WordPress sites can expose the same access barriers found across the web, and those barriers may prompt ADA complaints, demand letters, or litigation when they prevent or materially impede disabled people from using a service or completing a task. There is no representative 2026 dataset here ranking WordPress defects behind lawsuits, and a scan score cannot tell you whether visitors can use your site’s real journeys.

Can a WordPress site be sued for accessibility?

Yes. A website’s operator may face an ADA complaint or lawsuit if people with disabilities cannot access the services, programs, goods, or activities offered through it. The legal question is not whether a site runs WordPress, but who operates it, what it offers, where it operates, and what the facts show about access.

The Justice Department says it has consistently taken the position since 1996 that ADA requirements apply to web content. Its guidance discusses Title II duties for state and local government services, programs, and activities—including those provided online—and Title III duties for businesses open to the public. The guidance is informal and nonbinding; it also says businesses and public entities have flexibility in how they ensure accessible online offerings. Read the DOJ’s ADA web guidance.

Situation What the ADA framework covers Technical rule and date
State or local government entity covered by Title II Access to the entity’s services, programs, and activities, including online content and mobile applications. The DOJ rule specifies WCAG 2.1 Level AA. Following an April 2026 interim final rule, the DOJ implementation page lists April 26, 2027 for entities serving populations of 50,000 or more, and April 26, 2028 for entities serving populations under 50,000 and special district governments. See the DOJ Title II implementation resource.
Business open to the public Title III concerns full and equal enjoyment of the business’s goods, services, facilities, privileges, advantages, or accommodations. The DOJ’s general web guidance does not set one detailed web-specific technical standard or a universal compliance deadline for every private business.

The Title II dates are not deadlines for every private WordPress site. The Justice Department’s general guidance says it has not issued detailed web-specific standards for businesses; that is distinct from the WCAG 2.1 Level AA requirement in the Title II rule for covered public entities.

What does “getting sites sued” mean in 2026?

A lawsuit’s allegations are not a court’s findings. A proposed settlement is not a final judgment. For example, in a February 2, 2026 statement about Alcazar v. Fashion Nova Inc., the DOJ described plaintiffs’ allegations that the apparel retailer’s site denied blind users full and equal access. The Department objected to a proposed settlement because, in its view, the injunction’s general accessibility promise lacked a confirmation or enforcement mechanism and did not ensure concrete steps. The release said the case was pending and still required district-court approval; it was not a finding against Fashion Nova and was not identified as a WordPress case. Read the DOJ’s statement.

Separate industry reporting gives a sense of the broader litigation environment, not a WordPress-specific count. UsableNet’s 2024 report counted more than 4,000 digital-property ADA lawsuits: 1,600 state-court and 2,400 federal-court filings. It also reported 961 lawsuits against companies that had a previous digital ADA lawsuit. These are UsableNet’s figures, not government statistics; they do not identify WordPress defendants, establish what barriers were involved, or predict a 2026 filing total. Which WordPress accessibility issues should you inspect first?

The following is a practical inspection map based on WCAG’s scope and DOJ descriptions of access barriers—not a ranking of defects that caused 2026 lawsuits. Prioritize barriers that block a person from finding information or completing an important task.

Images, icons, and other non-text content

Check whether meaningful images and icons have text alternatives that convey their purpose. Decorative images should not create confusing or repetitive screen-reader output. A product image, for example, may need an alternative that communicates useful product information rather than a filename or generic label.

Keyboard operation and visible focus

Try the full user journey without a mouse. Test menus, dialogs, search, filters, account functions, cart, and checkout. Confirm that keyboard focus is visible, moves in a sensible order, and is not trapped or lost—especially when a menu or modal opens and closes.

Forms, instructions, and errors

Make sure fields have programmatic labels and that instructions are available where needed. When a submission fails, identify the error clearly and make it possible to understand and correct the problem before trying again. Test whether a visitor can successfully complete registration, contact, booking, or purchase flows.

Video and audio

Check that videos have captions and that other alternatives are provided where needed. The DOJ’s examples of Title III matters include an agreement addressing online video courses that lacked captions and were inaccessible to deaf users. That example illustrates an access issue; it does not show that every WordPress site with video has the same defect.

Structure, contrast, resizing, and mobile use

Review heading structure, page landmarks, text resizing, contrast, reflow, and mobile behavior against the applicable WCAG criteria. Content should retain a usable structure when a visitor changes text size or views the site on a narrow screen.

Documents and embedded services

Test PDFs and other downloads, as well as payment tools, calendars, booking widgets, maps, and third-party forms that are part of the service offered. A vendor-built interface can still be part of the experience an entity provides. For public entities, the DOJ notes that material posted by the government or its contractor generally is not excluded merely because an outside vendor created it; rule exceptions are fact-specific.

WordPress themes, plugins, and updates

Reassess after changing a theme, block, page builder, plugin, checkout, or embedded widget. The cited guidance does not establish that any particular WordPress theme or plugin is inherently compliant or noncompliant. A plugin can affect the delivered experience, but the platform itself is not a legal cause, and installing an accessibility plugin does not by itself make a site accessible.

Which WCAG version matters?

WCAG organizes accessibility guidance around four principles: content should be perceivable, operable, understandable, and robust. Its testable success criteria are grouped into conformance levels A, AA, and AAA. WCAG 2.1 was published in 2018 and WCAG 2.2 in 2023. W3C’s overview, updated September 17, 2026, describes WCAG 2.2 as the latest version, says it does not deprecate or supersede WCAG 2.1, and encourages use of the latest version. A page conforming to 2.2 also conforms to 2.1 and 2.0. See W3C’s WCAG 2 overview.

For covered public entities, the DOJ Title II rule specifies WCAG 2.1 Level AA. WCAG 2.2 can be a newer reference for accessibility work, but its publication does not turn WCAG 2.2 AA into a universal ADA deadline or technical requirement for all private businesses.

How to assess and fix barriers on a WordPress site

Use a repeatable process focused on real tasks, not only page-level scores. Automated tools can flag some problems, but they cannot establish on their own that a person can complete the full journey.

  1. Inventory important journeys. Identify how visitors find key information, register, book, contact the organization, log in, purchase, and access essential documents.
  2. Identify the applicable requirements. Determine whether the operator is subject to Title II, Title III, or other relevant requirements, taking jurisdiction and circumstances into account. Public entities should track the Title II rule and current implementation date; private businesses should not assume those dates apply to them.
  3. Evaluate representative pages and templates. Check relevant WCAG criteria across the site’s common layouts and task flows. Use automated checks to find some issues, then add manual keyboard testing and assistive-technology evaluation of actual tasks.
  4. Correct the source of each barrier. Depending on the issue, changes may be needed in content, theme code, reusable components, plugin configuration, documents, or third-party integrations.
  5. Retest after fixes and significant changes. Repeat the important user journeys and check that corrections work in the rendered site. Reassess after substantial WordPress updates or changes to themes, plugins, page builders, or embedded services.
  6. Keep a dated remediation record. Record identified issues, who owns each correction, retest results, and unresolved barriers. Offer a practical way for visitors to report access problems and respond to the individual need.

An overlay, accessibility statement, certification, or one-time fix is not a substitute for accessible operation or a guarantee against a claim. The DOJ’s Fashion Nova statement also illustrates its concern that a general promise of accessibility may be weak relief when it lacks concrete work and a way to confirm or enforce it. For advice about a demand letter or legal claim, consult qualified counsel; this article is not legal advice.
