Can You Copyright a Book Written With Generative AI? Current U.S. Rules

Yes, but only the human-authored parts are protected. In the United States, a book that uses generative AI can qualify for copyright when a person contributes protectable expression through writing, creative selection or arrangement, or sufficiently creative revisions. Text whose expressive elements were determined entirely by a machine is not independently protected, and prompts alone do not make the user the author.

The short answer for an AI-assisted book

The U.S. Copyright Office’s Part 2 report, issued January 29, 2025, treats generative AI as a tool that can be used within a copyrightable book, not as a human author. Copyright protection follows the human creative contribution that readers can perceive in the finished work. The Office identifies three practical ways that contribution may appear:

As an Amazon Associate I earn from qualifying purchases.

  • Human-authored expression is present in the final text.
  • The author makes creative choices in selecting, coordinating, or arranging AI-generated material.
  • The author makes creative modifications to AI output.

These categories are not an automatic registration formula. Copyrightability depends on the expressive contribution shown in the particular book. A person who enters a prompt and accepts the resulting prose without making creative decisions about its expression generally cannot claim authorship of that machine-determined prose.

This answer is limited to United States law. Copyright rules in other countries may use different tests or registration procedures.

What the copyright statute requires

Section 102(a) of Title 17 of the United States Code says copyright subsists in “original works of authorship fixed in any tangible medium of expression” and expressly includes literary works. A manuscript, ebook file, or printed book ordinarily satisfies the fixation and literary-work parts of that baseline. The difficult question for generative-AI writing is authorship: which expressive elements came from a human rather than from the system?

The statute does not grant a copyright merely because someone owns the computer, paid for an AI service, wrote a prompt, or pressed a generation button. The claim must identify original expression attributable to a human author. AI can be part of the production process, but it cannot supply the human authorship required for the machine-determined portions.

Three ways human authorship can appear in the book

1. Human-written expression that remains visible

If you write chapters, scenes, dialogue, descriptions, narration, or other passages yourself, those passages can be protected when they meet ordinary originality requirements. AI may help brainstorm, check grammar, suggest alternatives, or perform another assistive function without automatically disqualifying the surrounding human writing. The registration covers the human expression, not any unaltered machine wording embedded in it.

Human authorship must be perceptible in the work being claimed. Private effort that leaves no expressive trace in the manuscript is not enough by itself. For example, using an AI tool to generate ideas and then writing an original scene in your own words leaves a human-authored scene in the output. Merely deciding that an AI-generated scene sounds acceptable leaves much less evidence of human expression.

2. Creative selection, coordination, or arrangement

A book can contain AI-generated components and still have protectable human authorship in the way those components are chosen and organized. The selection must involve creative judgment rather than purely mechanical sorting. Coordination can include deciding how disparate generated passages work together, changing their relationships, or building a coherent narrative structure. Arrangement can include an original sequence, chapter architecture, framing device, or editorial presentation.

Protection in this situation attaches to the human-authored compilation or arrangement to the extent that the choices are sufficiently creative. It does not turn every selected AI passage into human-authored prose. Another person may not be barred by your copyright from using machine-determined wording simply because you placed that wording in your book; your claim is directed to the protectable selection, coordination, arrangement, and any other human expression.

3. Creative modifications to AI output

Rewriting, expanding, compressing, restructuring, and otherwise transforming generated text can create protectable expression when the changes reflect meaningful creative decisions. The relevant question is not how many keystrokes or revisions you made. It is whether the final language, characterization, pacing, imagery, organization, or other expressive features are the result of human authorship.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Copyediting that fixes spelling or punctuation may improve a manuscript without adding much copyrightable expression. By contrast, replacing generic paragraphs with distinctive narration, recasting a scene in a deliberate voice, combining multiple outputs into a new passage, or inventing connective material can leave a substantial human contribution. The Office does not prescribe a percentage of human editing that guarantees protection.

Why a prompt alone usually is not enough

A prompt can contain original ideas, instructions, characters, themes, or plot requirements. The Copyright Office nevertheless says prompts alone do not establish authorship of the expressive output when the system determines the wording or other expressive elements. A detailed instruction such as “write a 3,000-word mystery in first person with alternating timelines” may influence the result, but influence is not the same as personally authoring the generated sentences.

Prompts can still matter as evidence of your creative process and as a way to direct an assistive tool. They do not, by themselves, give you a copyright in every output produced from them. If the prompt itself contains original prose, that prose may be evaluated separately as human-authored expression, while the generated response is analyzed under the human-authorship standard.

How common production patterns are evaluated

The following comparison applies the Copyright Office’s stated factors: the source of expressive elements, human control and revision, whether the contribution is perceptible, creative selection or arrangement, and registration disclosure.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
Book-making pattern Expressive source Human control and revision Likely copyright scope Disclosure issue
AI generates a passage that is published unchanged Predominantly AI Prompt and acceptance only The machine-determined passage is not independently protected; any separate human text may be protected. Disclose the AI material if it is more than de minimis.
Human writes the manuscript and uses AI for brainstorming or proofreading Predominantly human Human composes the final wording Human-authored expression can be protected; assistive use does not automatically defeat copyright. Describe AI-generated material when it remains in the submitted work and is more than de minimis.
AI supplies a draft that the author substantially rewrites Mixed Human rewrites, adds, removes, and reshapes expression Protection may cover the human-authored revisions and resulting expression, not unchanged machine wording. Identify the AI material and explain the human contribution.
Author assembles selected AI passages into an original structure Mixed Creative selection, coordination, and arrangement The human-authored compilation or arrangement may be protected to the extent it is sufficiently creative. Disclose the AI material and the compilation contribution.
Author supplies only a high-level prompt and publishes the output Predominantly AI Limited human expressive control The prompt does not establish authorship of the generated prose; protection is limited to any separate human expression. AI disclosure is required when the generated material is more than de minimis.

These are practical applications of the Office’s principles, not guaranteed outcomes. A registration examiner can evaluate the actual manuscript and the claimed contribution differently depending on the facts.

Do you own the copyright to an AI-generated novel?

Ownership is the wrong first question if the novel’s expressive elements were generated without sufficient human authorship. The U.S. position described by the Copyright Office is that machine-determined expression is not independently protected by copyright. A person cannot obtain exclusive copyright in that expression simply by commissioning it, possessing the output, or publishing it.

If the novel combines generated material with your own writing, your claim can cover your original passages and any sufficiently creative selection, arrangement, coordination, or modification. The registration record should make that division clear. The result may be a book with copyright protection in some portions and no independent copyright protection in other portions, rather than an all-or-nothing answer for the entire file.

Copyrightability is also distinct from any contract or usage terms governing an AI service. Those terms can affect what a provider permits you to do with an output, but they do not replace the U.S. law requirement for human authorship. The material here addresses copyright, not the terms of a particular service.

How to disclose generative-AI material when registering

The Copyright Office’s March 16, 2023 guidance says applicants have a duty to disclose AI-generated content in works submitted for registration. When the AI material is more than de minimis, the applicant should identify it and provide a brief statement describing the human author’s contributions. The guidance does not set a universal word count or percentage that defines “more than de minimis,” so describe the actual role AI played in your manuscript.

  1. Separate the components. Review the final book and identify passages, images, or other material generated by an AI system rather than written or created by you.
  2. Assess whether the AI material is more than de minimis. If generated content is a substantive part of the submitted work, do not omit it from the application.
  3. Disclose the material. Identify the AI-generated portions in the application and provide a concise explanation of what you contributed, such as original text, rewriting, creative arrangement, or selection.
  4. Describe the claim accurately. Claim the human-authored expression and compilation or modifications you created, rather than asserting authorship of unchanged machine output.
  5. Correct an omission. The 2023 guidance explains that applicants can update a pending application and correct the public record when required disclosure was left out.

A practical recordkeeping system can make this process easier. Keep dated drafts showing your original passages, prompt and output records, revision history, and notes identifying why you selected, reordered, combined, or rewrote particular material. The Office’s guidance requires disclosure and a description of the human contribution; this documentation list is a practical editorial recommendation, not a quoted Office checklist.

What the Copyright Office’s examples show

A Recent Entrance to Paradise

The Review Board affirmed refusal to register A Recent Entrance to Paradise, a work claimed to have been generated with no human involvement. The example illustrates the boundary at the extreme end: when no person contributed authorship to the expressive elements, there is no human-authored expression for a copyright registration to protect.

Zarya of the Dawn

The Office later registered the comic book Zarya of the Dawn for its human-authored text and its human selection, coordination, and arrangement. It excluded the Midjourney images that were not the product of human authorship. The registration demonstrates that one work can contain both protectable human contributions and excluded AI-generated material.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Since the 2023 guidance, the Office has reported registering hundreds of works that incorporate AI-generated material, with registration covering the human author’s contribution. During its AI initiative, the Office also reported receiving more than 10,000 responsive comments. Those figures show that AI use does not automatically prevent registration, while the scope of each registration still depends on the human contribution in the particular work.

How much editing is enough?

There is no official “minimum number of edits,” page count, or human-written percentage that guarantees copyright. Focus instead on the character of the final expression:

  • Did you choose distinctive wording, imagery, dialogue, or narrative voice?
  • Did you invent or materially reshape scenes, characters, structure, or transitions?
  • Can a reader perceive your expressive contribution in the finished book?
  • Did your selection and arrangement create an original compilation rather than a mechanical list?
  • Can your drafts and revision history explain which portions you authored and which the system generated?

Heavy factual checking, formatting, or proofreading may be important to publication but does not automatically add copyrightable expression. Conversely, a shorter intervention can be significant if it determines the final expressive choices. The legal analysis is qualitative and tied to the work as submitted.

What to do before publishing

  1. Decide which parts of the manuscript are entirely human-written, AI-generated, or mixed.
  2. Preserve drafts and records that show your creative decisions and revisions.
  3. Review the final file for unchanged generated passages and mark them for disclosure.
  4. Prepare a registration statement that identifies the AI material and accurately describes your human authorship.
  5. Limit the claimed scope to human expression, creative compilation or arrangement, and creative modifications.
  6. If the work is commercially important or the authorship split is difficult to describe, obtain advice from a U.S. copyright attorney before filing.

The Copyright Office’s governing principle

Shira Perlmutter, Register of Copyrights and Director of the U.S. Copyright Office, summarized the policy in 2025: “After considering the extensive public comments and the current state of technological development, our conclusions turn on the centrality of human creativity to copyright. Where that creativity is expressed through the use of AI systems, it continues to enjoy protection. Extending protection to material whose expressive elements are determined by a machine, however, would undermine rather than further the constitutional goals of copyright.”

Applied to a book, that principle means generative AI can assist the writing process, but the enforceable copyright claim must be grounded in expression you authored or creatively shaped.
