Usually, yes—if both the musical composition and the exact recording you use are genuinely in the public domain in the relevant territory. Attribution is not ordinarily a copyright condition for public-domain material. But an old, public-domain composition can still have a protected modern recording, and YouTube may flag music during a live stream or claim an archived replay.
Check the composition and the recording separately
A musical composition—the music and any lyrics—and a sound recording—the particular performance and production—are separate works. The U.S. Copyright Office explains that “Copyright in a sound recording is not the same as, or a substitute for, copyright in the underlying musical composition.” U.S. Copyright Office: Musical Compositions and Sound Recordings

That distinction matters when streaming classical music or old songs. A composition may be public domain while a recent orchestra, soloist, label, or producer controls rights in the recording you found. Verify the rights status or license of the specific audio file, not just the age of the composer or tune.

There is no single worldwide cutoff date. For U.S. works, the Copyright Office says works published before January 1, 1931 are in the public domain because their copyright has expired. That is a U.S. reference point, not a universal rule or a complete test for every recording. U.S. Copyright Office: Copyright Duration

Recordings need particular care: the Copyright Office notes that pre-February 15, 1972 sound recordings may remain protected under state law until February 15, 2067. U.S. Copyright Office: Pre-1972 Sound Recordings Status can also depend on publication and creation dates, authorship, and the territory where the stream or replay is available. Without the track and intended territories, no general date rule can certify a particular file.
Attribution is different from permission
If the composition and exact recording are verified as public domain, attribution is not ordinarily required as a copyright-license condition. Adding a credit does not, however, clear a recording that is still protected.

A licensed track may have different conditions. For example, YouTube says works under a Creative Commons Attribution (CC BY) license require credit to the creator. Follow the specific license rather than assuming that credit alone grants permission. YouTube: Creative Commons
What can happen during and after the livestream
While you are live
YouTube says it scans all live streams for matches to third-party content, including copyrighted material in another live broadcast. If it identifies third-party content, it may replace the stream with a placeholder and warn you. Continuing to transmit the identified content can result in a temporary interruption or termination. YouTube: Copyright issues with live streams
After the stream ends
If you archive the stream, a Content ID claim may be made after the stream is complete. YouTube distinguishes this later archive claim from the live scan. A claim is a platform event, not by itself proof that your public-domain assessment is wrong; claims can affect visibility or earnings depending on the rights holder’s settings and geography, and a claim is not the same as a copyright takedown or strike. YouTube: Content ID claims
YouTube also says Content ID does not take written descriptions of “free” music into account. A note in your description therefore will not prevent a match. Keep records that identify the exact recording and establish its source and rights status.

Verify a recording before using it
- Identify the exact audio. Record the track title, performer, recording or release details, and the page or archive from which you obtained it. Do not treat a public-domain composition as proof that every recording of it is public domain.
- Check both rights layers. Establish the composition’s status and the recording’s status or license for the territories relevant to your stream and replay.
- Read the actual terms. For licensed music, confirm the license permits livestreaming and archived video, and check any territory, monetization, attribution, or other conditions. A “free” label is not enough.
- Keep evidence together. Save the source page, rights statement or license, and details identifying the recording. If a claim arises, these records help explain the basis for your use.
- Check any channel-allowlist requirement. If a rights holder has licensed third-party content for a stream, YouTube advises that the channel may need to be added to the owner’s Content ID allowlist to avoid interruption.
Choose between a verified public-domain recording and a licensed track
| What to check | Verified public-domain recording | Licensed track |
|---|---|---|
| Composition and recording | Verify both independently; an old composition does not clear a newer recording. | Confirm the license covers the composition and the particular recording. |
| Live stream and replay | Check status in relevant territories for both the live use and any archived replay. | Check that the license permits livestream use and archived video. |
| Monetization and territory | Confirm the status applies in the territories where the stream or replay is available. | Check the license’s monetization and geographic limits. |
| Attribution and other conditions | Attribution is not ordinarily a copyright condition for verified public-domain material. | Follow the license; CC BY, for example, requires creator credit under YouTube’s guidance. |
What to use when rights are uncertain
YouTube recommends its Audio Library for copyright-safe music and sound effects. If you source a track elsewhere, check that specific track’s terms for the intended live use and replay rather than relying on a credit line or a general claim that the music is free. YouTube Audio Library
