An employer can configure a recruitment chatbot to score applicants, recommend rejection, or automatically close an application. Whether it may lawfully do so depends on the tool’s actual role, the data it uses, and the laws in the places where the employer operates and candidates apply. A bot that answers questions or schedules interviews is materially different from one that ranks people or makes a selection decision.
What “automatic rejection” means in practice
Recruiting software can affect an application at several different levels. A conversational assistant may explain benefits, collect contact details, or book an interview without evaluating a person’s qualifications. A more consequential system can parse a résumé, assign a score, classify an applicant as a fit or non-fit, rank a pool, recommend that a recruiter reject someone, or send a rejection message without a human reviewing the file.

The legal distinction is the system’s decision authority, not whether its interface looks like a chat window. New York City’s automated employment decision tool (AEDT) definition reaches a tool that uses a score, classification, or recommendation to substantially assist or replace discretionary employment decision-making. An employer cannot avoid responsibility by saying that a vendor supplied the model or that the final email was sent automatically.
| Chatbot function | Effect on an application | Why the distinction matters |
|---|---|---|
| FAQ and scheduling | Communicates information or arranges a human interview | Usually does not itself select or reject candidates |
| Data collection | Gathers answers, résumé text, or availability for later review | Risk depends on whether the answers are then scored or filtered |
| Scoring or classification | Produces a fit score, category, or ranking | Can substantially assist an employment decision and trigger AEDT or similar rules |
| Recommendation | Tells a recruiter to advance or reject an applicant | Human involvement may not remove obligations when the recommendation materially drives the outcome |
| Automatic disposition | Closes an application or sends a rejection without discretionary review | It is a direct selection decision subject to anti-discrimination and notice requirements |
Is an AI rejection legal?
There is no single worldwide answer. Automatic rejection is still an employment selection procedure, so ordinary anti-discrimination duties apply. Under federal civil-rights principles in the United States, a selection procedure can be unlawful if it intentionally discriminates or disproportionately excludes a protected group without being job-related and consistent with business necessity. The same analysis can apply when the exclusion comes from a statistical model, résumé parser, personality assessment, video analysis, or chatbot workflow.

An employer should evaluate the complete pipeline: the job requirements, training data, input fields, scoring rule, threshold, human review, and the effect on protected groups. A neutral-sounding rule can still create an unlawful disparate impact. For example, a requirement that penalizes employment gaps, certain speech patterns, a particular educational path, or an inaccessible assessment may exclude qualified people for reasons unrelated to essential job duties.
Other laws may add duties. State and city rules, privacy laws, sector regulations, collective-bargaining agreements, procurement terms, and rules in the candidate’s country can all change the answer. A compliant deployment in one location is not automatically compliant elsewhere.
New York City’s AEDT requirements
New York City has one of the clearest local frameworks for automated hiring tools. A system used to screen candidates or employees for an employment decision can be an AEDT when it substantially assists or replaces discretionary decision-making through a score, classification, or recommendation.
Recommended Free Tools
Independent bias audit
Before using a covered AEDT, the employer must obtain an independent bias audit completed no more than one year before the tool’s use. The employer must also make a public summary of the most recent audit available. The audit is intended to examine selection effects, including whether use of the tool creates materially different outcomes for demographic groups covered by law.
Advance notice to candidates
New York City candidates must receive notice at least 10 business days before the tool is used. The notice must identify the qualifications and characteristics the system assesses and explain how a candidate can request an alternative selection process or an accommodation. A vague statement that “technology may be used” does not convey the required practical information.

Data information and retention
City guidance also addresses information about the type of data used, the source of that data, and retention. Employers should make the required information available in the manner specified by the city’s guidance and maintain records showing what the tool evaluated and when.
Enforcement and penalties
Enforcement is not merely theoretical. A New York State Comptroller audit dated December 2, 2025, reported that applicants were often unaware when AI screening was used and found weaknesses in the city Department of Consumer and Worker Protection’s enforcement and complaint handling. The audit page reports civil penalties of $500 to $1,500 per day for violations, as stated by the Comptroller’s 2025 audit materials.
“Job seekers deserve a fair and transparent process when they apply for work, and that includes knowing if a company is using artificial intelligence to evaluate their resumes or video interviews, and whether the technology was vetted to eliminate biases.” — Thomas P. DiNapoli, New York State Comptroller, 2025
What notice should an NYC applicant expect?
A useful notice identifies the automated tool, says when it will be used, and describes the qualifications and characteristics assessed. It should also tell the applicant how to seek an alternative process or accommodation. Candidates should save the notice, the job posting, and the date of any automated message because those records can clarify what system was involved.
If no notice appears, the absence is not proof that a violation occurred: the employer may have provided it elsewhere or may not be covered by the city rule. However, an applicant can ask the recruiting contact whether an automated employment decision tool was used, what categories of information it considered, and how to request an alternative or accommodation.

Disability and accessibility safeguards
The Equal Employment Opportunity Commission and the Department of Justice warn that algorithmic tools can screen out qualified people with disabilities, including people who could perform the job with reasonable accommodation. A system may infer disability from voice, facial movement, typing patterns, response speed, résumé gaps, or an assessment format that is difficult to use with assistive technology.

- The assessment should measure job-related abilities rather than characteristics that merely correlate with disability.
- The tool should not force prohibited disability-related questions or medical examinations at an impermissible stage of hiring.
- Human reviewers should be able to consider an applicant through an accessible alternative process instead of treating a failed automated interaction as final.
A candidate who believes a disability affected an automated result can promptly request an accommodation, explain the barrier in functional terms, and ask that a qualified human review the application. The request should not require the applicant to disclose more medical information than necessary.
When the Fair Credit Reporting Act applies
Some hiring systems incorporate a consumer report supplied by a background-screening company. A consumer report can include employment, education, criminal-record, credit, or other information covered by the Fair Credit Reporting Act (FCRA), depending on how it is obtained and used. A résumé-ranking model that relies only on information submitted directly by the applicant is not automatically an FCRA report, but adding a third-party report can change the obligations.
Before an adverse action
When an employer is considering rejecting an applicant based in whole or in part on a consumer report, the joint EEOC and Federal Trade Commission guidance describes a pre-adverse-action process. The employer should provide the applicant with a copy of the report and a summary of rights, along with notice that adverse action is being considered, before making the final decision.
After the decision
If the employer proceeds, the post-adverse notice should identify the reporting company, state that the reporting company did not make the hiring decision, and explain the applicant’s rights to dispute inaccurate or incomplete information and obtain another free report in the circumstances allowed by the FCRA. A chatbot message by itself does not replace these notices.

What the EU AI Act means for recruitment tools
The European Commission’s AI Act Service Desk identifies AI systems intended for recruitment or selection as potentially high-risk. Examples include automated job-matching and ranking tools that analyze CVs, skills, education, past placements, or competency data to produce scores, rankings, or fit categories.
That does not mean every recruiting chatbot is automatically high-risk. A bot limited to scheduling or answering questions has a different function from a system that ranks applicants. The classification depends on the actual purpose, deployment, and output. Where a tool falls into a high-risk category, organizations face a more formal risk-management and governance analysis, including controls around data quality, documentation, human oversight, monitoring, and accountability.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone. How to tell whether a bot rejected you
- Read every message and portal notice. Look for terms such as automated decision, assessment, ranking, score, screening, or alternative process.
- Ask a precise question. Request confirmation of whether an automated tool evaluated your application and whether it produced a score, classification, ranking, or rejection recommendation.
- Identify the data involved. Ask whether the system used résumé text, application answers, interview video or voice, background information, or information obtained from another source.
- Request the available review route. In a covered jurisdiction, ask for an alternative selection process, human review, or disability accommodation. Keep the request focused on the barrier and the job process.
- Preserve evidence. Save the job advertisement, application confirmation, chatbot transcript, notice, rejection email, and dates. Do not alter screenshots.
- Check the relevant authority. Depending on location and the issue, a complaint may involve a city civil-rights agency, a state agency, the EEOC, or a data-reporting dispute process.
A short rejection alone cannot establish that AI made the decision. Many employers use automated workflow software for communications while a recruiter makes the substantive choice. The aim of these questions is to determine what the system actually did.
Controls employers should implement before deployment
A defensible program starts with a written description of the tool’s purpose and decision boundaries. The employer should specify whether the system communicates, recommends, ranks, or rejects, and which human decision-maker remains accountable.
- Job-related criteria: map every input and threshold to an essential job function or documented business need.
- Data governance: record the type, source, quality, retention period, and permitted use of each data field.
- Bias testing: conduct the legally required independent audit where applicable and monitor outcomes after deployment, not only during procurement.
- Notice: give location-specific notice before evaluation, including assessed characteristics and an alternative or accommodation route where required.
- Human oversight: prevent an unreviewed low score from being an automatic final rejection when law or policy requires discretion.
- Accessibility: test with assistive technology and provide a practical way to complete an equivalent assessment.
- Logging and appeals: retain the model version, inputs, output, reviewer action, notice, and reason for disposition so a complaint can be investigated.
- Vendor accountability: contractually require documentation, audit cooperation, incident reporting, data limits, and a way to correct errors.
Employers should also test what happens at the edges: an applicant with a nontraditional résumé, an employment gap, an accent, a screen reader, a request for extra time, or a corrected background record. A polished chatbot experience does not demonstrate that the underlying selection process is fair.

Common failure modes and practical fixes
“A human can override it, so it is only a helper”
If recruiters routinely follow the model’s recommendation or never see applicants below a threshold, the tool may substantially influence the decision despite nominal human involvement. Measure override rates and require documented review of borderline and adverse cases.
“The vendor tested for bias once”
Models, job populations, thresholds, and data sources change. Testing should be tied to the current version and repeated when material changes occur. In New York City, the independent audit must be no more than one year old when the covered tool is used.
“The notice is buried in the privacy policy”
Applicants need a clear, timely explanation of the evaluation, the characteristics assessed, and how to seek an alternative or accommodation. A general privacy statement may not communicate those operational rights.
What’s actually slowing this PC down?
Pick the symptom - the matching free tool is one click away.
“The chatbot asked for medical details to improve matching”
Disability-related inquiries and medical examinations are restricted in hiring. Collect only information that is lawful, necessary, and handled through an appropriate accommodation process.
“The background report was just another data source”
Using a third-party consumer report can activate FCRA pre-adverse and post-adverse procedures. Separate that workflow from ordinary résumé scoring and provide the required report and dispute information.
Bottom line for applicants and employers
A recruitment chatbot can reject candidates automatically, but automation does not create an exemption from employment law. The decisive questions are what the system outputs, how much it influences the selection, which data it uses, and where the hiring occurs. Applicants should look for clear notice, ask whether a score or recommendation was used, request an alternative or accommodation when appropriate, and preserve records. Employers should treat the bot as part of the regulated selection process: define job-related criteria, audit effects, provide accessible human review, document decisions, and follow location-specific notice and adverse-action rules.
