Using an AI voice clone safely means clearing several separate questions: whether you have permission to reproduce the speaker’s vocal identity, rights to use the source recording, copyright in any human-created material in the output, and any applicable disclosure duties. Permission to use an audio file does not automatically authorize cloning the person who speaks in it, and labeling a synthetic voice does not make an unauthorized use lawful.
Four different rights questions can apply to one voice clone

Can someone clone your voice without permission?
There is no single comprehensive U.S. federal rule in the cited sources that resolves every unauthorized voice replica. The U.S. Copyright Office’s July 31, 2024 report on digital replicas treated them as a distinct policy issue and recommended federal legislation. That recommendation is not itself a general permission rule. State laws and contracts may matter, but the cited material does not provide a state-by-state survey; the result can depend on where the people and project are connected and what the recording or other agreements say.

What written permission should cover
Make the authorization specific enough that both sides can identify what was approved. As a practical risk-control checklist—not a claim that every listed term is legally required everywhere—record:
- The person and voice material covered, and who is authorized to grant permission.
- The project, purpose, media, territory, and duration.
- Whether edits, new scripts, translations, or other derivative versions are allowed.
- Compensation and any accounting terms.
- Whether the permission can be sublicensed, and to whom.
- What happens to the model, source recordings, and existing materials when the permission or project ends.
If a performer is represented by a union, agent, estate, or other rights holder, verify that the signer has authority for the proposed use. For a deceased performer, rights and authority may depend on the applicable law and agreements.
What union agreements illustrate
SAG-AFTRA’s Sound Recordings Code FAQ describes safeguards for its covered sound-recording context: consent before release, in writing and separately from the royalty agreement or performer contract, using clear and conspicuous language that gives reasonably specific intended-use details. The FAQ says that, if consent was not obtained during the artist’s life, consent for a deceased artist must come from the representative or estate. These are terms for covered agreements, not a universal statutory standard for every creator.

SAG-AFTRA’s August 14, 2024 announcement about Narrativ, a platform for licensing performers’ digital voice replicas for digital audio ads, describes a negotiated model involving informed consent, compensation, individual control, and additional safeguards. It is an example of how a licensing arrangement can be structured, not evidence that the service is currently available to every user or that its terms apply to unrelated projects.
Who owns an AI-generated voice recording?
There is no sound general answer based solely on who typed the prompt or who operates the voice tool. Consider separately who controls the source recording, what the tool’s terms permit, whether the material includes another person’s performance or authored work, and what human expression went into the final production.
Copyright in AI-assisted output
In its January 29, 2025 summary on copyrightability, the U.S. Copyright Office said copyright may protect output when a human author determines sufficient expressive elements. Its examples include human-authored material that is perceptible in the result, or human creative arrangement or modification. Merely entering prompts is not enough by itself. AI assistance—or including AI-generated material in a larger human-created work—does not automatically prevent copyright in the human-authored elements.

The Copyright Office’s overview lists Part 1 on digital replicas as issued July 31, 2024, and Part 2 on copyrightability as issued January 29, 2025. It also reported that a pre-publication Part 3 on training was released May 9, 2025, with the final Part 3 still forthcoming on that page. Those reports address different questions; they do not resolve every dispute about training material, a particular recording, or state publicity rights.
When must a creator disclose that audio is synthetic?
Disclosure rules depend on the jurisdiction and on the role the creator plays. The EU and California provisions described below impose certain transparency obligations on covered providers or deployers; they do not grant permission to clone a person’s voice.
European Union
Under the European Commission’s Article 50 service-page description, providers of systems that generate synthetic audio and other media have machine-readable marking and detectability duties, subject to exceptions. Deployers must disclose certain qualifying deepfakes. The scope depends on the actor, content, and applicable exceptions, so do not infer that every creator must label every synthetic voice clip.

The Commission’s general-purpose AI guidance separately says covered model providers must establish a copyright policy that respects EU copyright and rights reservations, and publish a sufficiently detailed summary of training content. It says those obligations applied from August 2, 2025, with full compliance enforcement from August 2, 2026. These are provider obligations, not a blanket end-user rule authorizing or forbidding a particular voice clone. The Article 50 page describes itself as based on the consolidated AI Act as of July 27, 2026; check the applicable current text and guidance for a specific project.
California
California’s AI Transparency Act, SB 942, became operative January 1, 2026. The law defines a covered provider to include a provider whose publicly accessible generative AI system has more than one million monthly visitors or users. It requires covered providers to offer a no-cost AI detection tool and provide manifest disclosure options, and to include latent disclosure in covered AI-generated audio and other media, subject to technical-feasibility and other statutory terms. This is a covered-provider transparency law, not a general voice-cloning consent law.

Reduce misuse and keep a clear record
The Federal Trade Commission identifies three intervention points for voice-cloning countermeasures: prevention or authentication before a clone is used, real-time detection or monitoring, and post-use evaluation. It discusses measures such as watermarking and authentication while emphasizing implementation challenges and that no single solution addresses the problem. The FTC also states that there is no AI exemption from laws already on the books.

- Confirm sensitive approvals through an authenticated channel instead of relying on a voice message alone.
- Limit access to source audio and keep a record of where it came from and how it may be used.
- Preserve written permissions, contract terms, and project versions alongside the final audio.
- Use provenance or watermarking features where appropriate, but do not treat them as proof of consent or a guarantee that listeners can detect a clone.
- Label synthetic performances when a rule applies or when needed to avoid misleading the audience.
These measures reduce practical risks; they do not guarantee that a clone is authentic, detectable, or lawful.
Questions to ask before choosing a voice-cloning service
Read the terms for the exact service, account, and project rather than relying on broad marketing language. Check whether the arrangement actually covers your intended use and ask:
