Under the federal baseline, a person who is part of a conversation can generally record it with the consent of one participant, including the recorder. That exception does not apply when the interception serves a criminal or tortious purpose. State law can be stricter: some states require consent from every participant in a private conversation.
The result depends on where each participant is located, whether the conversation is private, who operates the recorder, what device is used, and how the file will be used or disclosed. Before pressing record, identify every relevant jurisdiction and obtain clear consent from everyone whenever feasible.

What federal law says about covert recordings
Section 2511 of Title 18 of the United States Code generally prohibits intentionally intercepting wire, oral, or electronic communications. It contains a private-person exception commonly described as “one-party consent.” The statute says: “It shall not be unlawful under this chapter for a person not acting under color of law to intercept” a communication when that person is a party to it or when one party has given prior consent, subject to the statute’s limitation on criminal or tortious purposes.
When the recorder is a participant
If you are actually taking part in the conversation, the federal rule usually permits you to record without telling the other participants. The federal rule is only a baseline, however. It does not override a stricter state law, and it does not resolve every question about privacy, devices, later disclosure, or a recording made for an unlawful objective.

When the recorder is not a participant
A person who is not part of the conversation cannot rely on the participant branch of the exception. Federal law may still recognize consent if one participant authorized the interception, but the facts must genuinely establish that consent. Secretly placing a recorder in a room, vehicle, office, or home without participant consent creates a different and usually greater risk than recording a conversation in which you are speaking.
The criminal-or-tortious-purpose limit
One-party consent is not a license to record for an unlawful purpose. The statute and Department of Justice guidance preserve the exception only when the interception is not made for a criminal or tortious purpose. “Tortious” refers to conduct that can give rise to a civil claim, such as an intentional privacy invasion or misuse of confidential information. A recording made to threaten, blackmail, facilitate a crime, or carry out another wrongful scheme can fall outside the federal exception even when the recorder is a participant.
Why state consent laws can change the answer
Federal law establishes a minimum framework; states can impose additional protections. The Bureau of Justice Assistance notes that some states require all parties to consent before a private conversation is recorded. In those jurisdictions, being one of the speakers does not by itself make a hidden recording lawful.

Example: Illinois
Illinois law requires consent of all parties to record a private conversation when the recorder is not a party. The exact facts still matter, including whether the conversation was private and whether the statutory definition applies, but Illinois illustrates why a federal one-party assumption is unsafe. You must read the current statute and controlling decisions for the jurisdiction involved rather than rely on a nationwide rule of thumb.

Six facts that determine whether a covert recording is risky
1. Where each person is physically located
For a phone, video, or online call, list the physical location of every participant, not merely the area code or mailing address. Also identify where the recording device is located. Different states may connect their privacy statutes to the speaker, the listener, the device, or the place where the conversation occurs. When the locations point to different rules, do not assume the most permissive law controls.
2. Whether the conversation is private
Consent statutes commonly focus on private conversations. A conversation held openly in a setting where people can ordinarily hear it may present a different privacy analysis from a closed meeting, a home, a private office, or a call understood to be confidential. “Public” does not automatically mean “free to record,” and “private” does not automatically answer every question; the circumstances and applicable statute control.

3. Whether you are a participant
Say exactly what your role is. A person speaking on the call is a participant. A person who leaves a recorder in a room and is not part of the discussion is a non-participant. Asking another participant to place a device in the room may create an authorized interception in some circumstances, but it can also raise separate issues if the consent was obtained through deception or for an unlawful purpose.

An ordinary phone or digital recorder is not the only possibility. Federal communications rules contain a device-specific provision: 47 C.F.R. §2.701 requires authorization from all parties to use a covered radio device to overhear or record private conversations, with an exception for law-enforcement activity. A consent analysis that seems adequate for a normal phone may not satisfy a rule aimed at a particular radio device.
5. Why you are recording
Document the legitimate objective before you start. Preserving your own conversation for accurate notes, memorializing an agreed interview, or creating an authorized business record is different from recording to intimidate someone, obtain leverage for extortion, or commit another civil or criminal wrong. The federal exception does not protect an interception made for a criminal or tortious purpose.

6. What you will do with the file
Recording and disclosure are related but distinct decisions. A lawful recording can create new exposure if you publish it, send it to people who have no reason to receive it, use it to threaten someone, or violate a confidentiality agreement. Check the rules that govern the intended audience and channel before uploading, forwarding, or attaching the audio to a complaint.

Phone calls between different states
Interstate calls are where a simple “one-party” answer becomes especially unreliable. Suppose you are in a one-party-consent state and the other speaker is in a state that requires all-party consent. The federal rule may permit your participation, while the other state’s statute may prohibit a hidden recording of a private call. Courts do not produce one universal conflict-of-laws result for every combination of facts.

State variation makes that a risk-reduction recommendation, not a claim that every interstate call is governed by one particular state’s law. Preserve the consent in the recording or in writing so there is a clear record of what was authorized.
Hidden recorders at work, school, or in healthcare settings
A workplace does not create a blanket exception or a blanket prohibition. Start with the state consent rule, then check the employer’s handbook, confidentiality agreements, meeting rules, and any policy governing company devices. A school, clinic, hospital, or telehealth platform may impose additional privacy and recording requirements. Contracts can also restrict recording or disclosure even when a criminal statute would not.
Before recording a meeting, interview, performance discussion, patient interaction, classroom exchange, or call with a service provider, ask whether the organization requires notice or written authorization. If the recording may become evidence in a dispute, consult a lawyer licensed in the relevant jurisdiction before pressing record or distributing the file.
A safer workflow before you press record
- Map the locations. Write down the physical location of every participant and the location of the recording device.
- Classify the conversation. Decide whether the participants reasonably expect privacy and whether the conversation is openly audible to bystanders.
- Identify your role. Note whether you are a participant, a non-participant controlling the device, or relying on another person’s authorization.
- Identify the equipment. Confirm whether you are using a normal phone or recorder, a platform’s built-in function, or a covered radio device subject to 47 C.F.R. §2.701.
- Check current law. Read the current statute and controlling cases for every relevant jurisdiction. Do not rely on a chart that does not identify its date or scope.
- Ask for consent. Give clear notice that you intend to record and obtain an affirmative “yes” from every participant whenever feasible. Avoid vague wording such as “this may be recorded” if you need proof of authorization.
- Preserve the authorization. Keep the consent in the recording itself or in a dated written record, along with the participants’ identities and locations.
- Check private rules. Review employer, school, healthcare, contract, and platform requirements before recording or sharing.
- Limit handling. Store the file securely, restrict access to people who need it, and decide in advance whether retention or deletion rules apply.
- Get legal advice for a dispute. If the audio could be evidence, ask a lawyer licensed where the relevant participants and device are located before recording, editing, filing, or disclosing it.
If you already made a covert recording
Do not publish it, threaten someone with it, or forward it broadly while you are still unsure whether it was lawful. Preserve the original file without editing, record the date, locations, participants, device, and purpose, and keep any messages showing consent or notice. Do not create additional copies for convenience; unnecessary distribution can increase the number of people exposed to a potentially protected communication.

Ask counsel to evaluate both the interception and the planned use. The answer may differ for keeping the file privately, giving it to a lawyer, submitting it in a proceeding, sending it to an employer, or posting it online. A lawyer can also advise whether a court or agency has particular authentication, chain-of-custody, or filing requirements.
Why no nationwide yes-or-no answer exists
The federal framework, the state-consent split, the Illinois example, and the radio-device rule show why “Is it legal to record someone without them knowing?” cannot be answered for every situation in one sentence. The official authorities establish the federal rule and demonstrate meaningful state variation, but they do not create a complete current 50-state answer for every workplace, public-place, device, or disclosure scenario.
Use the federal one-party rule as a starting point, not a guarantee. When facts cross state lines, involve a private setting, use specialized equipment, or involve later publication or a dispute, disclosure and legal advice are safer than assumptions.
