Autonomous weapons vs. remotely piloted weapons: how control and accountability differ

The central difference is who makes the final targeting decision. In a remotely piloted weapon, a human operator identifies the target and decides when to fire. An autonomous weapon can select and engage targets after activation without a new human decision for each target. Both must comply with international humanitarian law (IHL), but autonomy can reduce real-time human judgment and make it more difficult to reconstruct who was responsible when an attack goes wrong.

What the two terms mean

Remotely piloted weapons

A remotely piloted weapon is operated by a person who is not physically at the weapon’s location. The operator receives sensor or video information, assesses the situation, identifies a target and initiates the attack. A remotely piloted aircraft may fly with extensive automation, but that does not by itself make its weapon autonomous. The key question is whether a human makes the decision to apply force.

As an Amazon Associate I earn from qualifying purchases.

The International Committee of the Red Cross (ICRC) gives a direct example: “An armed drone piloted remotely by a human operator, who identifies the target and decides when to fire, is not an autonomous weapon.” The physical distance between operator and weapon is therefore not the legal or technical dividing line.

Autonomous weapon systems

The ICRC describes an autonomous weapon system (AWS) as a weapon that, once activated, can select and apply force to targets without further human intervention. A person may choose the mission, define a target profile, set a geographic area, impose a time limit and approve activation. The system can then perform critical functions—acquiring, tracking, selecting and attacking targets—on its own within those parameters.

There is no internationally agreed definition of AWS. The ICRC’s 2025 position paper focuses on autonomy in those critical functions. Automation used only for navigation, stabilization or locking onto a target that a person has already selected does not, by itself, make a system an AWS under that approach. National policies and diplomatic negotiations may use broader or narrower language.

The control distinction in one view

Question Remotely piloted weapon Autonomous weapon system
Who selects the target? Normally a human operator, using live or near-live information. Software selects targets according to its model, rules and operating limits after activation.
When is the attack decision made? During each engagement, immediately before force is applied. Before activation, through mission design and settings; the system may decide on individual engagements later.
What can a person change in real time? The operator can usually redirect, abort or withhold the attack while observing the engagement. Control depends on the system’s communication links, supervisory interface, time windows and ability to interrupt safely.
What creates uncertainty? Human error, poor intelligence, communications failure, fatigue or unlawful orders. Those problems plus sensor limits, software behavior, data drift, interaction with the environment and outcomes that are difficult to predict.
What must investigators reconstruct? What the operator saw, decided and communicated, and what commanders authorized. All of that, plus software versions, training data or models, configuration, sensor inputs, system state and the conditions that produced the machine’s selection.

These are functional distinctions, not a claim that every weapon fits neatly into one category. Systems can be semi-autonomous, with humans approving some engagements and software conducting others. The relevant analysis is always tied to the weapon’s actual capabilities and the circumstances of use.

How control works in each type of system

The human engagement loop in a remotely piloted system

  1. Observe: the operator receives imagery, signals or other sensor information.
  2. Identify: the operator assesses whether a person, vehicle or installation is a lawful military objective and distinguishes it from protected civilians or objects.
  3. Decide: the operator weighs the expected military advantage, foreseeable civilian harm and available precautions.
  4. Act: the operator initiates the weapon’s release or activation.
  5. Monitor and adjust: the operator can often abort, redirect or stop an engagement if new information changes the assessment.

This loop does not guarantee lawful conduct. An operator can misidentify a person, rely on faulty intelligence, misunderstand an order or fail to take feasible precautions. It does, however, place a human judgment at the point where force is applied and usually creates a relatively direct record of that judgment.

The bounded process in an autonomous system

  1. Define the mission: commanders or planners specify the objective, operating area, duration, target characteristics and prohibited areas.
  2. Configure the system: personnel select software, sensors, target libraries, thresholds, communications settings and rules of engagement.
  3. Authorize and activate: an authorized person starts the mission after reviewing the expected environment and risks.
  4. Sense and classify: the system collects data and compares detected objects or behaviors with its programmed criteria.
  5. Select and engage: within its limits, the system chooses targets and applies force without a fresh human decision for every engagement.
  6. Supervise and review: people may monitor status, intervene or terminate the mission when the design and communications link permit it; they must preserve records for later investigation.

A person can therefore remain deeply involved while not deciding each individual attack. The practical question is not whether a human touched the system at some point, but whether humans can understand, limit, supervise, interrupt and review what it does in the actual circumstances.

Why “human control” is more than a switch

Policy debates often use the phrase “meaningful human control,” but there is no single internationally agreed technical test. A useful operational analysis examines five capabilities.

Understanding

Users need enough knowledge of the system’s sensors, target-selection logic, known failure modes and performance limits to make an informed decision to deploy it. A generic assurance that the software is reliable is not a substitute for understanding how it behaves in the particular terrain, weather, electromagnetic environment and civilian setting of the mission.

Limiting

People should be able to constrain where, when and against what a system can act. Geographic boundaries, time windows, target characteristics, ammunition limits, exclusion zones and rules of engagement are examples. Limits must be technically enforced rather than left as informal instructions that the software cannot apply.

Supervising

Monitoring is meaningful only if the information arrives quickly enough and is clear enough to support action. A delayed, incomplete or ambiguous display may leave an operator nominally “in the loop” but unable to make a useful intervention. Supervisors also need an assignment of authority: someone must be responsible for watching the mission and deciding whether to continue it.

Interrupting

A stop or abort function must work under the conditions in which the weapon is expected to operate. Designers and commanders should test interruption after loss of communications, sensor degradation, unexpected civilian presence and software faults. If an engagement cannot be halted once a condition changes, the prior authorization must have been correspondingly narrower and more conservative.

Reviewing

After an operation, investigators must be able to determine what the system perceived, what it calculated, what people authorized and which safeguards were active. Review requires preserved logs and a chain of custody for data, not merely a final video clip or a statement that the mission was within its programmed parameters.

How accountability is allocated

Autonomy does not give a machine legal responsibility. Accountability remains with people and institutions under applicable law. The difficult issue is identifying which decisions and omissions contributed to the result.

Stage Potentially responsible actors Questions an investigation should answer
Research and design Developers, contractors, program managers and approving authorities Were foreseeable failure modes identified? Were civilian environments and edge cases tested? Were safety constraints built into the design?
Testing and acceptance Test teams, evaluators and officials who declared the system suitable Did testing reflect the intended operating environment? Were results, limitations and unresolved anomalies recorded?
Mission planning Commanders, intelligence staff and legal advisers Was the target set, area and time window lawful and appropriate? Were feasible precautions selected?
Configuration Operators, mission planners and technical personnel Which software version, model, thresholds, maps and exclusion zones were loaded? Did the settings match the approved mission?
Authorization and activation The person who authorized use and the person who activated or supervised it What information was available at the time? Were warnings, uncertainty or changing conditions considered?
Post-incident response Commanders, investigators and the institution responsible for the system Were logs preserved, civilians assisted, facts investigated and unlawful conduct reported or disciplined?

For a remotely piloted weapon, a firing record may connect the decision more directly to a named operator and commander. That does not eliminate questions about mistaken identity, unlawful orders, poor training or inadequate intelligence. For an autonomous system, responsibility can be distributed across the entire lifecycle, and evidence may be harder to interpret because the outcome depends on data, software, settings and environmental conditions as well as human choices.

Applying international humanitarian law

Both remotely piloted and autonomous weapons must be used consistently with IHL. The central rules include:

  • Distinction: parties must distinguish civilians and civilian objects from combatants and military objectives, and direct attacks only at lawful military objectives.
  • Proportionality: an attack is prohibited if expected incidental civilian harm would be excessive in relation to the anticipated concrete and direct military advantage.
  • Precautions in attack: attackers must take feasible precautions to verify targets, choose means and methods that reduce civilian harm, and cancel or suspend an attack when it becomes apparent that the legal conditions are not met.

These rules are applied to the circumstances known or reasonably knowable at the relevant time. A system that performs well in a controlled test may still be unsuitable where civilians, friendly forces or protected objects are mixed with military activity and the software cannot reliably distinguish them. Conversely, autonomy is not automatically unlawful merely because software performs a targeting function. Legality depends on the weapon’s capabilities, the limits imposed, the context of use and the decisions of the responsible humans.

The ICRC identifies loss of human control and judgment, difficulty predicting effects, and complications for responsibility and accountability as central concerns about AWS. Those concerns are legal and operational, not just ethical objections: if users cannot anticipate how a system will act, they may be unable to plan precautions or determine whether an attack remains lawful when conditions change.

Who is responsible when the wrong person is killed?

There is no automatic rule that assigns blame to the software, nor does the presence of a human somewhere in the chain automatically absolve everyone else. Responsibility depends on the facts and the applicable law, including the law governing command responsibility, individual criminal liability, state responsibility and weapons reviews.

An investigation should separate at least four questions:

  1. Was the attack authorized? Identify the commander, legal review, mission order and rules of engagement.
  2. What was reasonably knowable before activation? Examine intelligence, environmental forecasts, known system limitations and prior test results.
  3. What happened during the engagement? Reconstruct sensor inputs, classifications, communications, human alerts, overrides and the exact timing of force application.
  4. Did anyone fail a duty? Consider negligent design, inadequate testing, reckless authorization, improper configuration, failure to supervise or failure to stop an attack after warning signs.

If an operator knowingly attacks a civilian, ordinary rules on unlawful attacks apply. If a commander deploys a system in an environment where its limitations make lawful discrimination unrealistic, the commander’s authorization may be examined. If a defect was concealed or a foreseeable failure was ignored during development, responsibility may extend to the institution and personnel involved in that decision. The machine’s autonomy can make causation harder to prove, but it does not create a legal gap in which no person can be accountable.

Auditability: the evidence needed after an incident

Accountability is only practical when records allow an independent reconstruction. A robust record should preserve, with synchronized time references:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  • the mission order, authorization and rules of engagement;
  • operator, supervisor and commander identities and duty assignments;
  • software, model, firmware and configuration versions;
  • target libraries, thresholds, geofences, exclusion lists and time limits;
  • raw and processed sensor data, including data the system rejected;
  • communications quality, latency, outages and attempted overrides;
  • system alerts, confidence values, state transitions and weapons-release commands;
  • maintenance, calibration and cybersecurity events; and
  • post-strike assessments, civilian-harm reports and preservation actions.

Logs should be protected against alteration while retaining enough context to be intelligible to investigators who were not part of the original mission. A final “target engaged” entry without the underlying inputs and settings cannot establish whether the system behaved as designed or whether the design itself was inappropriate.

A policy example: the United States

The United States Department of Defense’s update to Directive 3000.09 states: “Persons who authorize the use of, direct the use of, or operate autonomous and semi-autonomous weapon systems will do so with appropriate care and in accordance with the law of war, applicable treaties, weapon system safety rules, and applicable rules of engagement.”

This language illustrates a human-chain model: authorizers, commanders and operators retain duties even when a weapon has autonomous functions. It is a U.S. policy requirement, not a globally agreed treaty rule. Other states may adopt different terminology or controls, and national directives can change.

Where international policy stands

States continue to debate new international rules for autonomous weapons in forums including the Convention on Certain Conventional Weapons (CCW). The ICRC’s current materials support restrictions on systems whose effects are unpredictable and requirements that users be able to understand, explain and predict a system’s behavior. The precise definition of AWS and the form of any future treaty or political declaration remain unsettled.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

The CCW Group of Governmental Experts has stated: “Accountability for developing, deploying and using any emerging weapons system in the framework of the CCW must be ensured in accordance with applicable international law, including through the operation of such systems within a responsible chain of human command and control.” The statement captures a broad principle while leaving states to negotiate the details of testing, supervision, weapons reviews, data retention and prohibited uses.

A practical framework for evaluating a proposed deployment

Before approval

  • Define exactly which functions are autonomous and which remain human-controlled.
  • Specify the target classes, geographic area, duration and environmental conditions for which the system was tested.
  • Document foreseeable civilian-presence scenarios and the precautions that address them.
  • Assign named decision-makers for authorization, activation, supervision, interruption and investigation.
  • Set a stop condition for loss of communications, sensor degradation, unexpected objects or behavior outside tested limits.

During the mission

  • Monitor whether the actual environment remains within the approved operating envelope.
  • Require supervisors to act on alerts rather than treating them as informational only.
  • Record every change to mission parameters and every attempted abort or override.
  • Suspend the mission when information needed for distinction or proportionality is no longer reliable.

After the mission

  • Secure complete logs and relevant sensor data immediately.
  • Compare actual conditions with the assumptions used in the legal and technical review.
  • Investigate civilian harm and near misses, not only confirmed unlawful attacks.
  • Update training, configuration controls and authorization procedures in response to findings.

Common misunderstandings

“Any drone is an autonomous weapon.”

No. A drone piloted remotely by a person who identifies the target and decides when to fire is the ICRC’s example of a non-autonomous weapon. Aircraft autonomy for takeoff, navigation or landing does not decide the issue.

“A human pressed the launch button, so the system is human-controlled.”

That describes activation, not necessarily target selection. If software chooses and attacks targets after launch, the important control questions concern the limits, predictability, supervision and interruptibility of those functions.

“Autonomous weapons are automatically prohibited.”

There is no universally agreed definition or blanket treaty prohibition covering every system described as autonomous. Existing IHL applies now, while states debate additional restrictions and requirements. A particular use can nevertheless be unlawful if it violates distinction, proportionality, precautions or other applicable rules.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

“The algorithm is to blame.”

Software cannot replace the human and institutional duties attached to design, testing, authorization, operation and investigation. Autonomy may complicate evidence and causation; it does not transfer legal responsibility to a machine.

What readers should take away

Remote piloting places the final targeting judgment with a person during each engagement. An autonomous weapon places more of that function in software after a human has set the mission and activated the system. The decisive accountability questions are therefore practical: could responsible people understand and constrain the system, supervise it in the real environment, interrupt it when conditions changed and later explain exactly how the outcome occurred? Until those questions can be answered with reliable evidence, the claim that a weapon remains under effective human control is incomplete.
