Are Hidden Recordings in the Workplace Legal? U.S. Privacy Rules Employers Should Know (2025–2026)

Sometimes, but there is no single nationwide answer. Federal law generally permits a participant to record a conversation when the recorder is a party or one participant has given prior consent. A state may require consent from everyone, however, and the result can change when people are in different states, the communication is by telephone or electronic service, the recorder is not a participant, or the recording captures protected labor activity.

Before pressing record, identify every participant’s location, the communication type, the recording purpose, applicable workplace or union rules, and how you plan to use or disclose the file. This U.S.-focused guide explains the federal baseline, stricter state rules, employer monitoring limits, the National Labor Relations Board’s 2025 position on covert bargaining recordings, and why legality and admissibility are separate questions.

Why a hidden recording can be lawful in one workplace and unlawful in another

Recording law is a combination of federal and state rules rather than a simple “one-party state” or “two-party state” label. The Federal Wiretap Act, Title III of the Omnibus Crime Control and Safe Streets Act, supplies a federal floor. States may impose greater protections, including an all-party-consent requirement. A recording that satisfies federal law can therefore still create state criminal or civil liability.

The facts that usually control are:

  • Where each participant is located. A meeting room, phone call, or video conference can involve several state laws at once.
  • What is being captured. In-person speech, telephone calls, video-conference audio, chat messages, screen images, and location data may be treated differently.
  • Who activated the recorder. Federal consent rules are different when the recorder is a participant versus a device left behind by a nonparticipant.
  • Why and how the file will be used. Ordinary documentation, a harassment report, organizing activity, collective bargaining, litigation, publication, and public disclosure raise different risks.
  • The setting and privacy expectation. A private office, open work area, restroom, locker room, home office, and employer vehicle do not present the same privacy analysis.

Because these details are fact-specific, a state-law attorney should review a planned covert recording when the consequences could include discipline, a lawsuit, criminal exposure, or disclosure of sensitive information.

The federal baseline: when one-party consent is enough

Department of Justice guidance describes 18 U.S.C. § 2511(2)(c) as permitting an interception when the person making it is a party to the communication or when one party has given prior consent. In practical terms, a participant may often record a conversation without telling the other participants under federal law. A person who is not part of the conversation generally cannot rely on that participant-consent exception merely by placing a microphone in the room.

The federal rule is not a universal permission slip. It applies to communications covered by the statute and does not eliminate state restrictions, privacy torts, employment consequences, confidentiality duties, or rules governing later disclosure. A recording made by an employee who is physically present may fit the federal participant rule; a manager who leaves a device in a conference room after leaving may not.

Consent must be tied to the actual recording

Consent is strongest when it is prior, informed, and specific about what will be captured and why. A general handbook statement that “systems may be monitored” may not clearly consent participants to a private meeting recording, especially where a stricter state law applies. If consent is required, announce the recording at the start, identify the participants, state the purpose and scope, and obtain an express confirmation that is itself preserved.

State all-party rules and conversations across borders

The Bureau of Justice Assistance explains that states can require more than the federal one-party baseline, including consent from all parties. Statutes may use terms such as “all-party” rather than “two-party,” and definitions can differ for telephone, in-person, and electronic communications. A state’s label alone does not answer whether a particular workplace recording is lawful.

Use the most protective practical approach

  1. List every person who can be heard, including a person who joins by phone or video.
  2. Identify the state where each person is located at the time of the conversation, not merely the employer’s headquarters or meeting address.
  3. Check the law for the specific medium: in-person speech, telephone, video-conference audio, messaging, or another electronic communication.
  4. If any applicable law may require all-party consent, obtain express consent from everyone before recording. Do not assume that silence, continued attendance, or a handbook acknowledgment is enough.
  5. Document the notice, the participants’ responses, the stated purpose, and any limits on storage or disclosure.

When a participant is traveling, working remotely, or calling from another state, the safest operational rule is to pause and obtain consent from everyone rather than betting on which jurisdiction a court will apply. Cross-border calls also create a separate risk when a company’s recording system is hosted or accessed in another jurisdiction.

Can an employee secretly record a manager or HR?

An employee who is a participant may satisfy the federal one-party rule, but state law can still prohibit the recording. A workplace policy may also restrict recording, although an employer cannot enforce a rule in a way that unlawfully chills protected concerted activity.

Complaints about harassment, discrimination, or safety

Recording a meeting about harassment, discrimination, retaliation, wage theft, or unsafe conditions can preserve an accurate account, but the subject matter does not automatically make a secret recording lawful. Check the states involved and the company’s policy first when possible. If recording is risky, contemporaneous notes, a written follow-up confirming what was said, witness names, and preserved emails may document the issue without creating a wiretap dispute.

Protected concerted activity under the NLRA

Section 7 of the National Labor Relations Act protects employees who act together to improve wages, benefits, and working conditions. Section 8(a)(1) prohibits an employer from interfering with, restraining, or coercing employees in exercising those rights. The National Labor Relations Board warns that employers may not spy on pro-union employees or maintain rules that reasonably tend to inhibit protected activity.

That protection is not a blanket right to record every workplace conversation. Whether an employee’s recording is protected depends on the facts, the purpose, the participants, the applicable state law, and whether the recording rule is being applied to suppress concerted activity or neutrally to protect legitimate privacy and confidentiality interests.

Can an employer record workers without telling them?

An employer may have a lawful business reason to monitor systems, investigate misconduct, secure facilities, or document customer transactions, but hidden recording can trigger federal and state wiretap laws, privacy claims, labor-law charges, and discipline disputes. Audio is especially sensitive because it captures “oral” or telephone communications within the reach of wiretap statutes. Video without audio may fall outside a wiretap statute in some circumstances, yet still violate privacy law or a state workplace-surveillance restriction.

Technology that can create surveillance problems

The NLRB’s 2022 surveillance memorandum identifies employer use of conversation recording, cameras, wearable devices, GPS, keyloggers, screenshots, webcam photographs, and audio recording as technologies that can become unlawful when their use would tend to interfere with protected activity. A camera aimed at a production line is not automatically equivalent to a microphone hidden in a break room; purpose, placement, notice, access, and effect all matter.

Locations with heightened privacy expectations

Restrooms, locker rooms, lactation spaces, medical areas, and similar locations present an especially high privacy risk. Employers should not place hidden microphones or cameras there unless counsel has identified a clear, lawful basis—and in many jurisdictions such recording is prohibited. Recording a private employee conversation in an office can also create exposure even when the same device is lawful in an open reception area.

A defensible employer monitoring program

  1. State the purpose. Explain whether monitoring is for security, quality control, legal compliance, training, or another defined need.
  2. Give clear notice. Identify the technologies, types of data, locations, and circumstances covered. Obtain consent where required by state law.
  3. Limit collection. Turn audio off when it is not necessary, avoid high-privacy spaces, and restrict monitoring to the least intrusive method that meets the purpose.
  4. Protect the files. Use role-based access, encryption, audit logs, and a written retention and deletion schedule.
  5. Separate protected activity. Do not target union activity, wage discussions, safety organizing, or other Section 7 activity, and do not apply a recording rule selectively to discourage it.
  6. Train supervisors. A manager who records from a personal phone or leaves a device running can create liability outside the approved program.

Collective-bargaining sessions: a heightened 2025 NLRB risk

On June 26, 2025, Acting NLRB General Counsel William B. Cowen announced GC Memorandum 25-07. The memorandum states the Acting General Counsel’s position that secretly recording a collective-bargaining session is a per se violation of the NLRA and directs regional offices to issue complaints when investigations support that theory. Cowen said, “The use of surreptitious recordings during the collective bargaining process is inconsistent with the openness and mutual trust necessary for the process to function as contemplated by the Act.”

This is an agency enforcement position, not a statute that automatically resolves every recording dispute or a final Supreme Court rule. Board decisions, the facts of a particular case, and later agency policy can affect how the position is applied. Nevertheless, covert recording of bargaining sessions should be treated as exceptionally high risk. Obtain agreement in advance, record openly in the ground rules, or use written minutes instead.

Hidden cameras, microphones, calls, and electronic meetings

Situation Questions that control the analysis Typical risk points
Employee records a meeting while participating Where are all participants, and does the applicable state require all-party consent? State wiretap liability, policy-based discipline, and disclosure of confidential information.
Employer records a meeting it arranged Was notice given, was consent required, and is the purpose legitimate and limited? Wiretap claims, privacy claims, selective enforcement, and NLRA interference.
Device left in a room by a nonparticipant Did the person have authorization, and were private oral communications captured? Federal and state interception laws, invasion of privacy, and severe evidence problems.
Video camera with no audio What location is covered, who is visible, and what notice or state surveillance rules apply? High-privacy locations, biometric or image misuse, and labor-law surveillance.
Phone or video-conference call across states Where is each person located, and which consent rule applies to the service and recording? Applying one state’s rule to everyone, cloud access, and later disclosure.

The table describes issues to investigate, not a guaranteed result. A recording can be lawful to make but unlawful to publish, or unlawful to make yet still considered by a tribunal under a separate evidence rule.

Will a secret recording be admissible in an NLRB case?

The NLRB Bench Book states that recordings are generally admissible in Board proceedings even when made without a party’s knowledge or consent. It also notes that a different result may apply if the federal wiretap statute was violated. “Admissible” means a tribunal may receive or consider the file; it does not legalize the recording.

Analyze three separate questions:

  1. Was making the recording lawful? Apply federal, state, and privacy rules to the participants, medium, and location.
  2. Can the employer discipline the recorder? Consider a neutral recording policy, how it was enforced, contractual rules, and whether the conduct involved protected concerted activity.
  3. Will a tribunal rely on it? Authentication, completeness, relevance, hearsay, confidentiality, and any statutory exclusion rule still matter.

Preserve the original file, keep metadata intact, note who made and stored copies, and avoid editing the evidentiary version. Before sending it to coworkers, posting it online, or giving it to a journalist, obtain jurisdiction-specific advice; disclosure can create a new privacy or confidentiality violation even if the original recording was lawful.

A decision checklist before anyone presses record

  1. Write down every participant and each person’s physical location.
  2. Classify the communication: in-person, telephone, video conference, chat, screen capture, or another electronic form.
  3. Determine whether the recorder is a participant or an outside observer.
  4. Identify the purpose: routine documentation, an investigation, protected concerted activity, bargaining, security, training, or another reason.
  5. Review the employer handbook, meeting ground rules, collective-bargaining agreement, and any union policy.
  6. Check whether any state involved requires consent from all participants. If uncertain, give clear notice and obtain affirmative consent.
  7. Decide who will have access, how long the file will be kept, and whether disclosure is necessary.
  8. For bargaining sessions, do not use a covert recording; get express agreement or use minutes.
  9. If the risk includes criminal liability, a significant employment action, or public disclosure, obtain advice from a lawyer licensed in the relevant state before recording.

If a hidden recording already exists

Do not alter, rename in a way that destroys metadata, or circulate the original file casually. Make a secure working copy, preserve the original and the device information, record when and where it was made, and limit access. Do not assume that deleting a file removes liability; backups, cloud copies, and recipients may remain.

Obtain advice before disclosure, especially when the file contains medical information, trade secrets, customer data, union strategy, or conversations involving people in multiple states. A lawyer can assess preservation duties, reporting options, possible privilege, and whether a state suppression or civil-liability rule changes the safest next step.

What employers should put in writing

A sound policy should identify monitored systems and locations, the business purposes, notice and consent procedures, prohibited high-privacy areas, access controls, retention periods, investigation authority, and a contact for questions. It should distinguish video from audio, explain when remote meetings are recorded, and require supervisors to use approved tools rather than personal devices.

Policies must be applied consistently. A rule that appears neutral can still violate Section 7 if employees would reasonably understand it as banning wage discussions, organizing, or other protected concerted activity. Review policies with labor and privacy counsel whenever technology, state operations, or union relationships change.
