There is no separate federal Form 1099-K threshold for AI agents in the IRS guidance available as of October 2026. Whether a form is required depends on the payment rail and the roles of the organizations that process and settle the transaction—not simply on whether software initiated it. For third-party payment networks, the current federal test generally requires both more than $20,000 in reportable payments to a payee and more than 200 transactions in the calendar year. Payment-card transactions follow a different reporting rule.
What does Form 1099-K report?
Form 1099-K is an information return for certain payment-card and third-party-network transactions. A payment settlement entity (PSE) files it for reportable transactions and furnishes it to the payee. The IRS describes a PSE as including a merchant-acquiring entity or a third-party settlement organization (TPSO). The form reports gross payment amounts; it is not a calculation of the recipient’s taxable profit or final tax bill. The IRS’s Form 1099-K overview explains the covered payment types.

What is the current federal reporting threshold?
Third-party payment networks
For a TPSO, the federal reporting exception applies unless reportable payments to a payee exceed both $20,000 and 200 transactions in the calendar year. The tests are conjunctive: exceeding either figure alone is not enough to meet this federal threshold. The IRS said the One Big Beautiful Bill retroactively restored this rule. The IRS’s October 23, 2025 announcement and FAQ give the current threshold details.

Do not apply the TPSO threshold to payment-card transactions. The IRS says merchant-acquiring entities do not use that de minimis threshold for card reporting. The reporting path therefore depends on how a transaction was paid and settled, not just on whether it looks like an online sale. See the IRS FAQ for third-party filers and its Form 1099-K overview.

Why some sources still mention $600
The American Rescue Plan Act lowered the statutory TPSO threshold to $600 without a transaction-count condition in 2021. IRS transition guidance delayed implementation, and temporary transition amounts followed. That history helps explain conflicting articles and expectations, but the $600 figure is not the current federal TPSO threshold described by the IRS after the 2025 restoration. See the IRS Internal Revenue Bulletin for 2024 and 26 U.S.C. § 6050W.
Does an AI agent make the payment, or receive the money?
Those are different situations. A software agent that buys a product for its user has not, by making the purchase, shown that the user received payment proceeds. A 1099-K question is more likely to arise when an agent helps sell goods or services, collect marketplace proceeds, or route money to a person or business. The relevant payee is not automatically the agent: the payment and settlement arrangement must establish who receives the proceeds and which entities have reporting responsibilities.

Settlement roles matter more than the interface
The IRS identifies filing responsibility by reference to the entity with the contractual payment obligation and/or the entity that submits instructions to transfer funds. Under the IRS’s described rule, an electronic payment facilitator that makes settlement payments for a PSE files in the PSE’s place. A marketplace, payment facilitator, merchant acquirer, or other intermediary may be involved, so a new agent-mediated checkout screen alone does not identify the filer. The IRS third-party-filer FAQ explains these roles.
How common cases differ
| Situation | What the IRS rule turns on | What to establish |
|---|---|---|
| An agent buys something for its user | The purchase alone does not establish that the user received payment proceeds. | Whether the transaction also involved a payment to the user, rather than an outgoing purchase. |
| An agent helps sell goods or services through a payment network | The TPSO test applies if the transaction is settled through a third-party network by a TPSO; the federal threshold requires both amounts to be exceeded. | The payee, reportable payments, transaction count, and entity settling the network transactions. |
| An agent helps sell through payment-card processing | Merchant-acquiring entities do not use the TPSO de minimis threshold for payment-card reporting. | Whether the transaction is a payment-card transaction and which entity is the merchant acquirer. |
| An agent routes proceeds through a custodial or on-chain arrangement | The IRS’s definitions depend on settlement roles and obligations; a wallet, protocol, agent, or marketplace is not automatically a TPSO. | The contract, payment flow, recipient of proceeds, and any entity responsible for settlement. |
These are applications of general IRS guidance, not agent-specific determinations. For a layered arrangement, contracts and actual payment flows matter more than the product’s label.

Does a 1099-K mean every reported dollar is taxable income?
No. The form reports gross payments, which may not match net earnings after fees, refunds, credits, or other adjustments. The recipient should reconcile the form with transaction records and determine the tax character of each receipt. The IRS says: “No matter the amount of reported payments, if you receive payments for selling goods or services, you must report all income on your tax return.” That guidance appears on the IRS page Understanding your Form 1099-K.
The reverse is also important: not receiving a 1099-K does not by itself make income nontaxable. The reporting threshold determines when a form is required under the applicable rule; it is not a tax-free allowance. The IRS discusses what to do with a received form in its FAQ for recipients.

What records should sellers and businesses keep?
Keep enough detail to connect reported gross payments to the money actually received and to the underlying sales. Useful records include:
- Processor, marketplace, and payment-account statements, including which entity handled settlement.
- Transaction-level ledgers showing dates, amounts, payment types, and the person or business receiving proceeds.
- Fees, refunds, credits, and other adjustments that explain differences between gross reporting and net deposits.
- Contracts or account terms that clarify which party has the payment obligation and how funds are transferred.
When a 1099-K does not match those records, use the transaction detail to identify the difference rather than treating the form’s gross total as profit. The IRS’s Form 1099-K guidance advises recipients to use the form alongside their other tax records.

What remains unsettled for agent-mediated payments?
IRS materials establish general rules for payment-card and third-party-network reporting, but do not announce a dedicated agent-specific threshold or resolve every unusual delegated or on-chain payment flow. Visa’s 2026 article reports roughly $15.0 million in adjusted volume across 109.6 million transactions since May 2025 for the particular on-chain payment activity it summarizes. Those figures describe that activity, not all agent payments, U.S. taxable income, or 1099-K reportable proceeds. Visa’s article is an industry account of developing payment activity, not tax authority.
For any specific transaction, determine the payment type, recipient, settlement entities, and tax character from the contracts and records. Federal Form 1099-K rules are not a substitute for checking state reporting requirements or other tax rules. For a complex business or return, consult current IRS guidance or a qualified tax professional.
