Yes. Small businesses can now find affirmative AI liability insurance, including a product announced specifically for small businesses by HSB on March 18, 2026. It remains an emerging specialty market, not a standardized policy available on identical terms everywhere. Eligibility, limits, exclusions, pricing and even whether a carrier will offer coverage depend on your state, industry, revenue, AI workflow and risk controls.
For most companies, the practical answer is a coordinated program: evaluate affirmative AI wording alongside technology errors-and-omissions (E&O) or professional liability, cyber liability and, where relevant, general liability, D&O and EPLI. Do not assume a conventional policy covers an AI mistake merely because the loss happened through software.

What AI liability insurance is—and why ordinary policies may not be enough
AI liability insurance is coverage written to respond to claims arising from the development, sale, configuration or use of artificial-intelligence systems. “Affirmative” wording names AI-related claims and addresses them expressly, rather than leaving the insurer and policyholder to argue whether a conventional insuring agreement applies after a loss.

HSB/Munich Re announced “AI Liability Insurance for Small Businesses” on March 18, 2026, describing protection for lawsuits resulting from the use of AI technologies. Specialty-market providers such as Mayflower and Axiom also describe affirmative AI modules. These offerings are not uniform: obtain the actual form, endorsements and underwriting requirements rather than relying on a product name.
Which businesses can seek coverage?
Underwriters generally distinguish among four roles. Your role affects both the likely policy and the questions on the application.
AI developers and model providers
Companies that build models, train systems, supply APIs or embed automated recommendations face allegations that a product malfunctioned, produced discriminatory results, exposed confidential material or infringed intellectual-property rights. Professional liability or technology E&O is usually a core layer, with affirmative AI wording considered for model-specific exposures.

A software company adding a generative feature, scoring engine or automated workflow can face a customer claim even when it did not train the underlying model. The contract, service description, model vendor terms and allocation of responsibility all matter. Ask whether vendors, subcontractors and hosted models are included in the definition of covered technology services.
Consultants, implementers and managed-service firms
Consultants that select, configure, fine-tune or monitor an AI system can be sued over advice or implementation errors. Professional liability is often the closest existing coverage, while AI-specific wording can clarify claims involving the configured system.

Businesses that only use AI internally
A retailer using an automated support agent, a manufacturer using predictive maintenance or an employer using a screening tool may not need a standalone AI policy. Nevertheless, the company can face a third-party claim, regulator inquiry, privacy allegation or employment dispute. Its existing E&O, cyber, EPLI, D&O and general-liability policies should be reviewed for AI exclusions and affirmative coverage.
What affirmative AI coverage may respond to
Coverage varies by form and elected modules. Specialty descriptions identify several possible categories:
Free tools Windows power users keep installed
One-click scans. No signup required.
- Third-party claims from AI output: A customer alleges that an erroneous recommendation, hallucinated answer or automated action caused financial loss.
- Wrongful disclosure through output: An AI system reproduces confidential, personal or regulated information in a response.
- Bias or discrimination allegations: A claimant says an automated decision treated a protected group unlawfully. Whether defense, settlement or regulatory components are covered must be confirmed; many policies sublimit or exclude these allegations.
- Intellectual-property claims: A claimant alleges that generated text, images, code or other output infringed a copyright, trademark, trade secret or other right. Some forms cover defense only, impose a sublimit or exclude knowingly supplied material.
- Regulatory proceedings: A module may pay defense costs for an investigation or proceeding within its stated scope. A civil fine, penalty or non-insurable restitution is a different question.
- Errors in professional services or software performance: The claim may be addressed under technology E&O even when the immediate cause was an AI component.
“Covered” does not necessarily mean the insurer pays every component of a loss. Check the trigger, definitions, exclusions, sublimits, retention, aggregate and treatment of defense expenses.
Technology E&O and professional liability: the main alternative
Professional liability, also called errors and omissions insurance, responds to allegations that a professional service provider made a wrongful error, omission or failure to meet a professional standard. The National Association of Insurance Commissioners describes it as coverage for mistakes in advice, delivery or professional services.
For technology companies, technology E&O is often the most practical foundation. Insureon describes it as protection for mistakes affecting clients and notes that a technology E&O policy can add third-party cyber coverage. Aon states that organizations developing AI need professional liability or technology E&O.

E&O is not automatically AI insurance. Ask whether “professional services,” “technology product,” “software,” “failure to perform” and “wrongful act” definitions include the actual AI workflow. A policy written for ordinary software may exclude algorithmic decisions, intellectual-property claims, bodily injury, intentional acts or contractual promises. If a customer’s contract requires a particular result, the contractual-liability exclusion can become decisive.
Cyber insurance: useful, but not a substitute for AI liability
Cyber policies primarily address security and privacy events. Depending on the form, they can cover breach investigation, notification, restoration, ransomware response, business interruption and third-party privacy liability.
Cyber insurance should not be assumed to cover an incorrect AI output that causes a client’s economic loss. Mayflower describes affirmative AI coverage as sitting beside cyber rather than replacing breach response, ransomware or business-interruption protection. Gallagher Re likewise warns that third-party liability from generative-AI outputs may require specialized coverage in addition to cyber.
Use a simple distinction when reviewing a claim: was there a security or privacy event, or was there an inaccurate, biased or otherwise harmful output without a security event? The first may fit cyber; the second is more likely to require E&O or affirmative AI wording. A single incident can involve both, so coordinate limits and defense provisions.
Other policies that may matter
| Coverage | Potential AI-related role | What you must verify |
|---|---|---|
| General liability | Some bodily injury, property damage or personal-and-advertising-injury allegations | AI, technology, professional-services and intellectual-property exclusions; economic-loss limitations |
| Intellectual-property insurance | Defense or indemnity for specified IP claims | Covered rights, knowledge exclusions, generated content treatment and sublimits |
| Umbrella or excess liability | Additional limits above underlying policies | Whether the umbrella follows AI exclusions and whether underlying coverage is required |
| D&O | Governance, disclosure or investor claims involving AI strategy | Conduct exclusions, entity coverage and regulatory wording |
| EPLI | Employment claims involving automated recruiting, promotion or termination decisions | Algorithmic-decision exclusions, definition of employment practices and third-party coverage |
None of these lines should be presumed to cover AI. The policy wording and exclusions control.

How much does AI liability insurance cost?
No cited public source publishes a universal standalone AI-liability premium, deductible, minimum-revenue rule or state-by-state eligibility table. Quotes are use-case-specific. The following figures are directional benchmarks for related coverage, not an AI tariff.
| Benchmark | Published figure | Qualification |
|---|---|---|
| Commercial E&O | $50 per month median; $69 average | Progressive Commercial, 2025, national median and average for new commercial customers; risk, industry, company size and limits affect price |
| Technology E&O | $110 per month median | Insureon technology-business customers, page current in 2026; limits, deductibles, location, employees and risk affect price |
| Cyber liability | $179 per month median | Insureon technology-business customers, page current in 2026; not an AI-liability price |
| General liability | $37 per month median | Insureon technology-business customers, page current in 2026; separate coverage with different triggers |
An AI-specific quote can be below or above these amounts. Underwriters may charge more for high limits, broad territories, consumer-facing decisions, regulated data, autonomous actions, large contract indemnities, little human review or a poor claims history. A narrow internal tool with strong controls may price differently from a public chatbot that gives financial, medical or employment recommendations.
What underwriters ask for
A complete, consistent application can improve the quality of the quote and reduce later coverage disputes. Prepare the following before approaching a broker or carrier.
AI inventory and business role
- List every model, API, plug-in, agent, chatbot and automated decision system.
- State whether you develop, resell, configure, integrate or merely use each system.
- Identify the business process, affected customers and whether the system can take action without approval.
Data, geography and affected people
- Describe personal, health, financial, confidential, proprietary and regulated data sent to each vendor.
- Identify storage and processing jurisdictions, customer locations and cross-border transfers.
- Explain whether outputs affect consumers, employees, applicants, patients or other protected groups.
Controls and governance
- Document human review, approval thresholds, testing and validation before release.
- Record monitoring for hallucinations, drift, bias, security incidents and model changes.
- Explain access controls, retention, deletion, prompt handling and vendor security reviews.
- Maintain an incident-response plan with escalation, customer notification and evidence preservation.
Contracts and history
- Provide customer agreements, service descriptions, indemnities, limitation-of-liability clauses and required insurance terms.
- Review model-vendor terms for training on customer data, output ownership, confidentiality and indemnification.
- Disclose prior claims, complaints, regulatory inquiries, outages and unresolved incidents.
- State requested limits, retentions, territories, retroactive date and target policy period.
NAIC work on AI governance emphasizes risk management, model evaluation and data inputs. Specialty-market guidance similarly points to documented inventories, governance and testing as useful underwriting evidence.
Exclusions and policy details to examine
Ask for the complete policy and every endorsement, not only a certificate or marketing summary. Compare these items in writing:
Best Value
- AI definition and covered acts: Does “AI system” include generative models, third-party APIs, automated decisions, agents and configuration work?
- Affirmative wording versus silence: Is AI expressly covered, expressly excluded or left to an uncertain interpretation?
- Output and input: Are claims based on generated content, training data, prompts or a vendor’s model covered?
- Bias, discrimination and employment: Are defense and indemnity available, and does EPLI respond instead?
- Privacy and confidentiality: Does wrongful disclosure through an output trigger AI coverage, cyber coverage or both?
- Intellectual property: Which rights are covered, and are allegations involving knowingly infringing material excluded?
- Regulatory proceedings: Are investigations covered, and are fines, penalties or restitution uninsurable or excluded?
- Contractual liability: Does a promise in a customer contract expand liability beyond negligence?
- Defense costs: Are they inside or outside the limit, and who controls defense and settlement?
- Sublimits, retention and aggregate: Is a headline limit reduced for AI, privacy, IP, regulatory or reputational-loss claims?
- Retroactive date and reporting: For claims-made coverage, are prior acts covered and how quickly must circumstances or claims be reported?
- Territory and jurisdiction: Does the policy respond to claims brought where your customers, data or vendors are located?
- Vendors and subcontractors: Are cloud providers, model suppliers and implementation partners included or only your own acts?
Matching common scenarios to coverage
| Scenario | Likely coverage conversation | Important uncertainty |
|---|---|---|
| Customer relies on an AI-generated recommendation and loses money | Technology E&O, professional liability and affirmative AI | Whether economic loss from an output is a covered wrongful act or excluded performance guarantee |
| Chatbot reveals another customer’s confidential information | Cyber/privacy liability and affirmative AI wrongful-disclosure wording | Whether the event qualifies as a security incident and whether AI coverage has a sublimit |
| Hiring tool rejects applicants from a protected group | EPLI, affirmative AI and possibly regulatory coverage | Algorithmic-discrimination exclusions, defense-cost treatment and insurability of penalties |
| Generated code or image prompts an infringement suit | Technology E&O or IP insurance, with AI wording | Copyright, trademark and trade-secret treatment; knowledge and contract exclusions |
| Model outage interrupts a customer’s operations | Technology E&O; business-interruption coverage only if its trigger is met | Whether the policy covers a vendor outage, service-level promise or purely financial loss |
| Regulator investigates an automated decision | Affirmative AI regulatory-defense module, D&O or EPLI depending on facts | Investigation definition, permitted defense costs and excluded fines or penalties |
How to buy coverage: a practical sequence
- Map the workflow. Write the exact data flow from user input to model, human review, output and any automated action. Include foreseeable harm scenarios.
- Gather the forms. Request the full AI, E&O, cyber, GL, D&O and EPLI policies, endorsements and exclusions from your broker or carrier.
- Ask for a scenario map. Have the broker identify which policy responds to hallucination, bias, IP, privacy, regulatory and contractual-liability claims, and where no policy responds.
- Align limits and defense. Coordinate per-claim limits, aggregates, retentions, sublimits and whether defense erodes limits. Check excess coverage for matching exclusions.
- Confirm eligibility. Obtain written confirmation of state availability, covered territories, retroactive date, vendor treatment and any minimum-revenue or industry conditions.
- Disclose accurately. Describe every material AI use, control and known incident. An incomplete application can create rescission or coverage disputes.
- Compare the final terms. Evaluate the premium against exclusions and retention, not against the headline limit alone. Bind only after receiving the final quote and endorsements.
When an alternative may be more sensible
Rely primarily on technology E&O
This can be reasonable for a small developer, SaaS vendor or consultant whose main exposure is professional-service error and whose policy expressly covers the AI-enabled service. Obtain written confirmation that the model and output are within scope.
Add affirmative AI to an existing program
An AI endorsement or module may close a defined gap without replacing cyber or E&O. This approach is useful when the company has a mature insurance program but a new AI workflow.
Use contractual and operational controls
Insurance is only one layer. Limit high-risk automated actions, require human approval, restrict sensitive data, log prompts and outputs, test before deployment, monitor changes and give customers clear disclosures. Contracts should allocate responsibilities without promising an uninsurable result.
Do these 3 things before closing this tab:
1Clear out junk files and repair common Windows errors2Fix the driver behind crashes, sound loss and screen glitches3Repair Windows errors before they cause bigger problemsRetain a predictable, low-severity risk
A very small company may choose a higher retention or self-insure routine incidents while buying protection for severe third-party claims. Make that decision after modeling cash reserves, contractual requirements and plausible worst-case losses; do not treat self-insurance as proof that an excluded claim is covered.
Questions to ask a broker or carrier
- Is affirmative AI coverage available for my state, industry and exact use case?
- Which claims involving hallucination, bias, discrimination, IP, privacy, regulatory action and contractual promises are covered, excluded or sublimited?
- Does the policy cover AI systems supplied by vendors, and are vendors’ acts imputed to my business?
- Are defense costs inside or outside the limit? Who selects counsel and controls settlement?
- What are the retention, aggregate, retroactive date, reporting deadline and territorial limits?
- How does this policy coordinate with my technology E&O, cyber, GL, D&O and EPLI policies?
- What documentation or controls must remain in place as a condition of coverage?
- Can you confirm eligibility, limits, deductible or retention and premium in writing before binding?
Bottom line for a small-business buyer
AI liability insurance is available to at least some small businesses, but it is a developing specialty market with no universal price or standard form. Start with a documented AI inventory and workflow, then test the actual policy wording against realistic harm scenarios. For most businesses, the strongest approach is coordinated affirmative AI, technology E&O or professional liability and cyber coverage, supplemented by EPLI, D&O, general liability or IP insurance when the use case warrants it.
