Yes, in some jurisdictions and circumstances—but depicting violence is not automatically illegal everywhere. Authorities usually ask what the game communicates, whether the targeted group is real and identifiable, whether the work encourages hatred or attacks, how violence is framed, who can access it, and where it is distributed.
The same title can be lawful in one country yet restricted, refused classification, confiscated, or prosecuted in another. A fictional battle scene is legally different from an explicit message that a real ethnic group should be expelled or destroyed, and both differ from material that directly incites genocide.

What makes a violent game legally risky?
There is no worldwide rule that treats every depiction of ethnic or racial violence as a crime. Legal exposure depends on the jurisdiction and on the complete presentation: dialogue, narration, objectives, imagery, player rewards, advertising, online descriptions, and distribution method.
Interactive form does not automatically make a game safer or more dangerous than a film or book. The relevant question is whether the game merely depicts fictional conflict or communicates an unlawful message. A player-controlled fight in a story can be treated differently from instructions, slogans, or objectives urging hostility toward a real protected group.

Several factors recur across the laws and guidance discussed below:
- Target: Is the group a real, identifiable national, racial, religious, or ethnic group, or a wholly fictional faction?
- Message: Does the game portray events, or does it advocate that people attack, expel, or destroy the group?
- Framing: Does it condemn the violence, present it neutrally, glorify it, trivialize it, or dehumanize its victims?
- Intent and likely effect: Is there evidence of an aim to stir hatred, direct public incitement, or a specific intent to destroy a protected group?
- Audience and reach: Is the material publicly released, advertised online, supplied to minors, or limited to a private setting?
- Historical content: Does it approve, deny, or grossly trivialize a real genocide, crime against humanity, or war crime under a law that regulates such conduct?
These questions are fact-specific. The title, version, release territory, platform, age rating, scenes, and promotional material would all matter in an actual case.
Germany: incitement and dehumanizing depictions are separate risks
German law illustrates why the bare presence of combat is not the complete legal test. Two provisions can become relevant for different reasons.
Section 130: public incitement against protected groups
Section 130 of the German Criminal Code covers conduct carried out in a manner suited to causing a disturbance of the public peace. It includes inciting hatred against “a national, racial, religious group or a group defined by their ethnic origin,” calling for violent or arbitrary measures against such groups or individuals because of membership, and attacks on human dignity through insulting, maliciously maligning, or defaming a protected group.
The provision also addresses public dissemination and making qualifying content available, including to people under 18. For a game, investigators would therefore look beyond the game disc or download itself: public advertising, online distribution, user access, and the wording of missions or promotional material could all be relevant.

Section 131: glorifying or trivializing cruel violence
Section 131 addresses content describing cruel or otherwise inhuman acts of violence against humans or humanoid beings when the presentation glorifies or downplays those acts, or presents their cruel or inhuman aspects in a way that violates human dignity. Public dissemination and supplying such content to minors are covered.
A game could therefore create risk from the combination of its depiction, its framing, and its distribution method rather than from the mere fact that characters fight. A scene showing atrocities as condemned events raises different questions from a reward system that celebrates the suffering of an ethnic population or treats victims as less than human.
Historical denial and gross trivialization
European legal summaries of the German approach also describe rules covering approval, denial, or gross trivialization of genocide, crimes against humanity, or war crimes when the conduct is suited to inciting hatred or violence. Whether a particular historical scene meets those conditions depends on its exact wording, context, and public presentation; the category is not a blanket ban on fictional violence.
United States: genocide requires specific intent, and incitement is a separate offense
Federal genocide law in the United States is narrower than a general ban on violent imagery. Section 1091 of Title 18 defines genocide around a specific intent to destroy, in whole or in substantial part, a national, ethnic, racial, or religious group as such.
The statute lists acts including killing members of the group, causing serious bodily injury, deliberately inflicting destructive living conditions, imposing measures intended to prevent births, and forcibly transferring children. It separately provides an offense for anyone who “directly and publicly incites another to violate” the genocide provision.

That wording matters for a game. Ordinary fictional violence, without the required intent to destroy a protected group and without the statute’s direct-and-public-incitement elements, is not by itself the federal genocide offense described here. A game that depicts a fictional massacre, or even a historical atrocity, would still require analysis of its actual message and the evidence of intent.

United Kingdom: material intended to stir racial hatred
Part III of the UK Public Order Act 1986 regulates publication, distribution, display, or inclusion of written or other material when the statutory intent and threshold for stirring racial hatred are met. The Act defines “racial hatred” as hatred against a group defined by “colour, race, nationality (including citizenship) or ethnic or national origins.”
Applying that framework to an interactive game requires looking at the whole communication: dialogue and subtitles, imagery, mission objectives, marketing copy, trailers, community distribution, and the intended audience. A game that depicts a conflict without urging hostility may present a different case from material designed to persuade players to hate a real group.
Distribution is part of the analysis. A publicly sold or downloadable product, an online campaign aimed at a broad audience, and a private copy are not necessarily treated identically. The statutory intent requirement also means that offensive or shocking content cannot simply be assumed to satisfy the racial-hatred offense.

International standards: advocacy becomes unlawful when it incites prohibited harm
International guidance commonly distinguishes protected, offensive, or hateful expression from advocacy of hatred that constitutes incitement to discrimination, hostility, or violence. Incitement to genocide is treated as a category that states must prohibit under the cited international framework.
This distinction does not create one global criminal code. Domestic governments implement the standards differently, and national courts apply their own definitions, procedures, and constitutional safeguards. International principles are useful for identifying the key threshold—advocacy and incitement to concrete harm—but they do not determine the result for every game in every country.
How to assess a particular game
Use the following sequence before drawing a legal conclusion. It is an issue-spotting framework, not a substitute for advice from a lawyer qualified in the relevant territory.
- Map the jurisdictions. Identify where the developer, publisher, servers, storefront, and players are located. Criminal, media, and youth-protection rules are territorial and can apply differently to production, hosting, sale, and access.
- Identify the group. Record whether the target is a real national, racial, religious, or ethnic group, a recognizable stand-in, or a fictional faction. Real-world identifiers, slogans, symbols, and historical references can make the target more identifiable.
- Describe the communication precisely. Quote the relevant dialogue and describe objectives, narration, cut-scenes, menus, achievements, rewards, and player choices. Distinguish a depiction of violence from an instruction or endorsement that people should attack, expel, or destroy a group.
- Evaluate the framing. Ask whether the work condemns, contextualizes, neutrally depicts, celebrates, minimizes, or dehumanizes the violence. Germany’s section 131 expressly makes glorification, downplaying, and dignity-violating presentation relevant.
- Test intent and incitement. Look for evidence that the creator or distributor intended to stir racial hatred, directly and publicly incite genocide, or act with the specific intent to destroy a protected group. Those are distinct legal elements, not assumptions drawn from the presence of bloodshed.
- Check distribution and age access. Note public release, online availability, advertising, user-generated reposts, and supply to minors. German provisions specifically address public dissemination and minors; the UK framework regulates publication and distribution when its intent and threshold are met.
- Check historical claims. If the game depicts a real genocide or international crime, determine whether it approves, denies, or grossly trivializes the event in a jurisdiction that regulates that conduct, and whether the statutory conditions concerning hatred or violence are met.
- Document the exact edition. Record platform, version, language, release date and territory, age classification, patches, downloadable content, and marketing. A changed scene or regional edit can alter the legal analysis.
Comparison of the main legal tests
| Jurisdiction or framework | Core trigger | Game-related questions | Distribution or audience issue |
|---|---|---|---|
| Germany, Criminal Code §130 | Public-peace-threatening incitement of hatred, calls for violent or arbitrary measures, or attacks on the human dignity of protected groups | Does the game advocate hatred or attacks against a national, racial, religious, or ethnic group? | Public dissemination and making qualifying material available, including to people under 18, are addressed |
| Germany, Criminal Code §131 | Depictions of cruel or inhuman violence that glorify, downplay, or violate human dignity | How are atrocities framed, rewarded, narrated, and presented to the player? | Public dissemination and supplying the content to minors are covered |
| United States, 18 U.S.C. §1091 | Specific intent to destroy, in whole or substantial part, a national, ethnic, racial, or religious group; separate offense for direct and public incitement | Is there evidence of the required genocidal intent or direct public incitement, rather than fictional violence alone? | The federal statute does not itself provide a complete First Amendment or state-law analysis |
| United Kingdom, Public Order Act 1986 Part III | Material published, distributed, displayed, or included with the intent and threshold for stirring racial hatred | Does the game’s complete communication target a group defined by colour, race, nationality, or ethnic or national origins? | Publication, distribution, display, and online reach can be relevant |
| International framework | Advocacy of hatred that constitutes incitement to discrimination, hostility, or violence; incitement to genocide | Does the work cross from offensive expression into advocacy and incitement of prohibited harm? | States implement these principles differently under domestic law |
Common mistakes when judging legality
“Any ethnic violence in a game is illegal.”
That is too broad. The legal systems described here require additional features such as incitement, intent, glorification, a dignity-violating presentation, a regulated form of distribution, or a specific historical offense.
“It is fictional, so it can never be illegal.”
Fictional framing does not automatically resolve a case. A fictionalized name can still be a recognizable stand-in for a real group, and a game can use real-world slogans, symbols, or promotional language. Authorities may examine the message and likely effect rather than rely only on the label “fiction.”
Best Value
“An age rating proves the game is lawful.”
A rating is evidence about classification, not a universal immunity from criminal or civil rules. Some provisions specifically make public supply to minors relevant, while others focus on incitement or intent regardless of the rating.
“A ban in one country proves the game is illegal everywhere.”
National rules differ. One country may refuse classification or restrict distribution while another permits sale. The outcome in one territory does not establish the result in another.
“A shocking scene proves genocidal intent.”
Under the US federal statute, intent to destroy a protected group in whole or substantial part is an express element. Shock, brutality, or poor taste alone does not establish that element.

What creators and distributors should preserve
Anyone assessing a release should keep the complete, territory-specific record: scripts, localization files, design documents, mission logic, reward descriptions, trailers, store pages, moderation rules, age-classification submissions, and records of who can access the game. Context can change when a patch alters a scene, a marketing team adds a slogan, or user-generated content is promoted through an official channel.
Before launch, obtain advice in each high-risk territory from counsel familiar with criminal speech, media, and youth-protection law. Ask counsel to review the exact build and marketing package, not a general description. If a complaint or investigation arises, preserve the relevant version and distribution records rather than relying on screenshots or memory.
Bottom line
A video game depicting violence against an ethnic group can be illegal, but depiction alone is not an automatic offense. Germany may examine public incitement, attacks on human dignity, and glorifying or trivializing cruel violence; US federal genocide law requires specific intent or direct public incitement; the UK regulates material intended to stir racial hatred; and international standards focus on advocacy that incites discrimination, hostility, violence, or genocide. The decisive facts are the jurisdiction, the group, the game’s message and framing, intent, audience, and distribution.
