Sometimes—but not automatically. Whether an AI company may use your prompts, files, posts, or other personal information to train a model depends on the product’s contract and settings, how the data was collected, your jurisdiction, and the provider’s legal basis and privacy notices. A public post is not a universal grant of permission, and a privacy policy is not a blanket exemption from privacy or copyright law.
Training is also only one possible use. A provider may retain inputs for service operation, safety monitoring, abuse prevention, troubleshooting, or human review even when those inputs are excluded from model-improvement training. Check the current terms for the exact product and account type before submitting sensitive information.

What decides whether an AI company can train on your data?
There is no single worldwide rule that either permits or prohibits AI training on user data. Four questions usually control the answer:

- What did you agree to? Consumer, business, education, healthcare, and API products can have different terms and defaults.
- What did the provider tell you? Privacy notices and in-product controls must accurately describe material uses. In the United States, the Federal Trade Commission (FTC) says a model-as-a-service company that breaks its privacy or confidentiality commitments may violate laws the agency enforces.
- What is the data and where did it come from? Personal data, confidential business information, special-category data, and copyrighted works raise different issues. Data gathered from a private service is not assessed in the same way as information deliberately published for broad distribution.
- Which law applies? The European Union’s General Data Protection Regulation (GDPR), United States consumer-protection law, copyright rules, contracts, and sector-specific regulations can overlap.
“Training” generally means using examples to change or evaluate a model’s parameters or related systems. It is different from storing a conversation so the service can display it later, using it to detect abuse, or having a reviewer inspect it for safety. A no-training promise does not necessarily mean no retention.

Provider policies differ by product and account
Reading the name of a company is not enough. The same provider can offer one service that uses consumer conversations for improvement and another that excludes business inputs by default. The following examples illustrate why the exact product terms matter; defaults and controls can change, so verify them when you sign up or before uploading data.

These are examples, not an industry-wide standard. A free consumer account, a paid individual account, an organization-managed workspace, and an API key can all have different defaults. If an employer or school provides the account, its administrator may control retention and access even when the underlying technology is the same.
Can ChatGPT or another chatbot train on your conversations?
It depends on the account, product, and active setting. A consumer service may allow conversations to be used for improving models unless you turn off the relevant option or use a temporary mode. OpenAI’s cited business policy describes no-training defaults for the named business, education, healthcare, teacher, and API products. Anthropic’s cited consumer guidance describes an explicit-feedback or opt-in route for training consumer materials.
Do not infer a result from a single toggle without reading its scope. A control may cover future conversations but not information already used for improvement; it may exclude model training while permitting retention for security; or it may apply only to a particular workspace. Save a copy or screenshot of the terms and the setting you relied on, including the date.
Does posting something publicly give an AI company permission?
No automatic permission follows from public availability. Under the European Data Protection Board’s (EDPB) analysis in Opinion 28/2024, adopted 18 December 2024, the fact that information is public is one factor in assessing legitimate interest and a person’s reasonable expectations. Other factors include the relationship with the provider, the context in which the information was collected, its source, later uses, and what people were told.

Copyright is a separate question. A public article, photograph, code repository, or forum post can still be protected by copyright even if anyone can view it. The U.S. Copyright Office’s AI initiative continues to examine the use of copyrighted material in training; it has not declared all such training lawful or unlawful. Outcomes therefore remain fact-specific and developing.
Robots.txt files, platform terms, licenses, and takedown mechanisms may affect a particular collection, but none should be treated as a universal answer for every jurisdiction or model. If publication was limited to a community, behind a login, or accompanied by an expectation that it would be used only for a particular purpose, those circumstances can matter to a privacy analysis.

Is consent always required under GDPR?
No. GDPR recognizes six legal bases, including consent and legitimate interests. The correct basis depends on the processing and its context. A provider relying on legitimate interests must show that the processing is necessary and that its interests do not override the person’s rights and freedoms. The EDPB’s Opinion 28/2024 treats reasonable expectations and the source and context of data as important parts of that balancing exercise.
When consent is relevant
Consent must be informed, specific, freely given, and capable of being withdrawn. Bundling an unexpected training use into an unrelated service choice can create problems. Withdrawal generally stops future processing that relies on consent; it does not automatically undo every past use or reconstruct a model.
Special-category and sensitive information
Health details, biometric identifiers, political opinions, religious beliefs, sexual-orientation information, and similar special-category data receive additional protection. A provider needs both a general legal basis and a qualifying condition for the sensitive category. Do not assume that a general “we may use content to improve services” clause satisfies those requirements.

Anonymisation is a high bar
The EDPB says data is anonymous only when it is very unlikely that a person can be identified or that personal data can be extracted through queries. Replacing a name with a random identifier may be pseudonymisation rather than anonymisation if other details can reconnect the record to a person. A model that can reproduce distinctive personal information may therefore raise continuing data-protection questions.

A privacy policy is evidence of notice and may form part of the contractual relationship, but it is not a universal safe harbor. The FTC warns that companies must honor their privacy and confidentiality promises and may face liability if they silently change terms or bury a new use in fine print. A policy that clearly describes training may support a provider’s position, but it does not erase other legal duties, such as data minimization, purpose limitation, security, or copyright compliance.
Look for four separate statements rather than one broad sentence:
- Whether prompts, uploads, outputs, and feedback are used to train or improve models.
- How long raw content and logs are retained, and whether backups follow a different schedule.
- Whether people or automated systems review content for safety, quality, or abuse investigations.
- How to exercise access, deletion, objection, correction, or other rights.
Training is not the same as storage, safety review, or human access
A provider can exclude your content from model training and still process it for other reasons. Service operation may require temporary storage so a response can be generated or displayed across devices. Security teams may retain prompts to investigate fraud, account compromise, or harmful use. Automated filters can scan content, and trained reviewers may inspect a limited sample under the provider’s safety procedures.
Ask a provider to describe each purpose separately. “Not used to train” should not be read as “never retained,” “never reviewed,” or “immediately deleted.” For an API or business deployment, the contract should identify retention windows, deletion triggers, sub-processors, data locations, and exceptions for legal or security obligations.

What to do before submitting sensitive information
- Identify the account and region. Record whether it is a consumer, business, education, healthcare, or API product and which country’s terms apply.
- Open the current privacy or data-controls page. Find the setting governing model improvement, training, feedback, or history. Read its scope instead of relying on a product slogan.
- Choose a no-training option when available. For organizational work, prefer a contract that expressly excludes inputs and outputs from training by default. Confirm whether the exclusion applies to all workspaces and integrations.
- Configure retention. Select the shortest practical history and deletion period. Qualifying API organizations may be able to configure zero data retention, but confirm eligibility and the exceptions that still apply.
- Minimize the prompt. Remove names, account numbers, exact addresses, health information, credentials, trade secrets, customer records, and confidential source code. Replace them with realistic placeholders and keep the mapping offline.
- Check connected tools. A plug-in, browser extension, analytics service, or human-support channel may receive the same content under separate terms.
- Document your decision. Keep the terms, data-processing agreement, setting, and date. Policies and defaults can change.
What if your information was already submitted?
Start with the provider’s documented privacy-request channel. Ask what data is associated with your account, whether it was used for training or evaluation, the applicable retention period, and whether deletion, objection, or restriction is available. Preserve your request, identity-verification records, and the response.
Deleting a conversation usually removes that record from the user-facing history; it does not guarantee that every derivative, safety log, backup, or model parameter disappears immediately. Do not promise yourself that a model has “forgotten” information unless the provider explains the technical and legal effect. Where GDPR applies, rights and remedies depend on whether the provider is acting as controller or processor, the legal basis, and the circumstances of the processing. A supervisory-authority complaint or qualified legal advice may be appropriate for a disputed request.
The EDPB has noted that unlawfully processed personal data used in development can affect the lawfulness of later deployment unless the model has been duly anonymised. That observation does not create an automatic deletion remedy for every prompt; it underscores why the original collection and the model’s ability to reproduce information matter.
What businesses should compare before choosing an AI service
Procurement teams should compare the written agreement and technical controls, not just a marketing page.

| Security and incident response | What encryption, access logging, breach notification, and tenant-isolation commitments are contractual? |
OpenAI’s business and API controls illustrate the kind of commitments to verify, but they are not a universal industry standard. Require the provider to state which products, regions, and data types each promise covers.
Practical answers to common situations
You paste a customer email into a consumer chatbot
That message may contain personal data belonging to someone who never agreed to the chatbot’s terms. Remove identifying details, confirm your employer’s policy, and use an approved business or API environment with documented no-training and retention controls.
You publish an article and later find it in a model’s answer
Public access alone does not settle either privacy or copyright. Check the site’s terms and license, identify the provider and model version if possible, and use the provider’s rights or privacy channel. A reproduction may result from retrieval or memorization rather than new training, so ask what process produced it.
You opt out after months of use
The opt-out should govern future processing according to its terms. Ask whether earlier data was used for improvement and what deletion or objection process applies to those records. Keep the confirmation.

AI companies may be allowed to train on some data in some circumstances, but permission is never automatic merely because information was entered into a chatbot or posted publicly. The decisive details are the product’s contract and settings, the data’s source and sensitivity, the provider’s notice and legal basis, and the law that applies where you are. Treat training, retention, safety review, and copyright as separate questions, minimize sensitive content, and obtain explicit business terms when confidentiality matters.
