A company may face criminal prosecution, regulatory fines or civil claims if an AI bot causes harm or is used unlawfully. But the bot is not prosecuted: authorities and claimants must establish the responsibility of people or organizations under the applicable law. An unexpected action alone does not prove that a company had the knowledge or intent required for a crime, and EU AI Act fines do not apply automatically whenever a system behaves unpredictably.
Three different legal routes can apply
Criminal cases, administrative enforcement and civil claims are separate processes. They have different legal tests, potential outcomes and ways of identifying responsible parties.

| Route | What must generally be established | Possible outcome |
|---|---|---|
| Criminal prosecution | The elements of a specific offense, including any required knowledge or intent, and a legally sufficient basis to attribute conduct to an individual or company. | Criminal penalties under the applicable law. |
| Administrative enforcement | A covered organization or operator violated an applicable regulatory requirement. | A regulator may impose an administrative fine or other enforcement measure available under the law. |
| Civil compensation claim | The claimant meets the applicable civil-law test. Under the European Commission’s overview of the revised EU Product Liability Directive, that includes proving product defectiveness, damage and a causal link. | Compensation for a claimant if liability is established. |
These routes can be considered separately; a regulator’s fine is not compensation paid to an injured person, and a civil claim does not itself establish a crime.
In the EU, liability depends on the company’s role and the rule involved
The EU AI Act addresses covered providers, deployers and other operators. The European Commission says that “AI agent” is not a separate category under the Act: the definitions of an AI system and a general-purpose AI (GPAI) model can cover agents. A company cannot assume an agent is outside the Act just because it acts autonomously; the relevant questions include what system or model is involved, what the company does, and which obligations apply to that role.

Who may be in the enforcement picture?
Enforcement is shared among the European Commission’s AI Office, the European Data Protection Supervisor and national competent authorities. Which authority is involved depends on the system and operator. Potentially covered parties include providers, deployers and providers of GPAI models.
In practical terms, investigators may examine who built or supplied the system, who configured or released it, who operated it, and what each party controlled. A developer, provider and deployer are not interchangeable labels; responsibility turns on the applicable legal duties and the facts.
AI Act fines are ceilings for specified violations
The consolidated text of Regulation (EU) 2024/1689 sets maximum administrative fines for specified breaches. For non-compliance with prohibited AI practices, the ceiling is €35 million or 7% of total worldwide annual turnover for the preceding financial year, whichever is higher. For certain other specified operator breaches, it is €15 million or 3% of that turnover, whichever is higher.

Those are statutory maximums for the listed violations, not automatic charges for a harmful or surprising output. A fine requires an applicable provision, a covered party and a violation established through the relevant enforcement process.
Application dates differ by obligation
The European Commission’s AI Act Service Desk says some enforcement powers began on 2 August 2026. The stated application dates for specified high-risk-system rules include 2 December 2027 for Annex III systems and 2 August 2028 for high-risk systems embedded in regulated products. Exceptions and transition provisions may affect the result, so the system’s category, operator role and the exact provision matter when deciding whether a duty applied to particular conduct.
EU civil claims are separate from regulatory fines
The revised EU Product Liability Directive adapts product-liability rules to new technologies, including AI. In the Commission’s overview, a claimant must prove a defect, damage and a causal link to seek compensation. Whether a particular claim succeeds depends on the relevant law, its implementation, the product and the circumstances.

The European Commission described the AI Liability Directive as a proposal delivered on 28 September 2022. That proposal should not be treated as enacted legislation on the basis of the Commission page cited here.
In the United States, a rogue agent does not automatically prove a crime
One possible issue arises if an AI agent accesses a computer without authorization. A 24 September 2026 Associated Press report discussed the Computer Fraud and Abuse Act (CFAA) in that context and quoted experts who said prosecution would be uncertain. The statutory language includes knowing or intentional conduct; an agent’s action by itself may not establish that a company instructed or intended an intrusion.
The report also described prosecutorial discretion as a consideration if a company may have been reckless in testing. That is expert commentary about a developing issue, not a court holding that a developer is criminally liable whenever an agent accesses a system unlawfully. The example is specific to U.S. computer-access law and should not be generalized to other conduct or jurisdictions.

What investigators or claimants may need to establish
For a specific incident, the legal analysis can turn on questions such as:
- Which company or individual built, configured, supplied, released or operated the agent?
- What permissions did the system have, and what safeguards or limits were in place?
- What did the agent actually do, and which law or regulatory duty might that conduct engage?
- What did the responsible people or company know, intend or have reason to anticipate?
- Did the conduct cause legally recognized harm, and can the required connection be shown?
- Which jurisdiction has authority, and was the relevant requirement in force for this system and conduct?
These are not interchangeable tests. For example, evidence about inadequate safeguards may matter to a regulatory or civil claim, but criminal liability still depends on the elements of the particular offense and the rules for attributing conduct to a person or company.
