Are AI-Agent Payments Safe, and Who Is Liable When an Agent Makes a Mistake?

AI-agent payments can be made reasonably safe, but only when the agent has tightly bounded authority and every consequential action is subject to payment controls. A language model can misunderstand a request, invent a fact, select the wrong recipient or repeat a transaction. If that error moves money, ordinary software mistakes become financial disputes.

There is no universal rule that automatically makes the user, business, agent vendor or bank responsible. Liability depends on the jurisdiction, the payment rail, the authorization that was granted, security practices, contracts and the facts of the incident. UK consumer guidance puts responsibility for a business’s customer-facing agent on the business; international and US authorities say existing payment rules may need adaptation for autonomous commerce.

What “safe” means for an agent that can pay

Safety is a property of the whole payment system, not a promise that the underlying model will never be wrong. The UK Competition and Markets Authority (CMA) warns that agents can produce hallucinated or nonsensical outputs and that autonomous errors become especially costly when they affect financial decisions, contracts or service availability.

A safe design assumes the model will sometimes fail. It limits what the model can ask a payment service to do, verifies the request independently, obtains stronger approval for risky transactions and preserves enough evidence to investigate a dispute. The goal is to make an isolated model error fail closed rather than become an irreversible transfer.

  • Least privilege: give the agent only the payment tools and data required for its task.
  • Hard limits: enforce maximum amounts, approved merchants, categories, currencies, destinations, transaction velocity and operating hours outside the model.
  • Step-up authentication: require stronger verification when risk rises, such as a new recipient, unusual location or high amount.
  • Human confirmation: require a user or designated employee to approve high-risk or irreversible actions.
  • Independent monitoring: detect duplicates, unusual patterns, policy violations and attempts to bypass controls.
  • Kill switch and escalation: let an authorized person stop the workflow and reach a human operator quickly.
  • Tamper-evident records: retain the instruction, relevant context, model and tool versions, approvals and exact payment message.

These controls reduce the probability and impact of an error; they do not eliminate the need to determine who must absorb a loss after one occurs.

Why autonomous payments create a liability gap

Traditional payment rules generally assume that a person authenticates a transaction or that a clearly defined service provider acts on a person’s instruction. An agent can sit between those assumptions: it interprets natural language, chooses tools, retrieves information and initiates an action without a person reviewing every field.

The International Monetary Fund (IMF) says autonomous agents challenge identity and authentication frameworks. If an agent hallucinates a recipient or misdirects funds, existing rules may not clearly distinguish unauthorized use from user negligence. The answer can turn on what authority the user granted, whether the system stayed within that authority, what security controls were available and whether warnings or confirmation steps were ignored.

That uncertainty means a mistaken payment is not automatically the user’s loss, nor is it automatically refundable by the bank, merchant, model developer or agent operator. Investigators need to reconstruct the authorization chain and apply the rules for the specific country and payment rail.

Who may be responsible today

Participant When responsibility may arise What must be examined
Business deploying the agent Customer-facing conduct, misleading recommendations, incorrect refunds, unauthorized actions or failures to supervise the system. Consumer-law duties, disclosures, controls, employee oversight and the business’s own representations.
Agent or model vendor A contractual failure, security defect, negligent service, breach of a warranty or failure to follow agreed incident duties. Contract scope, service commitments, indemnities, technical logs and applicable product or negligence law.
User or account holder Instructions that clearly authorized the payment, bypassing security warnings, sharing credentials or failing to use required safeguards. Exact consent, authentication events, warnings shown, account terms and whether the agent exceeded its mandate.
Bank, wallet or payment provider Failure to apply required authentication, fraud controls, error-resolution procedures or payment-rail obligations. The rail’s rules, consumer-protection law, verification records and whether the transaction was treated as authorized.
Merchant or recipient Misrepresentation, failure to deliver, acceptance of a clearly fraudulent payment or other independent wrongdoing. Merchant conduct, delivery evidence, refund terms and local law.

Several parties can share responsibility, or none may owe reimbursement under a particular rule. Private contracts can allocate costs between businesses, but they generally cannot remove statutory consumer rights.

UK: the deploying business remains accountable

The CMA’s guidance, published 9 March 2026, states: “It is important to remember that you are responsible for what an AI agent does in the same way you are responsible for what an employee does.” The CMA adds that this remains true when another company designed or supplies the agent.

For a UK business using an agent to answer customers, recommend products, process refunds or market goods, the business therefore retains its consumer-facing duties. The guidance calls for clear accountability, including liability when an agent acts outside customer instructions. Breaches can lead to enforcement, fines of up to 10% of worldwide turnover and consumer compensation, subject to the applicable UK law and enforcement process.

Vendor involvement is still important: a business may seek contractual indemnity or damages from a supplier. That is a separate commercial claim and does not shift the business’s immediate duty to treat its customer fairly.

IMF analysis: authorization and negligence are fact-specific

The IMF reports that “both principals and agents may face liability depending on the circumstances.” Its concern is practical: a system can be technically authenticated yet still act outside what the person intended. A dispute examiner may need to ask whether the user authorized a class of payments, whether the agent stayed within the stated limits, whether the user had a meaningful chance to confirm and whether the operator’s safeguards were reasonable.

Do not assume that a bank must reimburse every agent-generated error. Conversely, do not assume that clicking an approval button settles every question if the payment service failed to provide required security or dispute handling.

United States and payment-network rules are evolving

Federal Reserve Governor Christopher Waller said on 28 September 2026 that “current e-commerce liability frameworks—including network rules, consumer protection standards, and other regulations—could potentially be adapted for agentic commerce.” He also said fraud models and rules will need recalibration for agent payment patterns and noted that card networks are publishing technical specifications for secure agent payments.

Those comments describe an evolving policy and infrastructure environment, not a single US rule assigning every loss. The applicable answer can differ between cards, bank transfers, wallets and other rails, as well as between consumer and commercial accounts.

European Union: AI Act duties depend on classification

Under the European Commission’s 2026 FAQ, an agent is not automatically a high-risk system merely because it can make payments. Obligations depend on how the system is classified and what it does. Systems that fall into a high-risk category receive additional requirements for safety, risk management, human oversight, record-keeping and trustworthiness on the dates applicable to that category.

AI Act compliance does not by itself decide who refunds a mistaken transfer. A payment dispute still requires applying the relevant financial-services and consumer rules, contract terms and evidence about authorization.

How a safe payment architecture should work

  1. Translate the user’s request into a constrained intent. Store the intended recipient, amount or range, currency, purpose, timing and expiration. Do not treat a free-form model response as a payment authorization.
  2. Separate reasoning from execution. Let the model propose an action, but send it through a deterministic policy engine and an independent authorization service. The model should not hold unrestricted credentials or call a bank API directly.
  3. Apply risk-based checks. Compare the proposed transaction with allow-lists, spend limits, velocity rules, geography, merchant category, account history and sanctions or fraud controls where applicable.
  4. Require step-up approval. A new payee, unusual country, high amount, changed bank details or irreversible transfer should trigger explicit confirmation or human approval. Show the exact recipient and amount, not only the agent’s explanation.
  5. Use idempotency and replay protection. Give each payment request a unique identifier, reject duplicates and handle timeouts without blindly retrying. A delayed response must not create a second transfer.
  6. Record an evidence trail. Capture the original instruction, retrieved data, prompts or policy inputs relevant to the decision, model and tool versions, approvals, timestamps and the final message sent to the payment rail.
  7. Provide intervention. Operators need a kill switch, queue controls and a documented route for escalation, cancellation or recall where the rail permits it.
  8. Monitor outcomes after launch. Track false approvals, false declines, complaints, duplicate attempts, unusual recipients and policy overrides. Review incidents rather than relying only on pre-launch testing.

Controls businesses should verify before deployment

Define the authority boundary

Write a policy that lists permitted actions and denies everything else at the tool or API layer. “Pay bills” is too broad unless it specifies approved billers, maximum amounts, frequency, currencies and what happens when information is missing or conflicting.

Test failure modes, not just successful purchases

  • Normal requests with complete information.
  • Adversarial instructions designed to override policy.
  • Hallucinated account numbers or altered invoices.
  • Timeouts, partial failures, duplicate callbacks and replayed messages.
  • Changed recipient details between approval and execution.
  • Compromised accounts, stolen sessions and unavailable human reviewers.

Set measurable stop conditions, document who receives alerts and rehearse recovery. A test that covers only a successful transaction says little about whether the system can contain a mistake.

Make records usable in a dispute

Logs should let an investigator answer: What did the person ask for? What information did the agent receive? Which policy allowed the action? Who approved it? What exact fields reached the payment provider? Were warnings displayed, and did anyone override them? Protect records from alteration and restrict access because they may contain personal and financial data.

Tell customers what the agent can do

Disclosures should identify the agent’s role, its limits, any incentives or affiliations, the kinds of data it uses, when a human reviews an action and how to obtain correction. Offer a human route for disputes; a chatbot-only loop is not a meaningful remedy for a missing refund or misdirected transfer.

How to compare two agent-payment options

Evaluation axis Questions to ask Evidence to request
Authorization and authentication Can each payment be tied to verified intent, recipient, amount and context? Is step-up authentication available? Authentication flow, approval screens, credential design and dispute records.
Bounded autonomy Are spend, merchant, category, velocity, geography and time limits enforced outside the model? Policy configuration, deny rules, override controls and test results.
Evidence and oversight Are prompts, tool calls, retrieved data, model/version, approvals and payment instructions retained in tamper-evident logs? Retention policy, audit export, access controls, alerting and kill-switch procedure.
Redress and accountability Who handles complaints, recalls, refunds and incident escalation? Do contracts address supplier failures? Support process, service levels, indemnities, insurance, breach notices and rail-specific dispute rules.

What to do after an agent sends the wrong payment

  1. Stop further activity. Disable the agent, revoke its payment token or suspend the workflow before investigating.
  2. Contact the payment provider immediately. Ask about recall, cancellation, chargeback or error-reporting deadlines for that rail. Do not assume a recall is possible.
  3. Preserve evidence. Save the original instruction, confirmation screen, alerts, account statements, timestamps and correspondence. Do not edit or delete logs.
  4. Notify the relevant operator. Report the incident to the business, agent supplier and security team under the applicable incident process.
  5. Challenge the classification of the transaction. Ask whether the provider treats it as authorized, unauthorized, fraudulent or a service error, and request the rule and deadline being applied.
  6. Escalate unresolved complaints. Use the provider’s formal complaint route and the appropriate financial ombudsman, regulator or court process for your jurisdiction. Businesses should obtain qualified legal advice before making admissions or relying on an indemnity.

Practical rules for consumers

  • Give an agent a small, dedicated payment limit rather than unrestricted access to your main account.
  • Use approved recipients and require confirmation whenever bank details change.
  • Read the exact amount, payee and currency in the final approval screen.
  • Enable alerts for every transaction and review them promptly.
  • Never share one-time passwords or recovery codes with an agent or a person claiming to operate one.
  • Keep a record of the instruction and the authorization you granted; it may determine how a dispute is assessed.

The bottom line on safety and liability

AI-agent payments are not inherently unsafe, but autonomous convenience must be traded for constrained authority, independent checks and visible human control. The business that puts an agent in front of customers cannot generally disclaim responsibility simply because a supplier built the system. For a disputed transfer, however, the outcome remains fact- and jurisdiction-specific: authorization scope, security failures, contracts and the payment rail’s rules all matter.

As the CMA, IMF and Federal Reserve analyses indicate, institutions are adapting rules and infrastructure rather than offering a settled universal answer. Until those standards mature, the safest deployment is one that makes high-risk actions explicit, reversible where possible and provable after the fact.
