Apple Legal Disputes FAQ: Antitrust, App Store Rules, Privacy and Patents (2026 update)

Apple faces several different kinds of legal pressure, not one single “Apple lawsuit.” The U.S. Department of Justice alleges that Apple unlawfully maintains smartphone monopolies; a California federal court found Apple violated an earlier App Store injunction; the European Commission has imposed a €500 million Digital Markets Act fine and ordered changes to steering rules; Apple’s privacy policies require permission for tracking; and patent cases continue in federal courts. Each matter has a different jurisdiction, legal theory, remedy and procedural status.

What is Apple being sued for in the United States?

The U.S. Department of Justice (DOJ) filed a federal antitrust complaint on March 21, 2024. Sixteen state and district attorneys general joined the case. The complaint alleges that Apple illegally maintains a monopoly over smartphones by selectively imposing contractual restrictions on developers and withholding critical access points.

The DOJ’s theory is monopolization under federal antitrust law (commonly described as a Sherman Act Section 2 case). Prosecutors are not alleging that a popular product is illegal merely because it is successful. They allege that Apple has monopoly power and preserves it through exclusionary conduct rather than competition on the merits. Attorney General Merrick B. Garland stated: “We allege that Apple has maintained monopoly power in the smartphone market, not simply by staying ahead of the competition on the merits, but by violating federal antitrust law.”

The complaint targets conduct involving the iPhone platform, developers, distribution, payments and access to functions that can affect competition. Filing a complaint establishes allegations, not a final finding that Apple violated the law. The federal court must still resolve factual and legal disputes, and appeals or later settlements could change the outcome.

Why the DOJ’s financial figures appear in the case

The DOJ’s 2024 release described Apple as reporting $383 billion in fiscal-year 2023 net revenue and $97 billion in fiscal-year 2023 net income. Those figures provide scale for the company discussed in the complaint; they are not a damages award, a penalty or a court finding that the revenue resulted from unlawful conduct.

What changed in the Epic Games App Store litigation?

The Epic litigation is a California federal-court enforcement proceeding involving a 2021 injunction. On April 30, 2025, the court found Apple in violation of that injunction. Apple’s Securities and Exchange Commission filing describes the order and its restrictions.

The order bars Apple from imposing commissions or fees on purchases consumers make outside an app when those purchases fall within the injunction’s scope. It also bars Apple from restricting how developers guide consumers to outside purchasing options and from interfering with a consumer’s choice to proceed inside or outside an app.

This is an injunction-enforcement finding, not the same thing as a final ruling on every question in the DOJ’s separate monopolization case. The practical issue is “steering”: whether an app can tell users that another purchasing channel exists and direct them there without Apple imposing the prohibited fee or restriction. The order may be challenged or interpreted further through subsequent proceedings, so developers should check the operative court orders and Apple’s current implementation requirements before changing payment flows.

What developers should distinguish

  • Outside-app purchase: A transaction completed through a channel other than Apple’s in-app purchase flow.
  • Steering: Information or links that direct a user to an alternative way to obtain an offer or content.
  • Injunction enforcement: A court deciding whether a party complied with an existing order, rather than deciding the entire antitrust case anew.

What does the EU Digital Markets Act require from Apple?

The European Commission designated Apple a Digital Markets Act (DMA) gatekeeper for iOS, the App Store and Safari on September 5, 2023. It designated iPadOS on April 29, 2024. A gatekeeper designation brings specific obligations under the DMA; it is not by itself a finding that every Apple practice is unlawful.

Steering and alternative channels

On June 24, 2024, the Commission issued preliminary findings that Apple’s App Store rules prevented developers from freely steering consumers to alternative channels for offers and content. “Preliminary” means the Commission had identified a provisional concern and was giving the company an opportunity to respond before a final enforcement decision.

Apple’s SEC filing records a Commission decision dated April 23, 2025: a €500 million fine under the DMA Article 5(4) investigation and a cease-and-desist order. The order requires Apple to remove technical and commercial restrictions that prevented steering to alternative distribution channels. The fine is an EU regulatory penalty, not a private damages award, and it addresses the conduct described in the Commission proceeding.

How the EU matter differs from the U.S. cases

The DMA is a regulatory regime with ex ante obligations for designated gatekeepers. The DOJ case is a contested federal antitrust lawsuit alleging unlawful monopolization. The Epic matter concerns compliance with a U.S. court injunction. A result in one proceeding does not automatically decide the others because the legal tests, markets, evidence and remedies differ.

Is Apple an illegal monopoly?

There is no single answer that applies to every proceeding. The DOJ complaint alleges that Apple has monopoly power in smartphone markets and unlawfully maintains it. That allegation remains to be adjudicated in the federal case. The April 30, 2025 California order found a violation of an injunction, not a final determination that Apple is an illegal monopolist under the DOJ’s theory. The EU gatekeeper designation and €500 million DMA fine concern compliance with European regulatory obligations, which are distinct from the U.S. monopolization test.

In antitrust law, “monopoly” can describe market power; “illegal monopolization” requires proof of the relevant market, substantial power and exclusionary conduct meeting the applicable legal standard. Readers should therefore identify the jurisdiction and procedural stage before treating a headline as a final merits ruling.

How does App Tracking Transparency affect apps?

Apple’s User Privacy and Data Use documentation says that apps on iOS, iPadOS and tvOS 14.5 or later need a user’s permission through App Tracking Transparency (ATT) to track users or access the device’s advertising identifier. An app that wants to engage in the covered tracking must present the system permission request and receive authorization; it cannot treat silence or a preselected setting as consent.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

ATT is a platform privacy requirement, separate from the antitrust and DMA disputes. A developer can face App Store consequences for failing to follow it even if the developer has no connection to any of the lawsuits. The requirement applies to the listed operating systems and versions; teams supporting older systems must verify the rules that apply to those versions.

Privacy-policy requirements for App Store submissions

Apple’s App Review Guidelines require every app to provide a privacy-policy link in its App Store Connect metadata and inside the app. The policy must accurately address collection, use, sharing and handling of sensitive data, and the app must follow the applicable rules governing those activities.

These are documentation and platform-governance requirements, not a ruling that Apple’s own business model is lawful or unlawful. Apple’s App Store Transparency Report says that Apple reviews apps for compliance with the App Review Guidelines to uphold privacy, security and content standards. Because guidelines and operating-system behavior can change, developers should consult the current Apple documentation when submitting or updating an app.

What Apple legal dispute is about patents?

Apple is involved in multiple patent matters, so “the Apple patent case” is misleading. Patent litigation can involve infringement claims, validity challenges, licensing disputes, appeals and requests for Supreme Court review. The available official records show an ongoing portfolio rather than one case that represents every patent issue involving Apple.

CPC Patent Technologies v. Apple

The Supreme Court docket for CPC Patent Technologies Pty Ltd. v. Apple shows a patent-related petition docketed in 2025. The petition was denied on November 10, 2025. A denial ends that particular Supreme Court petition; it does not resolve every related patent claim or prevent other cases from continuing.

Haptic, Inc. v. Apple, Inc.

GovInfo records Haptic, Inc. v. Apple, Inc. as a patent-infringement case in the Northern District of California, case 24-2296. Court material dated June 3, 2025 confirms activity in that action. The existence of a docket entry does not establish that infringement occurred or indicate what remedy, if any, will ultimately be ordered.

These examples are representative, not exhaustive. A complete list would require checking the relevant court dockets and later orders. Patent remedies can include damages, an injunction, a declaration concerning validity or infringement, or no relief if a claim fails.

What these disputes mean for developers

Payment and distribution design

Developers planning an alternative checkout or distribution channel should separate three questions: what the current U.S. injunction permits, what the EU DMA requires for users in the European Union, and what Apple’s ordinary App Review rules still require. A permission in one jurisdiction does not automatically create a worldwide entitlement.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Disclosure and consent

Before release, verify that the privacy-policy URL appears in both App Store Connect metadata and the app, that disclosures match actual data practices, and that any covered tracking waits for ATT authorization on iOS, iPadOS or tvOS 14.5 and later. Keep records of consent logic and update them when SDKs or operating-system behavior changes.

Monitoring legal changes

Assign someone to monitor the DOJ docket, the California injunction and appellate orders, European Commission DMA decisions, Apple’s developer documentation and relevant patent dockets. Court orders and regulatory decisions can modify what is technically or commercially possible without changing the underlying app code immediately.

What these disputes mean for users

  • When an app presents an ATT prompt, allowing it is a choice about covered tracking and advertising-identifier access; declining can limit those activities without necessarily preventing the app from operating.
  • An alternative payment notice may reflect a court order or DMA obligation, but the price, refund process and support channel can differ from Apple’s in-app purchase system.
  • App Store review is a platform process, not a guarantee that every app claim, business practice or third-party service is accurate.
  • A lawsuit or patent docket entry is not proof that Apple or an opposing party has already lost.

  8. November 10, 2025: The Supreme Court denies the CPC Patent Technologies petition.

How to read a new headline about Apple

First identify the forum: U.S. federal court, a California injunction proceeding, the European Commission or a patent court. Then identify the event: complaint, preliminary finding, injunction, fine, appeal or docket entry. Finally ask what was actually decided and for whom. This three-part check prevents an allegation from being presented as a judgment, a regulatory designation from being mistaken for a monopoly verdict, or one patent petition from being treated as the end of all Apple patent litigation.
