Whether a particular firing, layoff, hiring decision, or workplace practice is lawful depends on the facts, the applicable protections, and the jurisdiction. State and local law, contracts, and union agreements may also matter.
Can my employer fire or lay me off because of AI?
AI involvement alone does not make a job loss automatically unlawful. The federal sources discussed here do not establish a universal right to keep a job or a blanket prohibition on replacing work with automation. But an employer still has to comply with applicable employment protections when it uses AI to make, support, or carry out a decision.

For U.S. federal discrimination law, the EEOC identifies protection against discrimination based on race, color, religion, sex (including gender, sexual orientation, and pregnancy), national origin, age 40 or older, disability, and genetic information. Those protections can apply to decisions about hiring, firing, layoffs, pay, assignments, promotions, and training. See the EEOC’s worker guidance on employment discrimination and AI and its overview of disability discrimination and employment decisions.

The EEOC’s Strategic Enforcement Plan for fiscal years 2024–2028 identifies AI and other technology used in recruiting and employment decisions as an enforcement focus when systems intentionally exclude or adversely affect protected groups. That describes agency priorities; it is not a finding that a particular employer or tool broke the law.

What if an AI tool screens me out because of a disability?
An AI assessment may create a disability-related problem if it inaccurately measures a qualified person’s ability and screens them out. The EEOC says an employer may need to provide a reasonable accommodation, such as an alternative assessment format. AI processes that request disability or medical information may also raise legal concerns. The EEOC’s Artificial Intelligence and the ADA resource explains these risks.
If a tool or assessment is inaccessible or does not accurately reflect your abilities, ask the employer how to request an accommodation or another way to demonstrate your qualifications. Keep a record of the request and the response. Federal equal-employment-opportunity law also protects workers from retaliation for asserting rights covered by those laws; the EEOC’s worker guidance describes this protection.
Does AI change my rights to wages and recorded hours?
No. Federal wage-and-hour rules continue to apply when employers use AI or automated systems. In its April 29, 2024 bulletin, the Department of Labor’s Wage and Hour Division says employees remain entitled to applicable federal protections regardless of the workplace tools used, including compensation for hours worked under the laws it administers. If an automated scheduling, timekeeping, or productivity system affects recorded hours or pay, preserve relevant schedules, time records, and pay information. This federal bulletin does not resolve every state or local wage requirement, so the rules in the relevant jurisdiction may need separate review.

Does the government require advance notice, an explanation, or human review?
The Department of Labor’s AI principles call for transparency, meaningful worker engagement, protection of workers’ rights, and AI that enhances work. Its 2024 principles for worker well-being are policy principles, not an independent statute guaranteeing every worker advance notice, an explanation, human review, or continued employment in every AI-related decision. The DOL’s AI & Inclusive Hiring Framework announcement likewise describes guidance intended to help reduce discrimination and accessibility barriers in AI-supported hiring.

The International Labour Organization’s brief Generative AI and jobs: A 2025 update, published May 20, 2025, says one in four workers globally are in occupations with some degree of generative-AI exposure. The ILO concludes that most jobs are more likely to be transformed than made redundant because human input remains necessary. Exposure is not a forecast that one in four workers will lose a job, and the statistic is global rather than U.S.-specific.
The brief reports a mean automation score of 0.29 in 2025, compared with 0.30 in 2023, using its occupational exposure measure. It combines task-level data, expert input, and AI predictions and covers nearly 30,000 tasks at the six-digit occupational level. These figures describe the study’s measure; they are not probabilities of job loss.

What should I do if I think an AI-related decision violated my rights?
- Keep relevant records. Save the job or decision notice, performance and scheduling records, pay information, communications about the tool, and any accommodation request and response.
- Ask how to raise the issue. If an assessment may be inaccurate or inaccessible, ask the employer how to request an accommodation or challenge the assessment. If hours or pay appear wrong, compare your records with the employer’s time and pay records.
- Check which rules apply. The answer can depend on the state or locality, the type of decision, any possible protected basis or accommodation need, and an employment contract or union agreement.
- Get advice from a relevant source. Depending on the issue, that may be the EEOC, the Department of Labor, a state or local agency, a union representative, or a qualified employment lawyer. The appropriate route and any deadline depend on the claim and jurisdiction, so verify them promptly.
