a summarization task into unauthorized data access. Use allowlists, separate read and write permissions, confirmation gates, and human approval for external actions.

Run a documented approval workflow

  1. Record the use case and owner. Name the business purpose, users, data classes, jurisdictions, connected systems, and accountable decision-maker.
  2. Map the data flow. Diagram collection, prompt construction, inference, storage, logging, support access, backups, output storage, and deletion. Include every subprocessor and region identified by the provider.
  3. Test with synthetic data. Measure whether redaction, access rules, logging, and deletion work without risking real confidential material.
  4. Review contracts and evidence. Match provider commitments to the deployment. Ask for security assessments, incident procedures, subprocessor lists, and retention documentation rather than relying on a product label.
  5. Set operating controls. Create an approved-user group, prohibit unsanctioned plugins, require strong authentication, define prompt and output handling, and log approvals and material data flows.
  6. Obtain specialist sign-off. Escalate regulated personal data, privileged communications, credentials, trade secrets, material nonpublic information, export-controlled data, and customer-restricted content to privacy, security, legal, or records-management reviewers.
  7. Reassess on change. Recheck the service when the model, plan, region, terms, connector, subprocessor, or retention behavior changes. Federal guidance calls for independent evaluation of vendor claims and documented oversight.

What an enterprise plan does—and does not—prove

An enterprise plan can provide negotiated terms, administrative controls, centralized identity, audit logs, regional choices, and support commitments that a consumer account lacks. Those features reduce risk only when they are enabled and apply to the exact interface employees use. An employee can still bypass them with a personal account, a browser extension, an unapproved API key, or a connector that copies data into another system.

Verify that the “no training” rule covers prompts, uploads, outputs, feedback, and telemetry; that retention controls include backups and abuse logs; that support access is restricted and auditable; and that incident notification, deletion, confidentiality, and subprocessor clauses are contractual. Document which features are unavailable in your region or plan.

Special requirements for government and controlled data

Federal guidance emphasizes staff training, appropriate vendor terms, confidentiality and privacy protections, and safeguards against misuse of government information. For controlled unclassified information (CUI), use a recognized baseline such as NIST SP 800-171 Revision 3, published in May 2024. Verify that the AI deployment can meet the required controls for access, configuration, audit, incident response, media protection, personnel security, and system integrity; do not treat a general cloud attestation as proof that your particular AI workflow is compliant.

Map each control to the actual architecture, including prompts, retrieved documents, model weights, logs, support channels, backups, and downstream outputs. If the provider cannot identify where CUI is processed or how it is protected and deleted, keep that information out of the service.

When to stop and escalate

  • The provider will not state whether prompts or files are used for training or human review.
  • Retention, deletion, backup, or subprocessor behavior is undefined or conflicts with your obligation.
  • Processing geography or cross-border transfer safeguards cannot be established.
  • You cannot produce an access log or determine which administrators can read content.
  • The task involves credentials, privileged advice, trade secrets, regulated personal data, export-controlled information, or material nonpublic information.
  • The model can take external actions without a human confirmation step.
  • The service, plan, region, or connector changed after your last assessment.

In any of these cases, pause the upload, preserve the relevant evidence, and route the use case to the responsible privacy, security, legal, or records-management authority. A slower approved workflow is preferable to losing control of information that cannot be recovered.
