Yes—many open-weight models can be used in commercial products, but “open” is not a single legal category. Apache 2.0 releases generally permit commercial use, modification and redistribution, while community, modified-MIT, research and custom licenses can add attribution, acceptable-use, trade-compliance, revenue or platform conditions. Check the exact model version, its license, model card and usage policy before deploying it or selling anything built with it.

What commercial use actually covers

Commercial use is broader than putting a model behind a paid API. It can include running weights inside a company, embedding inference in a paid application, charging for outputs, fine-tuning a checkpoint for customers, distributing model files, or using generated text and code in a product. A license may allow one of those activities while restricting another.

“Open model” can describe downloadable weights without promising open-source rights. The legal terms attached to the specific artifact control. A project may publish one checkpoint under Apache 2.0, another under a modified MIT license, and a third under a research or non-commercial license. Even when the weight license is permissive, separate policies can restrict unsafe uses, exports, or how the service is operated.

The first step: identify the exact artifact

Do not rely on a family name such as “Llama,” “Qwen” or “Mistral.” Record the exact model name, version, repository, commit or release tag, quantized file (if applicable), and download date. A quantized or community-converted file can carry additional code, tokenizer or distribution terms that differ from the original release.

Keep local copies of the license text, model card, acceptable-use policy, safety policy and every notice bundled with the download. If the repository points to separate terms, preserve those pages as part of your release record. Re-check them whenever you upgrade: permission, thresholds and prohibited uses can change between versions.

How the major license patterns differ

License or term pattern Commercial use Modification and redistribution Typical obligations to verify
Apache 2.0 Generally permitted Modification and redistribution are generally permitted Keep license and notices, mark changes, preserve patent and attribution terms; follow any separate usage policy
MIT or modified MIT Often permitted, but modified clauses can add conditions Usually broad, subject to the modified text Attribution, notice language, revenue or platform thresholds, and restrictions added by the model publisher
Community license May be permitted with use-case, geography or scale limits May require notices, naming rules or downstream terms Acceptable-use policy, legal and trade-compliance duties, redistribution wording and trademark rules
Research or non-commercial license Not permitted for ordinary commercial deployment unless an additional license is obtained Often limited to research sharing Whether internal business evaluation is allowed and what event triggers a commercial license
Hosted-service terms Controlled by the provider agreement rather than a weight license You may not receive redistributable weights Data handling, output rights, rate limits, prohibited uses, account restrictions and termination rights

Apache 2.0 is permissive, not unconditional. OpenAI’s gpt-oss documentation describes it this way: “Apache 2.0 allows broad use, modification, and redistribution, including commercial use (subject to our gpt-oss usage policy).” The parenthetical matters: a usage policy can prohibit conduct that the copyright license alone would not address.

Model-specific licensing points

OpenAI gpt-oss

gpt-oss weights are released under Apache 2.0 and are intended to run on customer-controlled infrastructure or through hosting providers. Commercial deployment, modification and redistribution therefore start from a permissive copyright license, but the gpt-oss usage policy still applies. Review that policy for prohibited applications, safety requirements and any operational conditions before launch. Self-hosting does not remove those obligations.

Mistral models

Mistral states that most of its open-source models use Apache 2.0, allowing use for any purpose, free distribution, modification and sharing of modified versions. That statement does not cover every Mistral release. Certain models use modified MIT terms under which a company with more than $20 million in monthly revenue must obtain a commercial license or use Mistral Studio. Treat the threshold as a condition of the particular model’s license, not as a rule for the entire product line; verify how “monthly revenue,” affiliated entities and the relevant deployment are defined.

Meta Llama 3

Llama 3 uses the Meta Llama 3 Community License rather than Apache 2.0. Distributors must retain the notice: “Meta Llama 3 is licensed under the Meta Llama 3 Community License, Copyright © Meta Platforms, Inc.” The license also requires compliance with applicable law, trade-compliance laws and the incorporated Acceptable Use Policy. Preserve the notice in source distributions, containers, documentation and other places where license notices for your product appear. Check any naming, redistribution and scale conditions in the version you received.

Qwen

Qwen’s project guidance tells users to inspect the license accompanying each model. Do not infer commercial permission from one Qwen release to another. Pin the specific checkpoint and read its attached terms, including any restrictions on derivatives, redistribution, geography or use case.

NVIDIA open models

NVIDIA distributes some models under custom agreements that condition use on compliance with NVIDIA Trustworthy AI terms and preservation of applicable third-party license rights. The model agreement, not the marketing label “open,” determines whether your planned use is allowed and what notices must travel with a derivative.

A practical compliance workflow

  1. Pin the asset. Record the exact model, version, repository, commit or release tag, file hash and any quantization or conversion step.
  2. Collect the governing documents. Save the license, model card, acceptable-use or safety policy, trademark guidance and bundled third-party notices.
  3. Classify the terms. Mark the release as Apache 2.0, MIT, modified MIT, community, research/non-commercial or a hosted-service offering. If the text is custom, have counsel review it rather than guessing from a familiar label.
  4. Test your business plan against the clauses. Check commercial permission, prohibited uses, geography and export controls, attribution, redistribution, derivative and fine-tuning rights, user or revenue thresholds, and requirements imposed on downstream recipients.
  5. Inventory other rights. List training and fine-tuning data, prompts, generated outputs, trademarks, tokenizer or runtime code, and every third-party package. Obtain permissions where the model license does not provide them.
  6. Build notice handling into releases. Keep required license text and attribution in source packages, model cards, container images, documentation and customer notices. Record modifications and preserve third-party notices.
  7. Document operations. For self-hosting, assign owners for security, access control, logging, abuse monitoring, incident response, model updates and deletion of sensitive data. For hosted inference, review the provider’s service agreement and data-handling terms.
  8. Re-check before each upgrade. A new parameter size, checkpoint, tokenizer or safety policy can carry different permissions even when the family name is unchanged.

Rights that the weight license does not settle

Training and fine-tuning data

A model license normally governs the released weights, not every dataset used to train or adapt them. Confirm that you can lawfully collect, store and use customer records, copyrighted works, personal data and confidential material in fine-tuning. Contractual confidentiality, privacy law, data-protection obligations and sector rules may apply even when the model itself is Apache 2.0.

Generated outputs

Output ownership and infringement risk are separate questions. A license may grant broad rights to the weights without guaranteeing that every output is protectable, unique or free of third-party claims. OpenAI’s service terms warn that code-generation output “may be subject to third party licenses, including, without limitation, open source licenses.” Apply code scanning, human review and provenance controls before shipping generated code or content.

Trademarks and product names

Copyright permission to redistribute weights does not automatically grant trademark rights. Follow the publisher’s naming and logo rules, and avoid implying endorsement. Keep the required Llama notice or other attribution text distinct from branding that suggests an official product.

Third-party software and model components

Inference servers, tokenizers, drivers, datasets and sample code can have their own licenses. Inventory them in a software bill of materials and make sure your container and installer preserve their notices. A permissive model license cannot override a copyleft or proprietary term attached to a component you add.

Self-hosting versus hosted inference

Question Self-hosted weights Hosted inference
Who operates the infrastructure? Your organization or its infrastructure provider The inference provider under its service agreement
Primary compliance work License notices, security, access, monitoring, updates, incident response and data retention Provider terms, permitted inputs and outputs, privacy, retention, account limits and suspension rights
Can you redistribute weights? Only if the model license permits it and required notices follow the distribution Usually no; you receive a service, not a redistributable copy of weights
Data control You configure storage and network boundaries, but remain responsible for implementation Depends on the provider’s stated training, retention and regional-processing terms

Self-hosting can improve control over data and latency, but it does not turn a restricted model into an unrestricted one. Hosted inference may simplify patching and scaling while introducing contractual limits, logging practices and geographic processing questions.

Common commercial scenarios

Selling an application that calls an open model

This is usually feasible when the model permits commercial use. Keep the model’s notices, comply with its acceptable-use and trade rules, and review your own application’s data collection, output moderation and third-party components. If customers can download the weights, treat that as redistribution and apply every downstream condition.

Fine-tuning and selling a specialized model

Check whether the license permits derivatives and whether it imposes notice, naming or attribution rules on fine-tuned weights. Separately clear your fine-tuning dataset and document what changed. If the resulting checkpoint is distributed, include the original license and any required policy text.

Using a model internally

Internal use can still be commercial use. Confirm that the license allows business use, restrict employee access to approved data, and define retention and monitoring controls. “Not customer-facing” is not a substitute for a license grant.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Offering model outputs as a service

Verify that the model terms allow your use case, then address output review, abuse handling, privacy disclosures and service-level commitments. A hosted provider’s agreement may prohibit transferring API keys, bypassing usage limits or evading safety mitigations. OpenAI’s Services Agreement, for example, prohibits using services or customer content unlawfully and restricts reverse engineering, key transfer and bypassing limits or safeguards.

Frequent compliance failures and fixes

  • Relying on the family name: Replace assumptions with a versioned license record and file hash.
  • Keeping attribution only in an internal repository: Put required notices wherever customers receive software, containers, documentation or model files.
  • Ignoring thresholds: Check revenue, user-count, geography and platform conditions before launch and whenever your business grows.
  • Assuming outputs are automatically safe to ship: Scan generated code and content for third-party material, secrets, personal data and policy violations.
  • Forgetting converted or quantized files: Trace the conversion tool, tokenizer and additional code licenses as well as the original weights.
  • Treating self-hosting as a compliance exemption: Assign operational owners for security, monitoring, updates and incident response.
  • Failing to re-check upgrades: Make license and policy review a release gate for every new checkpoint.

When to obtain legal review

Escalate to counsel when the license is custom or ambiguous, your revenue may exceed a stated threshold, you distribute fine-tuned weights, you process regulated or personal data, you operate across export-controlled regions, or your product could fall within a prohibited-use category. Ask for a written interpretation tied to the exact version and deployment model; a generic statement that the model is “open” is not enough.

Launch checklist

  • Exact model, version, repository and artifact recorded
  • License, model card, usage policy and notices archived
  • Commercial, derivative and redistribution rights confirmed
  • Attribution, trademark and downstream notice text implemented
  • Revenue, user, geography, trade and prohibited-use clauses checked
  • Training, fine-tuning, prompt and output data rights documented
  • Third-party code, tokenizer, runtime and dataset licenses inventoried
  • Self-hosting security or hosted-provider data terms approved
  • Upgrade review scheduled before the next model release

The Bottom Line

Commercial use is often allowed, especially under Apache 2.0, but permission comes from the exact model’s license and accompanying policies—not from the word “open.” Pin the artifact, preserve notices, clear data and output rights, meet any thresholds or safety rules, and repeat the review for every upgrade.
