Usually, federal law allows a person who may legally possess firearms to make a non-NFA firearm for personal use, including with a 3D printer. That permission is conditional: the firearm must satisfy the federal detectability rule, the maker cannot be a prohibited person, and the project cannot involve a machine gun, conversion device, silencer, destructive device, or another specially regulated item. Making firearms for a livelihood or profit generally requires a federal firearms license.

State and local law can be much stricter. Some jurisdictions regulate or prohibit unserialized frames, receivers, precursor parts, 3D-printing equipment, digital design files, possession, transfers, or all of those activities. The legal answer therefore depends on the exact state, locality, object, conduct and date. This is general legal information, not individualized legal advice.

What federal law allows

Personal manufacture is generally lawful for a non-prohibited person

The Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) says an individual may generally make a firearm for personal use. The rule is technology-neutral: a person may use machining, assembly, 3D printing or another process, provided the result complies with federal law. ATF’s published statement is: “Individuals who make their own firearms may use a 3D printing process or any other process, as long as the firearm is ‘detectable’ as defined in the Gun Control Act.”

This federal baseline applies to a non-NFA firearm made for the maker’s own use. It does not create a blanket right to manufacture every kind of weapon, and it does not override a stricter state or local rule.

Detectability is a separate federal requirement

The Undetectable Firearms Act, 18 U.S.C. § 922(p), prohibits making, importing, selling, shipping, delivering, possessing, transferring or receiving a firearm that fails the statute’s detection standards. In practical terms, the firearm must be detectable by the required walk-through-metal-detector test, and its major component must produce the required image under airport-style X-ray screening. A design that is mostly plastic is not automatically lawful merely because it is called a homemade gun; the completed firearm has to meet the statutory test.

Detectability is not the same as having a serial number. Federal law can permit a personally made firearm without a manufacturer-applied serial number while still requiring the physical object to be detectable. A state may impose its own marking or serialization rule in addition to the federal detectability requirement.

Prohibited people do not receive an exception

A homemade or 3D-printed firearm is still a firearm. A person prohibited under federal law from possessing firearms cannot lawfully make or possess one just because it was produced at home or lacks a commercial serial number. Prohibiting categories include people subject to the federal firearms disabilities listed in 18 U.S.C. § 922(g), although the application of those provisions can depend on the person’s exact status and current law.

NFA and otherwise prohibited items require separate analysis

The personal-use rule does not authorize machine guns, machine-gun conversion devices, destructive devices, silencers or other items regulated by the National Firearms Act or otherwise prohibited by federal law. ATF specifically warns that destructive devices and machine-gun conversion devices are illegal to possess under federal law without the required licensing or registration framework. A project involving any of those categories should not be treated as an ordinary privately made firearm.

Business manufacturing requires licensing

Personal use and commercial activity are different legal situations. ATF states: “An individual may generally make a firearm for personal use. However, individuals engaged in the business of manufacturing firearms for sale or distribution must be licensed by ATF.” Repeated production as a regular course of trade or business for livelihood or profit can be treated as engaging in the firearms-manufacturing business even if the maker uses a home workshop or 3D printer. Selling, distributing, or routinely making firearms for others can therefore trigger federal licensing, recordkeeping, marking and transfer requirements.

What “privately made firearm” and “ghost gun” mean

The federal PMF definition

ATF’s regulation at 27 CFR 478.11 defines a privately made firearm (PMF) as a firearm, including a frame or receiver, completed, assembled or otherwise produced by a person other than a licensed manufacturer and without a manufacturer serial number placed on the firearm at the time of production. “Ghost gun” is a common public term, not a single federal legal category that makes every homemade firearm unlawful.

The definition covers more than a complete pistol or rifle. Depending on the facts, a privately produced frame or receiver can itself be the regulated firearm. A separate “precursor part” may be regulated under state law even when federal law does not classify that unfinished item as a firearm.

Why a missing serial number does not answer the question

Federal guidance generally does not require a person making a non-NFA PMF for personal use to put on a manufacturer serial number. That does not mean an unserialized firearm is universally legal. State law may require the maker to apply an identifying mark, obtain state approval, use a licensed manufacturer, or refrain from making or possessing the item altogether.

There is also a different rule when a federally licensed firearms dealer or manufacturer receives or acquires a PMF. The licensee must apply compliant identifying marks within the applicable regulatory deadline and maintain the required acquisition and disposition records. A private maker’s federal treatment therefore cannot be assumed to apply after a transfer to an FFL.

Making, possessing, transferring and selling are different acts

Legal systems often regulate each stage separately. A jurisdiction may allow a person to make an item for personal use but prohibit possession of an unserialized version, or permit possession while requiring a serialized mark before a transfer. Do not treat a conclusion about one act as an answer for all the others.

Situation Federal baseline Why state and local law still matters
Making a non-NFA firearm for personal use Generally allowed for a person who may lawfully possess firearms, if the firearm is detectable and no other federal prohibition applies. A state may require licensing, serialization, dealer involvement or may prohibit the manufacture itself.
Making for sale, distribution or livelihood Regular business manufacturing generally requires the appropriate federal firearms license. States can impose additional manufacturer, dealer, tax, safety and recordkeeping rules.
Possessing a PMF Not automatically illegal solely because it is homemade or lacks a serial number; prohibited persons remain barred. Some states prohibit possession of unserialized firearms, frames, receivers or precursor parts.
Transferring or selling a PMF Federal transfer rules, prohibited-person checks and licensing requirements can apply; a business transfer is not personal use. State law may require serialization, a dealer-processed transfer, background checks, waiting periods or may ban the transfer.
Machine gun, conversion device, silencer or destructive device Subject to separate NFA or other federal restrictions; a home-production claim does not create an exemption. State law may add independent criminal prohibitions.
Digital CAD file or instructions Federal analysis depends on the conduct and the item; technology alone is not the federal test. Some states regulate distribution or possession of digital manufacturing instructions in addition to the physical object.

How state and local law changes the answer

Use current law for the exact jurisdiction

ATF’s State Laws and Published Ordinances – Firearms, 36th edition, updated January 15, 2026, is a useful state-by-state starting point. It is not a substitute for reading the current statute, regulations and court orders. Local ordinances may matter as well, and litigation can change what a rule means or whether it is enforceable.

California

California is substantially stricter than the federal personal-use baseline. The California Department of Justice’s December 2025 Ghost Gun Laws Reference Guide states that a person may not use a 3D printer or CNC milling machine to manufacture any number of firearms, including completed frames or receivers and firearm precursor parts, without the required ATF and California DOJ manufacturer licensing.

California’s rules also address dealer-processed transfers, background checks, age limits, firearm-safety requirements, waiting periods, sale records and serialization. A California reader cannot rely on the federal statement that a person may generally make a personal-use PMF. California DOJ has separately explained that 2025 legislation added conditions concerning firearm-barrel purchases and transfers. The current statutes and effective dates control.

New Jersey

New Jersey legislative text criminalizes, for an unregistered or unlicensed person acting with the purpose of manufacturing or assembling a firearm, obtaining an unserialized frame or receiver or combinations of parts from which an unserialized firearm may be readily manufactured or assembled. New Jersey also regulates covert and undetectable firearms and has restrictions involving digital instructions.

The exact charge depends on the conduct and the statutory version in force. A person in New Jersey should check the current codified provisions rather than assume that a part, file or completed firearm falls outside the law.

New York

New York Penal Law materials define and regulate ghost guns, and New York has continued to propose or enact additional controls on three-dimensionally printed firearms and related digital manufacturing code. Bills, amendments and effective dates can change. A New York reader should consult the current consolidated Penal Law and verify which provisions are effective on the intended date.

Other states

Other states use different combinations of serialization, licensing, transfer, possession, manufacturing and digital-file rules. Some regulate only completed firearms; others include frames, receivers or precursor parts. Some impose marking deadlines or require a state-issued serial number. A nationwide statement such as “ghost guns are legal” or “3D-printed guns are banned” is inaccurate unless it identifies the jurisdiction, object and conduct.

3D printing does not create a special federal loophole

ATF says that federal firearms laws “currently do not limit the technology or processes that may be used to produce firearms.” That means the legal analysis focuses on the firearm and the maker’s conduct, not on whether the object came from a printer, milling machine or conventional manufacturing process.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Technology can still affect the legal result indirectly. A printed design may raise detectability concerns, a digital file may be regulated by state law, and a printer used for repeated production for customers may support a finding that the operator is engaged in business. The same physical design can therefore present different legal issues depending on who made it, why it was made, where it is located and what happens next.

What ATF’s crime-recovery statistic shows

ATF reported that 45,240 suspected privately made firearms were recovered by law enforcement from potential crime scenes from 2016 through 2021. The figure included 692 homicides or attempted homicides. It is a count of suspected PMFs generally, not a count of 3D-printed guns. ATF does not state that all of those recovered firearms were produced with 3D printers, so the statistic should not be presented as evidence of the prevalence of 3D printing specifically.

Common mistakes that create legal exposure

  • Assuming federal permission overrides state law. State and local governments can impose stricter requirements in areas not preempted by federal law.
  • Treating “no serial number” as the whole test. Detectability, prohibited-person rules, NFA classifications and state marking laws are separate questions.
  • Calling a business project personal use. Regular production for income, sale or distribution can require federal licensing and state authorization.
  • Ignoring the object’s classification. A conversion device, destructive device, silencer or machine gun is not analyzed like an ordinary non-NFA firearm.
  • Overlooking transfers. Giving, selling, lending, importing or transporting an item can trigger rules that did not apply when it was made.
  • Relying on an old bill or web summary. State statutes, regulations, court orders and effective dates change, especially for digital files and precursor parts.

A practical legal-verification process

  1. Define the object. Write down whether it is a complete firearm, frame or receiver, precursor part, conversion device, silencer, destructive device or another NFA item.
  2. Define the conduct. Separate making, possessing, transporting, importing, selling, gifting, lending and distributing digital instructions.
  3. Confirm the maker’s status. Verify that the person is not prohibited under federal or applicable state law.
  4. Check federal requirements. Review current ATF regulations and guidance on PMFs, detectability, licensing and NFA items.
  5. Check the state and locality. Use ATF’s current state-law compendium as a map, then read the controlling statute, regulation and any relevant court order for the exact jurisdiction.
  6. Check timing. Confirm the law and effective date that apply when the act will occur, not merely when an article or bill summary was published.
  7. Get fact-specific advice. If any issue involves a state ban, business activity, a transfer, an NFA item or an uncertain classification, consult a lawyer who handles firearms law before acting.

Bottom line

Under the federal baseline, a person who may legally possess firearms can generally make a detectable, non-NFA firearm for personal use, including by 3D printing, without a manufacturer-applied serial number. That permission ends or changes when the maker is prohibited, the object is an NFA or otherwise prohibited item, the activity becomes a business, or the firearm fails the federal detectability rule.

State and local law can be more restrictive. California requires licensing for 3D-printer or CNC manufacture of firearms and precursor parts; New Jersey regulates unserialized frames, receivers, parts and digital instructions; New York’s ghost-gun controls continue to evolve. The only reliable answer for a proposed project comes from checking the current law for the exact place, object and conduct before making, possessing or transferring anything.
