People and organisations in the United States, United Kingdom, European Union, Canada, Australia and elsewhere can use Chinese AI models, but “available” does not mean “processed locally” or “approved for every use.” You may reach a hosted chatbot, call an API in a supported region, or deploy open weights in infrastructure you control. The decisive questions are where prompts, logs and support data travel; which provider entity and contract apply; and whether privacy, AI, export-control or procurement rules restrict the use.
What “using a Chinese AI model outside China” actually means
The model’s country of origin and the location of your data are separate issues. A model developed by a Chinese company can be delivered through several architectures:
As an Amazon Associate I earn from qualifying purchases.
- Hosted consumer or business service: You send prompts to the provider’s website or application. The provider decides inference, storage, logging and support locations.
- Hosted API: Your software calls an endpoint. The account, model, endpoint and selected cloud region determine routing and available controls.
- Customer-cloud deployment: The model runs in a cloud account controlled by your organisation, subject to the provider’s licensing and technical requirements.
- On-premises deployment: Open weights run on servers you operate. Prompts can remain inside your network, although telemetry, updates, support and other integrations still need review.
That is why the answer differs by model, endpoint, account type and country. Open weights may be obtainable globally while a managed API exposes only a few regions. Conversely, a chatbot may be reachable from abroad while its privacy policy permits processing in China.
Which access routes are available outside China?
| Route | What you control | Main uncertainty | Best fit |
|---|---|---|---|
| Hosted chatbot | Account settings and the information you choose to submit | Provider-controlled inference, retention, training use, support access and jurisdiction | Low-risk experimentation and non-confidential tasks |
| Official API | Endpoint, credentials, application controls and sometimes region | Model and function availability can differ by region; logs and subprocessors may be outside your chosen region | Production software after contract and data-path review |
| Customer cloud | Network boundaries, identity, storage, monitoring and retention settings | Licensing, provider access for support, updates and cloud-service dependencies | Companies needing stronger residency and audit controls |
| On-premises open weights | Physical or virtual infrastructure, prompts, logs, access and model lifecycle | Hardware, patching, security, model licensing and compliance remain your responsibility | Regulated or confidential workloads with an experienced ML operations team |
Alibaba describes Qwen as supporting on-premises deployment, official APIs and deployment in an organisation’s own cloud. That gives a route to keeping prompts within infrastructure you control, but it is not a blanket promise that every Qwen release, tool or support channel has identical residency.

Alibaba Cloud’s current documentation for the DeepSeek Responses API illustrates the regional limitation: selected models and functions are available only in the China (Beijing) and Singapore regions. A user in Europe or North America may therefore be able to create an account yet still lack a particular model or function in a nearby region.
Can people in the US, UK, EU, Canada or Australia use them?
Technically, often yes. A foreign IP address is not by itself proof that a service is unavailable, lawful for every purpose or suitable for company data. Check all of the following before relying on access:
- Whether the provider accepts accounts from your country and can verify your organisation.
- Whether the exact model and API function are offered in the region you select.
- Whether payment, identity checks, telephone verification or local terms exclude your jurisdiction.
- Whether your employer, regulator, customer contract or government procurement rule forbids the service.
- Whether sanctions or export-control rules affect the model, hardware, software or end user.
Availability can change without a model-weight update. Providers add or remove regions, retire versions, alter abuse controls and move infrastructure. Record the endpoint and model version used in production, and recheck them immediately before launch and whenever the provider changes its terms.

DeepSeek’s privacy policy, last updated February 14, 2025, states: “When you access our Services, your Personal Data may be processed and stored in our servers in the People’s Republic of China.” The policy lists account information, user input, device and network information, log information, location information and cookies.
This is a provider-policy statement, not a guarantee that every future endpoint follows one identical route. It does mean that a user should assume China processing or storage is possible unless the specific contract and technical documentation establish otherwise. A browser session can also disclose more than the text of a prompt: account identifiers, IP address, device details, diagnostics and cookies may be collected.
Do not infer local processing from a local website domain, a low-latency connection or a cloud marketplace listing. Ask for the processing location of inference, prompts, attachments, safety logs, backups, support tickets and telemetry separately.
How can an organisation keep prompts out of China?
Use a deployment whose contract and architecture specify non-China processing, or run an open-weight model in infrastructure you control. For a customer-cloud or on-premises design, establish whether the provider can access the environment for support, whether crash reports leave the network, and where model updates are downloaded from.
A practical residency review should answer these questions in writing:
- Where does inference occur for the exact endpoint and model version?
- Where are prompts, outputs, safety events, billing records and backups stored?
- Which legal entity receives the data, and which subprocessors can access it?
- Are prompts used for training or product improvement, and how is opt-out enforced?
- How long are content and access logs retained, and can your organisation set shorter periods?
- Can support personnel in another country view content or diagnostic traces?
- What deletion, export, audit and incident-notification commitments are contractual?
If the provider cannot identify the endpoint’s data path, treat the location as unverified and keep personal, regulated and confidential information out of the service.
Does self-hosting remove compliance obligations?
No. Self-hosting can reduce provider-side transfer and storage, but it moves operational responsibility to the deploying organisation. You still need a lawful basis for collecting personal data, purpose limitation, access controls, retention schedules, vulnerability management, audit logs and a process for handling inaccurate or harmful output.
Self-hosted systems also create model-specific risks. Administrators must secure weight files and model-serving APIs, separate development from production data, restrict shell and storage access, scan uploaded documents, monitor prompt-injection attempts and decide whether outputs require human review. If an external support engineer, monitoring service or update repository can reach the environment, that connection is part of the data-transfer analysis.
Sector rules can add requirements for health, financial, education, employment, defence or public-sector uses. A private server does not override those rules, and it does not make copyrighted training or user-provided material automatically lawful.

Is DeepSeek legal under the GDPR?
There is no single yes-or-no answer for every user or deployment. The European Commission said on June 2, 2025: “Moreover, any transfer of personal data to China by DeepSeek needs to take place in compliance with the EU’s General Data Protection Regulation (GDPR).” A transfer can be lawful only when the organisation has a valid GDPR transfer basis and satisfies its other controller or processor duties.
Transfer safeguards
The Commission identifies modernised Standard Contractual Clauses (SCCs) as a contractual safeguard for transfers from the EU or European Economic Area to a third-country controller or processor. SCCs are not an automatic approval. Document what data moves, the purpose, the parties, onward transfers, retention, access rights and the provider’s ability to resist or notify government demands.
Third-country access assessment
The European Data Protection Board’s June 5, 2025 guidance on GDPR Article 48 addresses requests from non-European authorities for personal-data transfers. Your assessment should consider whether a foreign authority could demand access, what legal remedies exist, and which supplementary measures—such as encryption, pseudonymisation, strict key control and minimised prompts—actually reduce the risk.

Controller and processor responsibilities
Identify who decides the purpose and means of processing. Put processor instructions, confidentiality, deletion, breach notification, audit cooperation and subprocessor controls in the contract where applicable. The Act’s territorial reach is not limited to companies established in the EU. Providers and deployers in third countries can be covered when the output of their system is used in the European Union. A model’s Chinese origin therefore does not, by itself, place it outside the Act.
First classify the use:
- General-purpose AI: Determine whether the model is placed on the EU market and which provider obligations apply.
- Systemic-risk GPAI: The Commission says obligations include technical documentation, model evaluations, systemic-risk assessment and mitigation, and cybersecurity. The relevant GPAI rules applied from August 2, 2025.
- High-risk system: A downstream application may trigger requirements for risk management, data governance, technical documentation, logging, human oversight, accuracy, robustness and cybersecurity.
- Transparency-triggering use: Article 50 guidance can require users or providers to disclose that people are interacting with or viewing AI-generated content in specified circumstances.
Map the full chain: model provider, deployer, application owner and the location where output is used. A non-EU provider cannot avoid an applicable obligation simply by serving an EU customer from a server outside Europe.
Can governments or public bodies ban use?
Yes. Government-device rules can be stricter than consumer availability. On January 30, 2025, Italy’s data-protection authority, the Garante, announced an urgent limitation on processing Italian users’ data by Hangzhou DeepSeek and Beijing DeepSeek and opened an investigation after finding the companies’ communication unsatisfactory.
The European Commission later recorded restrictions affecting Australian government devices and Danish Parliament devices, while Taiwan advised government officials against using DeepSeek. These examples are not a universal ban on private citizens, and restrictions can change. Public bodies should check current authority notices, internal acceptable-use policies, procurement frameworks and device-management controls before installation or account creation.
What do DeepSeek’s terms mean for companies?
DeepSeek’s Open Platform Terms state: “You recognize that you are solely responsible for complying with all applicable Export Control and Sanctions Laws related to the access and use of the Services of you and your end user.” The terms also state that disputes are governed by the laws of the People’s Republic of China and may be brought where DeepSeek’s registered office is located.
Those clauses make a legal and procurement review essential. Check the contracting entity, governing law, venue, liability cap, indemnities, security commitments, audit rights, suspension rights and notice periods. Confirm that your customers, suppliers, employees and end users are not restricted parties and that the intended model, hardware and technical support comply with applicable export rules.
Hosted service or self-hosted model: which is safer?
| Decision axis | Hosted chatbot or API | Self-hosted or customer-cloud model |
|---|---|---|
| Data location | Must be verified from provider documentation and contract; China processing may be possible for hosted DeepSeek | Usually more controllable, but backups, telemetry, support and update channels still matter |
| Security operations | Provider runs core infrastructure; you configure accounts and application controls | You operate patching, identity, network isolation, secrets, monitoring and incident response |
| Compliance evidence | Request subprocessors, retention, training-use and audit documentation | Produce your own records while reviewing the model licence and any provider access |
| Features and updates | Fast access to managed tools, but regions and versions can change | Version control and change approval are yours; new features require engineering work |
| Exit options | Plan for export of prompts, logs, evaluations and application changes | Keep reproducible weights, configuration, evaluation sets and hardware capacity |
Choose self-hosting when residency, confidentiality or auditability justifies the cost and operational burden. Choose a hosted route only after the data path and contractual protections match the sensitivity of the workload.

A pre-launch checklist for an overseas deployment
- Name the exact service: Record model, endpoint, provider entity, account type, API version and intended processing region.
- Classify the inputs: Separate public, internal, personal, regulated, confidential and export-controlled material. Block the last four categories until approved.
- Read current terms: Check privacy policy, retention, training use, subprocessors, security documentation, suspension rights and governing law.
- Verify the route technically: Use provider region controls, network logs and test data to confirm where requests, attachments, outputs and telemetry go.
- Complete legal analysis: For EU data, document the GDPR transfer mechanism, transfer-impact assessment and supplementary measures. Check AI Act role, sector law, sanctions and procurement restrictions.
- Set guardrails: Minimise prompts, redact identifiers, disable unnecessary history, enforce single sign-on and least privilege, encrypt stored logs and define deletion dates.
- Test failure modes: Evaluate prompt injection, data leakage, unsafe output, model-version changes, regional outages and account suspension before production use.
- Monitor continuously: Recheck regions, model versions, terms, regulator orders and government-device rules immediately before launch and after material changes.
Bottom line for individuals and companies
Chinese AI models can be used outside China, but access is only the first test. Hosted DeepSeek may process personal data in China under its published policy; Qwen can offer on-premises or customer-cloud routes that give an organisation more control; and API features can be limited to particular regions such as Beijing and Singapore. Self-hosting changes the data path, not your legal duties. For EU users, China transfers still require GDPR compliance, while the EU AI Act can apply when output is used in the EU. Government-device restrictions and procurement rules may prohibit use even when a service is publicly reachable. Approve a specific model and deployment—not an entire country’s AI sector—after checking routing, contracts, law and operational controls.
