A credit denial or unfavorable change to existing terms may trigger an obligation to explain the principal reasons. A denial of mortgage assistance, such as a loan modification, follows separate servicing rules. The action and your rights depend on the loan, timing, and facts.
When does an AI decision trigger an explanation?
For a covered adverse credit action, the Equal Credit Opportunity Act (ECOA) and Regulation B require the creditor to give the applicant the specific principal reasons for its decision. The CFPB’s Circular 2022-03 says that requirement still applies when a creditor uses a complex algorithm: difficulty interpreting a model is not a reason to give an inaccurate checklist or withhold the actual reasons. CFPB Director Rohit Chopra summarized the agency’s position in a September 19, 2023 announcement: “There is no special exemption for artificial intelligence.”

A decision to deny credit or offer less favorable terms can be an adverse action. An unfavorable change to an existing account’s terms can also qualify, but not every payment adjustment, servicing decision, or change to a loan automatically does. The nature of the action, applicable law, loan type, and circumstances matter.

What a credit notice should tell you
When the adverse-action notice requirements apply, the notice should identify the specific principal reasons for the decision—not merely say that an algorithm, automated system, or internal policy made it. If the creditor relied on a credit report, you may also be entitled to information such as the reporting company’s contact details, the score used, and key factors that affected that score. Those additional disclosures depend on the circumstances; not every mortgage decision relies on a credit report, and notice requirements can differ.

Is a mortgage-assistance denial the same as a credit denial?
No. A borrower asking an existing mortgage servicer for help to avoid foreclosure is often seeking loss mitigation, not applying for a new loan. Regulation X has specific rules for covered loss-mitigation applications. When a servicer denies a complete application, it must give the specific reason or reasons for denying each available trial or permanent loan modification. Deciding not to offer an available modification counts as denying that option even if the servicer offers another option.
These rules require an explanation in covered cases; they do not require a servicer to offer a particular modification or guarantee that an appeal will result in assistance.

Details required for certain modification denials
- Investor or guarantor requirement: If that requirement is the basis for the decision, the notice must identify the loan owner or assignee and the requirement. “Investor requirement” alone is not enough.
- Net-present-value calculation: If the decision rests on this calculation, the notice must include the inputs used.
- Sequential review: If the system checks criteria in sequence and stops at the first failed one, the servicer may state the reason it reached and explain that other criteria were not evaluated.
An AI tool’s role does not change these explanation requirements. The applicable servicing rule and the facts of the application determine what the servicer must disclose.
When can you appeal a loan-modification denial?
Regulation X provides an appeal opportunity for certain loan-modification denials when the servicer receives a complete application at least 90 days before a foreclosure sale, or during another period specified by the rule. The timing condition matters, so the general deadline below should not be treated as applying to every denial or foreclosure situation.

- Check the denial notice and dates. Note when the servicer received your complete application, the date of the notice, and any scheduled foreclosure sale date.
- Contact the servicer promptly if you want to appeal. The borrower generally has 14 days after the relevant notice to appeal in cases covered by the rule. Confirm the deadline and submission method with the servicer and consult the current Regulation X text if the timing is unclear.
- Keep proof of submission. Save a copy of the appeal, attachments, delivery confirmation, and any response.
- Expect review by different personnel. A different person must review a covered appeal, and the servicer generally must provide its appeal determination within 30 days.
The CFPB’s consumer guidance also directs borrowers seeking to appeal a loan-modification denial to contact their servicer. The right to appeal is conditional; it is not a promise that a modification will be approved.
What if you suspect discrimination?
ECOA prohibits discrimination in credit transactions on the grounds it lists: race, color, religion, national origin, sex, marital status, age (if the applicant can legally contract), receipt of public-assistance income, and good-faith exercise of rights under the Consumer Credit Protection Act. The Fair Housing Act separately covers specified discrimination in mortgage and other housing-related credit. State and local laws may provide additional protections.

Potential warning signs can include being discouraged from applying, being refused despite appearing to qualify, receiving less favorable terms than a similarly situated person, or not receiving a clear denial reason. Any one of these signals warrants attention, but none by itself proves discrimination. Compare the notice with your application and preserve relevant records before drawing conclusions.
Recent rule changes matter. The CFPB’s Regulation B page reports a final rule issued April 22, 2026 concerning disparate impact, discouragement, and special-purpose credit programs, and says the regulation was most recently amended July 21, 2026. Because those are recent changes, check the current rule text, its effective date, and its status before relying on older summaries about the scope of protections. This article does not determine how those amendments apply to a particular borrower.

What records should you keep, and where can you turn?
Build a clear record
- Keep your application, submitted documents, decision notice, and any explanation the lender or servicer gave you.
- Record dates: when you applied, when the application became complete, when you received a decision, and any appeal or foreclosure deadlines.
- Save communications with the lender or servicer, along with payment records, statements, and notices about a servicing transfer.
- If a credit report was involved, retain the related disclosure and any information about the score or reporting company provided with the notice.
CFPB guidance says mortgage servicers must provide correct information and written billing information, subject to exceptions, and must pass along correct account information when servicing transfers. Keeping statements, payment records, and transfer notices can help you spot and document account problems.
Ask for the reason and consider a complaint
If a notice is vague, ask the creditor or servicer to identify the specific principal reason for the credit decision or the specific reason for each denied modification option, as applicable. Keep the request and response. If you believe discrimination occurred, you can file a complaint with the CFPB and may also contact relevant state or federal authorities. The CFPB’s consumer guidance describes complaint options; an agency complaint is not a substitute for meeting an appeal or foreclosure deadline.
This is general information about U.S. federal protections, not a determination of an individual borrower’s rights. Loan type, location, decision date, and procedural deadlines can affect the rules that apply. For a time-sensitive foreclosure or appeal issue, contact the servicer and seek help from a qualified housing counselor or attorney.
