Blocked ITC usually means input tax credit barred by a specific provision—most notably a category in section 17(5) of India’s CGST Act. Ineligible ITC is broader practical language for credit that cannot be claimed, whether because the general conditions in section 16 are not met, a restriction or apportionment rule in section 17(1)–(3) applies, or section 17(5) specifically blocks it. The terms are not always interchangeable: the legal reason determines whether credit is wholly unavailable, restricted to an eligible portion, potentially saved by an exception, or subject to a particular return treatment.
For a questioned purchase, test the claim in order: check section 16, determine whether business and exempt-supply use require apportionment, identify any applicable section 17(5) clause and exception, then apply the reporting rules for the relevant tax period. This is a CGST-focused overview, not a decision on an individual claim; the applicable state law, amendments, notifications, facts, and records also matter.

What “blocked ITC” and “ineligible ITC” mean
Input tax credit (ITC) is not available merely because GST appears on a purchase invoice. The Act sets baseline entitlement conditions and also limits credit in particular circumstances. “Blocked ITC” is commonly used for credit that a specific statutory prohibition makes unavailable, especially under section 17(5). “Ineligible ITC” is a wider explanatory label: it can describe any credit that cannot be claimed in full or at all under the applicable rules.
Neither phrase, by itself, identifies the legal result. A cost might fail a section 16 condition; relate partly to non-business activity or exempt supplies and therefore require restriction; or fall within a section 17(5) category. Those are different routes to an unavailable amount. The amount, possibility of an exception, and reporting treatment depend on which route applies and the facts of the purchase.

| Question | Section 16 condition | Section 17(1)–(3) restriction | Section 17(5) block |
|---|---|---|---|
| What is the legal issue? | A baseline condition for entitlement is not met. | Use or supply mix limits credit to the eligible portion. | A specified statutory category bars credit, subject to any applicable exception. |
| Is the whole amount necessarily unavailable? | Not necessarily; the result depends on the unmet condition and whether it can be satisfied for the relevant period. | Not necessarily; credit may be restricted proportionately where the rules require apportionment. | The relevant credit is generally barred if the clause applies and no exception fits. |
| What must be checked? | Each applicable section 16 condition and the tax period. | Business use, exempt-supply attribution, and the applicable apportionment rules. | The exact clause, its wording, and any exception. |
| How is the label used? | Often called ineligible in general discussion. | May be described as ineligible in part. | Commonly called blocked credit; it is also ineligible in the broader sense. |
The table is a classification aid, not a substitute for reading the current statutory text. In particular, “blocked” should not be used as a shortcut for every credit that fails for any reason.
Start with the section 16 eligibility test
Section 16(1) provides the general entitlement for a registered person, subject to the Act’s conditions, restrictions, and prescribed manner. It connects the goods or services to use, or intended use, in the course or furtherance of business. Section 16 is the starting point—not a complete answer—because satisfying its general test does not displace restrictions elsewhere in the Act.
For the item being reviewed, identify the claimant, the purchase, the tax period, the business purpose, and the records supporting the claim. Then work through the conditions that apply under the current section 16 and related rules. Do not infer eligibility from the presence of a tax invoice alone, and do not infer a section 17(5) block merely because someone has called an item “ineligible.”
Do these 3 things before closing this tab:
1Clear out junk files and repair common Windows errors2Scan for outdated or missing drivers - takes under a minute3Repair Windows errors before they cause bigger problemsSeparate a failed condition from a statutory block
If a baseline condition is not met, the issue is a section 16 eligibility problem even if the amount is casually described as blocked. If the baseline is met, continue to section 17: an otherwise eligible purchase may still require apportionment or be prohibited under a specific clause. Keep the reason attached to the amount in internal workpapers so the decision can be reviewed later.

Check the period, not just the invoice date
Eligibility is period-sensitive. The law applying to the relevant tax period, the timing of the claim, and any amendment or notification that affects that period can change the analysis. The Finance (No. 2) Act, 2024 added section 16(5) and (6), providing retrospective relief in specified section 16(4) time-limit situations. That relief is conditional; it is not a general extension for all late claims. Check the text and applicability requirements against the taxpayer’s precise period and circumstances before relying on it.
Distinguish apportionment from a blocked-credit category
Section 17(1)–(3) addresses restrictions associated with non-business use and exempt supplies. Under section 17(1), where goods or services are used partly for purposes other than business, credit is restricted to the business-use portion. Section 17(2) restricts credit attributable to taxable and zero-rated supplies where inputs relate partly to exempt supplies. Section 17(3) forms part of this apportionment framework. The practical point is that some ITC may be unavailable without the purchase being a section 17(5) blocked-credit item.
Apportionment and a categorical block answer different questions. Apportionment asks how much of an otherwise relevant credit is attributable to eligible use or supplies. Section 17(5) asks whether a listed category makes credit unavailable notwithstanding the general entitlement, unless a written exception applies. Do not treat a proportional restriction as a blanket ban, or assume that business use alone defeats a section 17(5) restriction.

Suppose a GST-registered business buys a service used partly for business and partly for a private purpose. The first issue is how section 17(1) limits credit to business use and how the applicable rules determine that amount. The fact that the supplier charged GST does not make the private-use portion eligible. This is an apportionment question, not automatically a section 17(5) block.

Example: inputs connected with exempt supplies
If an input relates to both taxable or zero-rated supplies and exempt supplies, section 17(2) may restrict the credit attributable to exempt supplies. The classification requires the relevant supply and use facts; it is not enough to label an entire business either taxable or exempt. Apply the prescribed method for the relevant period rather than inventing a percentage or using an unsupported estimate.
When section 17(5) may block credit
Section 17(5) begins by overriding the general entitlement and lists particular categories where ITC is unavailable, subject to exceptions written into the provision. Commonly discussed categories include specified passenger motor vehicles, vessels and aircraft; certain related services in stated circumstances; some food, beverage, and employee-related services; works-contract services and construction of immovable property in specified circumstances; and goods or services for personal consumption.
These descriptions are signposts, not complete legal tests. The statutory wording distinguishes among categories and includes exceptions. A summary such as “all vehicle ITC is blocked” or “all construction ITC is blocked” is too broad. For a real claim, identify the precise clause, read its conditions and exception, and establish that the facts satisfy—or do not satisfy—those terms.
Specified vehicles and related services
A vehicle-related purchase is not classified by the word “vehicle” alone. Section 17(5) concerns specified motor vehicles and also addresses certain vessels, aircraft, and related services in stated circumstances. The type and use of the vehicle, the service purchased, and any clause-specific exception are material. Do not carry a conclusion from one vehicle or business use over to another without checking the applicable wording.

Food, beverages, and employee-related items
Some food and beverage and employee-related services appear among the section 17(5) categories, but the block is not a license to treat every expense connected with staff identically. Identify what was supplied, who received it, the statutory clause that may apply, and whether an exception in that clause is relevant. Preserve the documents that show the actual transaction and business context.
Works contracts and construction
Section 17(5) addresses works-contract services and construction of immovable property in specified circumstances. The outcome depends on the statutory category and its terms, rather than the broad fact that a project involved construction. Verify what the contract covered, what property or work was involved, and whether a stated exception applies. Avoid a blanket conclusion for all construction-related spending.
Personal consumption
Goods or services for personal consumption are another commonly identified category. That does not make every purchase with an employee or individual connection personal consumption: the purpose and actual use must be established. Conversely, describing a private expense as a business cost does not resolve the statutory restriction. Link the claim to contemporaneous evidence of who used the item and for what purpose.

Use this sequence before treating a purchase as eligible, partly eligible, or unavailable. It keeps the legal basis, amount, and reporting decision connected rather than collapsing them into a single label.
Best Value
- Identify the claim precisely. Record the supplier, invoice or other supporting document, goods or services, tax amount, claimant, and tax period. Separate transactions if one invoice includes items with different uses or legal treatment.
- Test section 16. Check the current baseline entitlement conditions and the prescribed manner for the period. Record which conditions are met and identify any unmet condition. Do not move directly to section 17(5) simply because a claim is disputed.
- Trace the use and supply relationship. Determine whether the purchase is used partly for a non-business purpose or relates partly to exempt supplies. If so, examine the section 17(1)–(3) restriction and applicable apportionment rules to establish the eligible share.
- Screen for section 17(5). Compare the purchase and its circumstances with the exact statutory categories. A category heading or informal description is not enough; the clause’s conditions control.
- Test any exception. If a section 17(5) clause appears to apply, read its exception and check whether the documented facts fit. Do not assume that business use is itself an exception.
- Determine the amount and treatment. State whether the result is no credit, a restricted portion, or credit potentially available under a relevant exception. Calculate only by the applicable provision and prescribed method; keep the basis for the calculation with the supporting records.
- Apply period-specific return guidance. Determine how the resulting reversal or unavailable amount is reported for the relevant tax period, using the current GSTR-3B form and instructions as well as applicable official guidance.
- Retain the reasoning. Keep the invoice and transaction records alongside the use analysis, statutory provision, exception analysis, apportionment calculation, and reporting decision. This makes the classification auditable if the facts or law are later revisited.
How the classification affects GSTR-3B reporting
Legal classification and return reporting are related but separate tasks. CBIC Circular 170/02/2022-GST states that reversal of ITC ineligible under section 17(5) or other provisions is made in GSTR-3B Table 4(B), rather than Table 4(D). It separately says credit unavailable because of the section 16(4) time limitation may be shown in Table 4(D)(2). The circular is dated guidance; confirm the current return form and instructions for the tax period before filing.
Do not use the word “ineligible” by itself to select a table. First establish why the credit is unavailable. In particular, the circular distinguishes a reversal of credit ineligible under section 17(5) or other provisions from credit unavailable on account of the section 16(4) time limit. An amount’s table placement should follow the applicable reporting instructions, not a generic label in an accounting ledger.
For a claim affected by section 17(1)–(3), calculate and report the restricted amount in accordance with the applicable provisions and current instructions. The cited circular’s broad reference to reversals under other provisions should not be stretched into a substitute for checking the instructions applicable to a particular period or a different reporting situation.

Amendments and tax-period checks
The GST framework and its administrative guidance have changed over time. The Finance (No. 2) Act, 2024 added section 16(5) and (6) with retrospective effect for specified time-limit situations. A taxpayer should verify the conditions for the relevant subsection, the affected period, and any implementation or notification requirements rather than assume every time-barred credit is revived.
A consolidated Telangana bare-law document labelled November 2025 provides a later cross-check of the section 17 framework, but a compilation should not be treated on its own as proof of the law applicable to every taxpayer and period. Confirm the current central statute, applicable state law, commencement and applicability of amendments, and valid notifications. For filing decisions, use the law and return instructions that govern the particular tax period.
Quick Recap
Common classification mistakes to avoid
- Using “blocked” as a synonym for every denial. A failed section 16 condition or an apportionment under section 17 is not necessarily a section 17(5) block.
- Assuming section 16 is the whole test. Meeting the baseline conditions does not override section 17 restrictions or a specific section 17(5) prohibition.
- Making a categorical claim from a broad category name. “Vehicles,” “construction,” or “employee expenses” is not a complete statutory analysis; identify the relevant clause and exception.
- Ignoring partial use. A purchase used partly for non-business purposes or partly in relation to exempt supplies may require restriction rather than an all-or-nothing answer.
- Applying a rule without fixing the period. Amendments and retrospective relief are limited by their own terms, while forms and reporting guidance can change.
- Choosing a return table from a ledger label. The legal reason and the instructions for the relevant period should drive reporting treatment.
- Relying on unsupported facts. Where business purpose, use, or exception eligibility matters, preserve evidence that supports the conclusion instead of relying on a description alone.
