Sometimes—but there is no universal rule. Whether an investigator may pose as a client depends on the country, the investigator’s official role, and what the operation involves. A law-enforcement agency’s authority does not automatically extend to a private investigator or citizen, and a cover identity alone does not authorize searches, access to protected information, or seizure of cryptoassets.
What determines whether the undercover contact is lawful?
Three facts matter first: who is investigating, where the conduct takes place, and what the investigator plans to do. Local law and agency rules may govern undercover identities, inducement or instigation, privacy, recording, handling money, and harm to third parties. Rules can also differ between a simple inquiry under a cover name and an operation that goes further.

Official examples illustrate why a country-specific answer is necessary; they do not establish a general permission to pose as a client:
| Source and jurisdiction | What it establishes | What it does not establish |
|---|---|---|
| FBI Attorney General’s Guidelines, United States | The cited archived version, revised November 13, 1992, describes undercover activity as investigative work using an assumed name or cover identity by FBI staff or other federal, state, or local officers working with the FBI. It says the FBI may use undercover activity appropriate to its law-enforcement responsibilities, subject to the guidelines. | It is not a statement of every agency’s current policy and does not decide whether a particular investigator or proposed contact is authorized. |
| U.S. Code oversight provisions | Specified FBI and DEA undercover operations are subject to oversight and reporting rules. | Those controls are not, by themselves, authority for a particular investigator to pose as a client. |
| UK Proceeds of Crime Act investigations code | This UK procedural code addresses official investigation powers, including cryptoasset investigations, and advises seeking legal guidance where necessary. | It is not authority for undercover client posing outside its scope, nor a general rule for other countries. |
| UAE 2021 amending decree | The decree defines an undercover operation as an investigation by a judicial impoundment officer using impersonation or a disguised role to obtain information or evidence. | This definition applies to that instrument and jurisdiction; it should not be treated as a rule for other investigators or countries. |
| UNODC Practical Guide on the Investigation of Corruption Cases (2024) | The guide identifies jurisdiction-specific questions about immunity, provocation or instigation, and protections for undercover agents, as well as risks such as privacy interference, entrapment claims, third-party harm, and liability. | It is practical guidance, not binding law in every jurisdiction. |
The U.S. Code example is evidence of formal controls on specified official operations, not a stand-alone grant of undercover authority. Likewise, a procedure for investigating cryptoassets does not necessarily authorize every method used to investigate them.

A cover identity does not grant every investigative power
Legality depends on the conduct, not just the name or persona used. A covert conversation, a recording, an attempt to prompt someone to commit an offence, and a financial transaction can raise different legal questions. Assess privacy intrusion, inducement or instigation, recording rules, potential third-party harm, and liability under the applicable local law.
Keep separate powers separate. Using a cover identity does not automatically authorize a search, access to protected communications or account information, a financial transaction, or seizure of assets. Those actions may require a distinct legal basis, authorization, warrant, or court order under the relevant rules.

What blockchain tracing can—and cannot—show
Transaction tracing can follow cryptoasset movements and may identify a service provider or exchange as a point where investigators could seek further information. The FBI’s Internet Crime Complaint Center (IC3) says law enforcement can trace cryptocurrency transactions to follow money, while noting that transfers to overseas exchanges and differences in anti-money-laundering regimes can complicate investigations.

The U.S. Department of Justice’s digital-assets report discusses obfuscation methods such as chain-hopping and mixers. It also notes that many exchanges and other digital-asset businesses may qualify as money transmitters with U.S. anti-money-laundering obligations. Whether those rules apply to a particular service or transaction depends on the facts and jurisdiction.

What to establish before a specific operation
A case-specific answer needs more than the label “investigator.” Before contact or any movement of funds, establish:
- Jurisdiction: the country or countries where the investigator, target, platform, and relevant conduct are located.
- Investigator’s status: whether the person is a law-enforcement officer, regulator, licensed private investigator, journalist, or private citizen, and what authority applies to that role.
- Planned conduct: whether the plan is limited to a cover inquiry or includes inducement, recording, access to information, or sending or receiving funds.
- Required approvals: what agency approval, warrant, court order, or other legal basis is needed for each distinct action.
- Evidence and recovery: how the method may affect admissibility, privacy protections, third parties, and the practical prospect of recovering assets.
UNODC’s 2024 guide advises investigators to understand local rules on undercover-agent immunity, whether conduct could amount to provocation or instigation, and what protections are available during operations and trials. For an actual operation, confirm those issues with qualified counsel in the relevant jurisdiction or the responsible agency before making contact.
