For Wyoming workers covered by both state and federal minimum-wage laws, the federal rate is higher and applies. Federal overtime rules also generally require covered, nonexempt employees to receive extra pay after 40 hours in a workweek. Youth work has additional state and federal limits, and the rules depend on the minor’s age, job and schedule.
What is the minimum wage in Wyoming?
The U.S. Department of Labor’s state minimum-wage table, updated in 2026, lists Wyoming’s state rate alongside the federal rate. When both laws apply, an employee is entitled to the higher minimum wage. That means the federal rate governs covered Wyoming employment subject to both laws; coverage and statutory exemptions still matter.

| Rate | Amount | How it applies |
|---|---|---|
| Wyoming state minimum wage | $5.15 per hour | Rate listed by the U.S. Department of Labor in its 2026 state table. |
| Federal minimum wage | $7.25 per hour | Rate listed by the U.S. Department of Labor in its 2026 state table; it is the higher rate for covered employment subject to both laws. |
The Department of Labor describes its state table as informational and recommends checking with the relevant state labor office for official information. A rate comparison alone does not determine whether a particular worker or employer is covered.
Does Wyoming require overtime after 40 hours?
Under the federal Fair Labor Standards Act (FLSA), covered, nonexempt employees generally must receive overtime pay of at least one and one-half times their regular rate for hours worked over 40 in a workweek. The U.S. Department of Labor’s current FLSA guidance defines a workweek as a fixed, regularly recurring period of 168 hours. An employer cannot change that calculation just by choosing a different pay period.

Hours alone do not establish eligibility: the FLSA has coverage rules, exemptions and special provisions. Being paid a salary, by itself, does not establish that a worker is exempt. The federal rules also do not require extra pay solely because work falls on a weekend, holiday or regular day of rest when the employee has not exceeded the overtime threshold.
What other employment rules does the FLSA cover?
The FLSA addresses minimum wage, overtime, employer recordkeeping and youth employment standards. Its requirements depend on the job and applicable coverage provisions, so a general guide cannot determine whether a particular worker or employer is covered.
The U.S. Department of Labor says the FLSA does not itself require severance pay, vacation or sick leave. That statement is limited to the federal law: it does not resolve whether another state or local law, an employment agreement or an employer policy provides a benefit.
How late can a minor work in Wyoming?
A U.S. Department of Labor comparison of selected state standards for non-farm employment, marked as of July 15, 2025, reports that Wyoming limits minors to eight hours of work during any 12-hour period. It lists nighttime restrictions from 10 p.m. to 5 a.m., with exceptions for the night before a non-school day and for minors who are not enrolled in school.
Those figures summarize selected Wyoming rules; they are not a complete schedule rule for every young worker. Federal child-labor protections also apply where relevant, and the Department of Labor cautions that federal law governs when a state rule is less protective. Before assigning a minor a shift or job, check the current federal and state rules that apply to the worker’s age, occupation, school calendar and any hazardous duties.
Where can you verify a Wyoming labor-law question?
For a wage or overtime question, start with current U.S. Department of Labor guidance and check whether the worker and employer fall within the relevant federal rules. The Department’s state minimum-wage table directs readers to the relevant state labor office for official state information.

An unsigned 2023 Department of Labor memorandum identifies the Wyoming Department of Workforce Services as responsible for enforcing certain state minimum-wage, recordkeeping and wage-agreement laws. Because that memorandum is unsigned and older, it is only a lead to the agency—not confirmation of current contacts, filing forms, deadlines or procedures. Verify those details directly with the state before taking action.

The sources summarized here do not establish current Wyoming-specific requirements for final-pay deadlines, wage deductions, meal or rest breaks, paid leave or required notices. They also do not provide current claim contacts or procedures for other employment matters. For any of those issues, consult current Wyoming statutes or official state guidance rather than relying on a general federal rule or an assumed workplace practice.
