Usually, no—not when the download contains Nintendo’s Super Mario 64 ROM, code, graphics, music, models, or other copied game data. Nintendo says uploading or downloading pirate copies of its games is illegal. A demake built entirely from independently written code and newly created assets can present a different legal analysis, but “homebrew” is not a blanket license. Copyright, trademarks, publicity rights, contracts, platform rules, and takedown risk can still apply. The answer also changes with your country and with the exact files being distributed.

Start with the files, not the label

“Demake” describes a project that recreates a newer or more technically ambitious game in an older style or on older hardware. It does not identify what is inside the download. Two files marketed as Super Mario 64 demakes may have completely different legal profiles.

  • A package may contain Nintendo’s original ROM with modifications already applied.
  • A patch may contain only instructions that alter a copy of the original game supplied by the user.
  • A homebrew build may contain new executable code, graphics, music, models, and levels created by its developers.

The decisive questions are whether Nintendo material is included, whether the user must provide a lawfully obtained original, whether access controls are bypassed, and how the project uses Nintendo’s names, characters, logos, and other identifying elements. Distribution, monetization, audience size, and local law also matter.

How the common download types compare

Download type Nintendo code or assets included Does the user supply an original? Access-control issue Practical legal profile
Unauthorized SM64 ROM Yes, the game data is the product being copied No; the download supplies the copy May involve circumvention, depending on the source and method High infringement risk; Nintendo expressly describes pirate uploads and downloads as illegal
Prepatched ROM hack or demake Usually yes, if the package includes the original ROM or extracted assets Often no May involve circumvention Riskier than a patch-only release because the copyrighted game data is redistributed
Patch-only release The patch can be authored separately, but it is designed to modify Nintendo’s game Yes, the user is expected to obtain the original Use may still implicate access-control rules Shipping no ROM file reduces one distribution risk but is not authorization or a guarantee of legality
Independently authored homebrew New code and assets, with no copied Nintendo files No Nintendo copy should be required Depends on the platform and how the software is installed Different from ROM distribution, but Nintendo copyrights, trademarks, publicity rights, contracts, and platform rules may still be relevant

Is downloading a Super Mario 64 ROM legal?

Nintendo’s published Intellectual Property & Piracy FAQ states: The uploading and downloading of pirate copies of Nintendo games is illegal. It also characterizes third-party links and peer-to-peer offers as unauthorized copies. A Super Mario 64 ROM obtained from a ROM site, file host, torrent, or another person is therefore directly within the conduct Nintendo says is illegal, regardless of whether the file is described as a backup, an archival copy, a hack, or a demake.

Owning an N64 cartridge does not automatically make a downloaded ROM lawful. Ownership of one physical copy and acquisition of another digital copy are separate events. The source of the digital file, the copying method, and the law where you live determine the analysis. A site’s claim that a file is “for educational use,” “abandonware,” or “safe if you own the cartridge” does not create a license.

What cartridge ownership can and cannot do in the United States

Section 117’s narrow archival rule

For the United States, 17 U.S.C. §117 can permit a lawful owner of a copy of a computer program to make an archival copy under specific conditions. The U.S. Copyright Office explains that the copy must be made by the legal owner, solely for archival or backup purposes, and that any archival copy must be destroyed or transferred with the original when the original is sold, given away, or otherwise transferred.

This rule is not a blanket right to download a ROM from someone else. It does not authorize a ROM site to make and distribute copies, and it does not let an owner sell or give away a backup separately from the original. Whether a particular cartridge dump qualifies as an archival copy can depend on the facts, including who made it, how it was obtained, and what the copy is used for.

Why the rule is not a universal answer

Section 117 is a U.S. statute. Other countries have different exceptions, definitions of private copying, and rules for software backups. Even in the United States, a separate issue may arise if making or using the copy requires bypassing a technological measure that controls access to the game.

Are ROM hacks and patch files legal?

A ROM hack or demake can be distributed in at least two ways. A prepatched package includes the original ROM, with modifications already applied. A patch-only package contains data that tells a patching tool how to alter a copy the user already has.

Patch-only distribution avoids sending Nintendo’s original ROM file, which is an important difference. It does not turn the project into an authorized Nintendo product, however. The patch may reproduce or depend on Nintendo code, graphics, music, models, characters, levels, or other protected expression. Applying it may also involve access-control questions under the Digital Millennium Copyright Act in the United States. Nintendo could still object to distribution, hosting, monetization, or branding.

A prepatched ROM is generally the more obvious risk because the download itself contains the copyrighted game data. Calling the package a “fan project” or “mod” does not change what is being copied. A patch author can reduce exposure by requiring users to supply an original, but that packaging decision alone is not a license and does not guarantee that the underlying project is lawful.

What about an independently made Mario-style homebrew game?

A project with independently written code and newly created art, music, models, sounds, and levels is materially different from redistributing Nintendo’s ROM. If it does not include extracted Nintendo files, the central copying issue changes. Developers still need to examine the names, characters, logos, visual identity, music, and other expressive elements they choose to use.

Copyright protects original expression, while trademarks identify the source of goods and services. A title or logo that suggests Nintendo sponsorship can create confusion even when the executable code is original. Character likenesses and other elements may also raise publicity or related rights depending on the country. Commercial sales, donations, advertising, or a large public release can increase practical enforcement risk, but a free download is not automatically lawful.

“Homebrew” describes how software is made or distributed for a platform; it is not a legal category that overrides copyright or trademark law. A homebrew game that uses no Nintendo code or assets still needs its own analysis of branding, platform terms, and the jurisdiction in which it is released and played.

Are emulators, flash carts, and circumvention illegal?

An emulator is a tool, not a verdict

An emulator can be lawful software. The legal question usually turns on the game files used with it, how those files were obtained, and whether access controls were bypassed. Using an emulator with an unauthorized ROM does not become lawful because the emulator itself is legitimate. Conversely, the existence of an emulator does not by itself prove that every use is infringing.

DMCA section 1201 and the 2024 exemptions

The Copyright Office explains that section 1201 of the DMCA generally prohibits bypassing technological measures that control access to video games and software. The 2024 rulemaking includes narrow exemptions for specified preservation and restoration activities involving eligible libraries, archives, museums, and certain lawfully acquired games. Those provisions are limited by the types of institutions, games, purposes, and access described in the regulation.

They are not a general public authorization to download Super Mario 64 ROMs, distribute circumvention tools, or bypass protections for ordinary personal convenience. A flash cartridge can be a storage or hardware device, but its legality depends on the files loaded onto it, how they were made, and the conduct involved in obtaining or sharing them.

What Nintendo’s fan-content guidelines actually cover

Nintendo’s published Game Content Guidelines say that, under stated conditions, it will not object to certain gameplay footage and screenshots shared on appropriate platforms. That is a limited policy for specified video and image uses. It does not grant a general license to distribute ROMs, copied game assets, fan games, patches, or every use of Nintendo characters and marks.

The guidelines also say Nintendo cannot provide legal advice and encourage people to seek their own counsel about a proposed use. Treat the policy as a narrow permission framework for the listed content, not as approval for a demake download.

Why your country matters

There is no worldwide rule that makes every demake legal or illegal. A decision requires at least two facts: the governing jurisdiction and the exact package being downloaded or shared. Relevant differences can include private-copy exceptions, software-backup rules, treatment of reverse engineering, anti-circumvention law, trademark standards, and remedies.

For a U.S. reader, section 117 and DMCA section 1201 are important reference points, but neither one turns a third-party ROM download into a safe default. For readers elsewhere, a local copyright lawyer or recognized national copyright office is the appropriate source for country-specific advice. A project released in one country can also be accessed, hosted, or monetized in several others, creating more than one legal exposure.

A practical check before you download or share

  1. Identify the exact files. Read the archive contents and project documentation. Determine whether it includes an original ROM, extracted Nintendo assets, or only independently authored files.
  2. Check the acquisition path. A file supplied by a third party is not converted into a lawful backup by your ownership of a cartridge.
  3. Separate patching from authorization. A patch-only release avoids shipping the ROM but does not grant permission to copy, modify, or distribute Nintendo material.
  4. Consider access controls. Ask whether creating, applying, or using the files requires bypassing a technological measure. DMCA exemptions are narrow and fact-specific.
  5. Review branding. Look for Nintendo names, logos, characters, music, and other expressive elements, as well as claims or presentation that could imply sponsorship.
  6. Assess distribution and money. Public hosting, peer-to-peer sharing, paid downloads, donations, advertising, and bundled devices create different practical risks from keeping a private experiment on your own equipment.
  7. Check local law. Apply the rules of the country where you obtain, host, or distribute the software, not only the country where the project’s author lives.

If you already downloaded a questionable file

Do not upload it, seed it, sell it, or pass it to friends. Do not assume that deleting a file erases every legal issue, but stopping further distribution avoids creating additional copies or offers. If the project is commercially important, you received a takedown notice, or you need to know whether a personal backup is covered by local law, consult a lawyer in the relevant jurisdiction. Nintendo’s own guidelines state that it does not provide individualized legal advice.

FAQ

Does owning the original cartridge let me download an SM64 ROM?

No automatic rule does that. In the United States, section 117 addresses a narrow archival copy made by a legal owner under stated conditions; it does not authorize obtaining a copy from a ROM site or treating a separately distributed backup as lawful.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Are all ROM hacks illegal?

No categorical answer is accurate. A prepatched hack that redistributes Nintendo’s ROM is riskier than a patch-only release, but a patch is not automatically authorized. The files, conduct, and jurisdiction control the analysis.

Are all emulators illegal?

No. An emulator is a tool. The legality of a particular use depends on the software loaded into it, how that software was obtained, and whether access controls were circumvented.

Can I play a fan-made Mario homebrew game on an emulator?

Only the specific project and use can be assessed. Original code and assets change the analysis, but Nintendo-related characters, marks, music, distribution terms, and local law may still create rights or enforcement issues.

Is a patch file always safe because it contains no ROM?

No. Patch-only packaging avoids distributing the original ROM file, but it is not a license and does not resolve possible copyright, trademark, anti-circumvention, or platform-policy issues.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Does Nintendo’s gameplay-video policy cover a demake?

Not generally. The published guidelines address specified gameplay footage and screenshots under stated conditions; they do not grant a general fan-game, ROM, or asset-distribution license.

The Bottom Line

Bottom line: Treat a downloaded Super Mario 64 ROM or prepatched demake containing Nintendo data as unauthorized unless qualified legal advice says otherwise. A patch-only project or genuinely original homebrew build may present a different case, but neither is automatically licensed. Check the exact files, access-control method, branding, distribution plan, and governing country before downloading, playing, or sharing.
