Usually, yes. An Indian business does not generally have to stop trading merely because it has appealed a GST demand. However, filing an appeal does not by itself freeze collection. For a first appeal under section 107 of the Central Goods and Services Tax (CGST) Act, the business must pay the amount it admits as payable and the statutory pre-deposit on the disputed tax. After that payment, recovery of the balance is deemed stayed under section 107(7). That stay concerns recovery of the demand; it is not a blanket guarantee that registration, bank accounts, inventory, licences or day-to-day operations cannot be affected by a separate order or enforcement measure.
What the law allows while an appeal is pending
The CGST Act does not say that a taxable person must close its shop, factory, office or online business because an adjudication order is under appeal. A business can ordinarily continue supplying goods or services, issuing invoices, paying employees and meeting its ongoing GST obligations while challenging the demand.

The critical distinction is between continuing business activity and stopping recovery of the disputed demand. The statutory stay is conditional. Section 107(7) provides: “Where the appellant has paid the amount under sub-section (6), the recovery proceedings for the balance amount shall be deemed to be stayed.” In practical terms, an appeal that has merely been drafted, uploaded or acknowledged should not be treated as an automatic stay.
This answer applies to the ordinary first-appeal framework under the CGST Act. A separate registration suspension or cancellation order, attachment, seizure, detention, prosecution-related order, insolvency process or court direction can create operational consequences that must be reviewed independently.

How the first-appeal stay works
Pay the admitted amount
Section 107(6) requires payment of the amount admitted by the appellant as payable under the order. The order may contain tax, interest, fine, fee and penalty components. Reconcile the figures in the order and payment ledger rather than assuming that paying only the principal tax satisfies every admitted liability.
Pay the pre-deposit on disputed tax
For an appeal to the Appellate Authority, the usual statutory pre-deposit is 10% of the remaining amount of tax in dispute. It is not automatically 10% of the entire demand including every interest, fine, fee or penalty component. Determine what part of the order is disputed and apply the statutory calculation to the disputed tax amount, with the current law and portal calculation checked before filing.
What happens after payment
Once the admitted amount and required pre-deposit have been paid, recovery proceedings for the balance are deemed stayed under section 107(7). Preserve the electronic liability ledger entry, challan, payment reference and appeal acknowledgement. If a recovery officer continues action, those records are the starting point for requesting correction and, where necessary, seeking professional or judicial relief.

When payment and recovery can begin
Section 78 ordinarily gives a taxable person three months from service of the order to pay the amount due before recovery proceedings are initiated. The statutory wording is: “Any amount payable by a taxable person in pursuance of an order passed under this Act shall be paid by such person within a period of three months from the date of service of such order failing which recovery proceedings shall be initiated.”

That is an ordinary period, not an unconditional entitlement in every case. The proper officer may specify a shorter period when it is expedient in the interest of revenue, but reasons must be recorded in writing. Read the order and any accompanying recovery communication to see whether a shortened period is asserted and whether the recorded-reasons requirement appears to have been met.
If an amount remains unpaid, section 79 provides statutory recovery modes. Depending on the case, these can involve measures directed at money owed to the taxpayer, goods, property or other recoverable assets. An appeal does not make those powers irrelevant; the section 107 payment condition is what gives the balance its deemed-stay protection in a first appeal.
Can the business keep trading in practice?
Ordinary operations
Nothing in sections 78, 79 and 107, read for the ordinary demand-and-appeal situation, commands a business to stop accepting orders or making taxable supplies simply because an appeal is pending. Continue filing returns, collecting and remitting current GST, maintaining books, issuing compliant invoices and responding to notices. The pending appeal relates to the challenged order; it does not excuse new-period compliance.

- detention or seizure of goods or a vehicle;
- a distinct demand for another tax period or registration;
- a court order, insolvency direction or sectoral licence condition; or
- a notice requiring an immediate response or appearance.
Each measure has its own legal basis, timing and challenge route. Paying the section 107 amount for one appeal should not be represented as automatically releasing attached assets or reviving a cancelled registration.
First steps after receiving a GST demand
- Record service and communication dates. Save the order, portal message, email, physical delivery proof and any notice showing when the decision was communicated. The appeal period and the ordinary recovery period run from statutory service or communication events, not from the date somebody first opens a downloaded file.
- Break down the demand. Create separate figures for disputed tax, admitted tax, interest, penalty, fine and fee. Mark which findings, periods, invoices or credits are being challenged.
- Check the payment deadline. Identify the section 78 three-month date and look for a shorter period supported by reasons recorded in writing. Escalate immediately if a recovery notice arrives before the date you calculated.
- Look for operational orders. Search the GST portal and correspondence for registration action, attachment, detention, seizure or another proceeding unrelated to the merits of the demand.
- Calculate the section 107 payment. Pay admitted dues and generally 10% of the remaining disputed tax. Verify the current statutory text, the order and the portal before transferring funds.
- File and preserve proof. Section 107 generally allows three months from communication of the decision or order to file the appeal. The CBIC appeal rules identify Form GST APL-01 and the acknowledgement and document process. Save the ARN, acknowledgement, uploaded grounds, annexures and payment references.
- Monitor the case after filing. Acknowledgement is not a substitute for payment. Track deficiency messages, hearing notices, additional-payment requests and any recovery communication, and respond within the stated time.
Deadlines and amounts at a glance
| Item | Ordinary rule | Qualification |
|---|---|---|
| Time to pay an order | Three months from service of the order | Section 78 permits a shorter period when the proper officer records that it is expedient in the interest of revenue. |
| First-appeal deadline | Generally three months from communication of the decision or order | Confirm the exact communication date, any permitted extension and current portal directions. |
| Admitted amount | Pay the amount admitted as payable under the order | Reconcile tax, interest, fine, fee and penalty components shown in the order. |
| First-appeal pre-deposit | Generally 10% of the remaining disputed tax | This is calculated against disputed tax, not automatically every component of the demand. |
| Effect of section 107(6) payment | Recovery of the balance is deemed stayed | The stay follows the required payment; filing alone does not create it. |
Choosing between compliance, appeal and a waiver route
| Route | When it fits | Payment and stay consequence | Checks before acting |
|---|---|---|---|
| Pay or comply with the original order | The liability is accepted, or commercial certainty is more important than contesting it | Payment addresses the amount due, but check whether interest, penalty or another balance remains | Exact amount, due date and whether a shortened section 78 period was lawfully set |
| First appeal under section 107 | The adjudication findings or calculation are challenged | Admitted dues plus the statutory pre-deposit; recovery of the balance is deemed stayed after payment | Limitation, APL-01 filing, disputed-tax calculation and separate enforcement actions |
| Section 128A waiver appeal | An eligible interest or penalty waiver application has been rejected | A rejection in Form GST SPL-07 may be appealed; previous tax payments can affect any shortfall in the required pre-deposit | Covered period, eligibility, required tax payment and whether the issue is waiver only |
| Further Tribunal appeal | The Appellate or Revisional Authority outcome is challenged | Historical statutory text describes an additional pre-deposit and deemed stay for the balance | Current amended section 112, commencement notifications and the Tribunal’s live filing procedure |
The table’s Tribunal entry needs particular caution. Older consolidated statutory material describes a further pre-deposit, but the current amended provision, commencement status and operating Tribunal process must be verified in a live case before anyone quotes a percentage or deadline.
Special case: an appeal against a rejected section 128A waiver
CBIC Circular No. 238/32/2024-GST addresses appeals from an order in Form GST SPL-07 rejecting an application for the section 128A waiver of interest or penalty. This is a targeted route for deciding whether the waiver applies; it is not a second opportunity to re-argue the original demand’s tax merits.

Common mistakes that put operations at risk
Assuming an appeal automatically stops collection
A filing receipt does not, by itself, satisfy section 107(6). Calculate and pay the required amount, then keep proof that the payment was credited.
Using 10% of the wrong base
The statutory figure is generally 10% of disputed tax. Applying it to the total demand without separating tax from interest, penalty, fine and fee can produce an incorrect payment and a disputed stay position.
Ignoring the service date
Waiting for a reminder can consume the three-month appeal window or the section 78 payment period. Build a dated chronology as soon as the order is received.
Treating the three-month period as absolute
A proper officer can set a shorter payment period for recorded revenue reasons. Check the wording and seek urgent advice if recovery is threatened early.
Best Value
Stopping current GST compliance
The appeal does not suspend obligations for later tax periods. Continue returns, payments, records and invoice controls while the historical demand is contested.
Overlooking a separate restriction
A registration order, attachment, detention or seizure may affect operations even when recovery of the appealed balance is stayed. Address that measure under its own procedure.
What to give a GST professional
An Indian GST practitioner or tax lawyer should receive the complete order and annexures, proof of service, electronic liability ledger, payment challans, return history, reconciliation of disputed tax, all portal acknowledgements, and every notice concerning recovery or registration. Ask the adviser to check the CGST provision alongside the applicable state GST counterpart, current amendments, limitation, the authority that passed the order and any court or departmental directions.
Do these 3 things before closing this tab:
1Scan for outdated or missing drivers - takes under a minute2Repair Windows errors before they cause bigger problems3Fix the driver behind crashes, sound loss and screen glitchesThe statutory framework explains when a first-appeal recovery stay arises, but it cannot determine whether a particular business may operate without restriction. That conclusion depends on the actual order, the taxpayer’s registration status, the assets targeted and the procedural posture.
Bottom line for a business owner
A pending GST appeal does not ordinarily require the business to shut down. Keep trading and meeting current GST obligations unless a separate lawful measure says otherwise. To protect against recovery of the disputed balance, do not rely on the appeal filing alone: pay the admitted amount and the required first-appeal pre-deposit, file within the applicable period, preserve evidence and check immediately for any registration, attachment, seizure or court action. The deemed stay under section 107(7) is conditional and limited to recovery of the balance, not an immunity from every consequence connected with the demand.
