Yes—unless a law, contract and technical design prevent it. A cloud service can keep primary workloads in your country while sending backup copies, administrator sessions, telemetry or metadata abroad. Sovereignty therefore cannot be proved by a data-centre address alone. You must establish where each copy and data flow goes, who can access it, which legal regime applies, and whether you can produce evidence during an audit.
Residency is only one part of sovereignty
“Hosted in-country” usually describes the location of a primary production region. Sovereignty asks a wider set of questions: where live data, replicas, snapshots and disaster-recovery copies are stored and processed; where support engineers and privileged administrators work; which metadata and telemetry fields are exported; who owns and controls the provider and its subcontractors; and whether a foreign authority could compel access.

A workload in one EU country may be stored or processed in another EU country under the EU free-flow framework. The European Commission says public authorities retain access to data for regulatory control even when it is located in another EU country or stored in the cloud. A national rule, sector regulation or customer contract can still require a narrower boundary than the EU-wide baseline.
For a meaningful sovereignty claim, define the boundary in writing. It should cover customer content, metadata, telemetry, logs, encryption keys, identity systems, management planes, support tooling, replicas, backups and the software supply chain. If any item is outside the required country or legal area, the service is not fully sovereign for that requirement.

Map every place your data can travel
Ask the provider for a current data-flow diagram, not just a list of regions. The diagram should identify storage, processing, replication, backup, monitoring and support destinations, together with retention periods and the legal entity operating each component.
| Area to examine | Questions for the provider | Evidence to request |
|---|---|---|
| Primary and backup geography | Where are live data, replicas, snapshots and disaster-recovery copies stored and processed? | Region map, replication policy, backup-retention policy and a flow diagram |
| Support and privileged access | Can employees, subcontractors or follow-the-sun support teams access systems from abroad? | Support-access policy, operator locations, privileged-access logs and approval records |
| Telemetry and metadata | Which fields leave the region, for what purpose and through which analytics service? | Telemetry schema, destinations, retention period and redaction controls |
| Legal control | Who owns and controls the provider and subcontractors, and which third-country laws could apply? | Ownership chart, data-processing agreement, transfer assessment and government-request process |
| Technical control | Are encryption keys, identity, administrative planes and critical software supply-chain functions controlled in the required jurisdiction? | Key-management design, administrative-plane boundary and supply-chain attestations |
| Exit and resilience | Can you export and restore data without an overseas dependency? | Export format, tested recovery procedure, egress terms and continuity plan |
Primary storage and replicas
Replication can cross a border automatically for durability or load balancing. “Region,” “availability zone” and “backup vault” are different constructs, so require the provider to identify each one. Ask whether snapshots are copied to a central service, whether disaster-recovery activation uses a different geography, and whether deleted data remains in another location during a retention window.
Support and administrator access
Data can leave through a support session even when storage never moves. A remote engineer may view production records, run a diagnostic query or download a log from another country. Determine whether support is human, automated or subcontracted; whether access is just-in-time and approved; what is masked; and whether session recordings and commands are retained. Follow-the-sun coverage is not sovereignty unless every operator and technical path meets the required boundary.

Telemetry, logs and metadata
Telemetry may include tenant identifiers, resource names, IP addresses, error payloads, query text, user IDs or object paths. Metadata can reveal business activity even when customer content is encrypted. Obtain the schema and destination list, then confirm collection, redaction, retention and deletion settings. An analytics service operated outside the boundary is a transfer if the exported fields identify a person or expose protected business information.
Apply the correct rules to personal, mixed and non-personal data
Personal data
When personal data leaves the European Economic Area (EEA), GDPR requires a lawful transfer mechanism. The European Commission identifies adequacy decisions, standard contractual clauses (SCCs), binding corporate rules, approved certification mechanisms, codes of conduct and limited derogations as available tools. The mechanism must match the actual transfer path, including support access and telemetry, rather than only the storage region.
Mixed datasets
Datasets often combine personal and non-personal elements. Where the elements are inextricably linked, EU guidance treats the dataset under GDPR. Separating a database table or encrypting a field does not automatically remove transfer obligations if the provider can still connect the information to an identifiable person.

Non-personal data
EU policy generally supports the free movement of non-personal data within the Union. The Data Act does not prohibit cross-border data flows; instead, it provides safeguards when a third-country public body seeks access to non-personal data held in the EU. Providers should publish protective measures and, where possible, inform customers before disclosure. Measures can include encryption, audits and certification. Sector-specific secrecy, cybersecurity or public-sector rules may impose additional restrictions.

What Schrems II changes when data leaves the EEA
An SCC on its own is not the complete analysis. The Commission’s SCC guidance, following the Schrems II judgment, requires an assessment of the destination country’s laws and practices, the specific circumstances of the transfer and whether government-access powers are necessary and proportionate. If the assessment identifies a material risk, supplementary measures may be needed or the transfer must stop.
- Inventory the transfer. Record the dataset, controller and processor roles, destination, recipients, purpose, frequency, retention and every onward transfer.
- Select the mechanism. Check whether an adequacy decision applies. If not, use the appropriate SCC module, binding corporate rules or another valid tool; rely on a derogation only for its narrowly defined situation.
- Assess destination law and practice. Examine government-access powers, independent oversight, redress and the provider’s history and procedures for handling requests.
- Choose supplementary controls. Depending on the risk, use strong encryption with customer-controlled keys, minimised and pseudonymised fields, split processing, strict access controls and monitored support sessions.
- Document and review. Keep the transfer-impact assessment, technical rationale and decisions. Reassess when the provider, destination, law, data type or support model changes.
Encryption helps only if the recipient cannot obtain the usable keys. If a provider operates the key service, can decrypt on request or receives plaintext through support tooling, describe that limitation explicitly in the assessment.

How EU sovereignty criteria go beyond location
The European Commission’s Cloud and AI Development Act material describes four sovereignty levels. Level 1 begins with infrastructure located in the Union. Higher levels add independence from third countries, supply-chain transparency, Union ownership and control, and protection from third-country interference. These levels are a framework for evaluating sovereignty, not a guarantee that every service in an EU region meets the highest level.
Working material published on EUR-Lex in 2026 identifies customer data, metadata and telemetry as part of the boundary: they remain in the Union unless the customer explicitly requests otherwise. The criteria also examine outsourced technical and operational support, provider ownership and control, subcontractors, third-country governmental access and data generated through use of the service. A provider that keeps files in the Union but exports telemetry or relies on overseas privileged support would therefore fail a Union-only requirement unless the applicable criteria and contract allow it.

Physical location does not eliminate legal exposure. A provider incorporated or controlled in another country may be subject to that country’s disclosure laws, and a subcontractor may create a separate access path. Ask which entities can receive a binding request, how the provider validates it, whether it challenges overbroad demands, and whether it can notify you before disclosure. Contracts should require prompt notice where legally permitted, transparency reports or equivalent reporting, and a documented process for handling conflicts between foreign law and your sovereignty obligations.

For non-personal data, the Data Act’s safeguards are relevant when a third-country public body requests access to data held in the EU. They do not turn every workload into a sovereign service, and they do not remove GDPR requirements for personal data. Treat the request process, encryption design and customer-notification commitment as procurement requirements rather than assumptions.
Procurement checklist for a sovereignty-bound workload
- State the boundary. Specify the country, the EEA or the Union, and whether the rule covers only customer content or also metadata, telemetry, keys, identities, logs and support records.
- Classify the data. Mark personal, mixed and non-personal elements, including diagnostic exports and operator-visible fields.
- Require a complete flow map. Include production, replicas, snapshots, backups, disaster recovery, monitoring, support tools, subprocessors and onward transfers.
- Set access conditions. Require in-boundary operators where applicable, just-in-time approval, least privilege, strong authentication, session recording and customer-controlled emergency access.
- Choose transfer safeguards. For EEA exits, document the mechanism and Schrems II assessment before activation. Specify supplementary measures and key ownership.
- Test resilience. Perform a restore using the documented backup path and verify that recovery does not silently invoke an overseas service.
- Define change control. Require advance notice and approval for new regions, subprocessors, telemetry fields, support locations or ownership changes.
- Plan exit. Specify export format, deletion certification, retention of immutable backups and a timetable for removing copies after termination.
Contract language that closes common gaps
A data-processing agreement should identify every processing location and subprocessor, but a sovereignty schedule should be more precise. It should state that replicas, backups and disaster-recovery copies remain in the named boundary; list permitted support locations; prohibit unapproved remote administration; enumerate telemetry and metadata fields; and require notice before a new destination or subprocessor is introduced.
Include obligations for encryption and key custody, access logging, incident notification, government-request handling, audit cooperation, deletion and verified export. If the customer may explicitly request processing outside the Union, make that an affirmative, logged instruction with a description of the resulting transfer mechanism—not a default buried in standard service settings.
Evidence an auditor will expect
The proposed EU audit criteria call for proof that customer data is stored and processed exclusively in the Union and that unauthorised third parties cannot access, obtain, make unavailable, destroy or process it. Maintain an evidence pack containing:
- Current access logs and privileged-access records, including operator location and approval.
- Support-access policies, session records and subcontractor attestations.
- Backup-retention, replication and disaster-recovery policies.
- Data-flow diagrams showing where data is stored, processed, replicated and backed up.
- Telemetry schemas, destination inventories, redaction rules and retention settings.
- Monitoring records demonstrating Union-only processing where that is the requirement.
- Ownership and control information, subprocessor lists and government-request procedures.
- Transfer-impact assessments, SCCs or other mechanisms for EEA exits.
- Restore-test results and export tests proving that continuity does not depend on an unapproved foreign service.
Practical decision rule
Approve a cloud design only after you can answer four questions with current documents: where can every copy and signal go; who can access it; which law governs each transfer; and what evidence proves the controls work? If any answer depends on a marketing label, an unspecified “EU region” or an undocumented exception, treat the workload as not yet sovereign and resolve the gap before deployment.
