A hosting service may disable the project under the Digital Millennium Copyright Act (DMCA) or its own rules before any court decides whether infringement occurred. “Browser port” is a delivery method, not a legal category.
This is a U.S.-focused explanation. Other countries use different copyright exceptions, notice systems and anti-circumvention rules. Whether a particular port is lawful depends on its code, assets, access method, permissions, purpose, distribution model and jurisdiction.

What a “browser port” actually describes
People use browser port to mean several technically different projects:
- New code that imitates a game’s mechanics and runs in JavaScript, WebAssembly or another browser technology.
- An adaptation that includes copied artwork, music, characters, dialogue, level data or other game expression.
- A copy of the original game running through an emulator in a browser.
- A browser-hosted game file that visitors can download or play remotely.
The legal questions are therefore concrete: What was copied or adapted? Was an original game file delivered? Is the work publicly performed or displayed? Were technical controls bypassed? Does the creator have a licence? Is the project ordinary entertainment, criticism, teaching, research or preservation? Is it offered commercially or as a substitute for an authorized release?

Rewriting the program code can change the analysis, but it does not answer all of those questions. A clean-room implementation is not the same thing as uploading a ROM, and no general rule says that every newly written port is either lawful or infringing.
Why a host can remove a fan project
Copyright covers more than source code
Under U.S. copyright law, owners generally control reproduction, preparation of derivative works, distribution, and certain public-performance and public-display rights, subject to statutory limits. A commercial game can contain several separately relevant kinds of expression: program code, audiovisual presentation, music, artwork and character depictions. Nintendo’s intellectual-property FAQ identifies those categories in its products; that is Nintendo’s description of its rights, not a court’s ruling that every element of every game receives identical protection.
A project may therefore raise different issues at once. Copying original code is one concern. Recreating a game with copied sprites and music is another. Hosting a complete game file for public play can implicate reproduction and distribution, while streaming or running it for visitors can implicate public performance or display. The browser does not erase those acts; it only changes how users receive them.

Section 512 of the DMCA gives qualifying online service providers conditional protection from monetary liability if they follow specified procedures. When a provider receives a compliant notice from a copyright owner or authorized agent, it may remove or disable access to the identified material. Services also apply their own terms and may act under internal enforcement policies, even when a notice is disputed.
The result is often immediate unavailability while the underlying legal question remains unresolved. A takedown demonstrates that access was disabled; it does not, by itself, prove that a court found infringement.
An uploader can submit a counter-notification stating that the removal was a mistake or misidentification and consenting to the jurisdiction required by the statute. The Copyright Office explains that, after forwarding a valid counter-notice to the complaining party, a provider generally may restore the material after 10 to 14 business days unless the rightsholder reports filing a court action seeking an order to restrain the material. This is a procedural opportunity, not a guaranteed defense or a promise that the project will return.

A reported example: the 2015 browser version of Super Mario 64
TIME reported on March 31, 2015 that Nintendo sent a takedown notice to the server hosting Royston Ross’s browser version of Super Mario 64. The notice identified an audiovisual work, computer program, music and fictional-character depictions. The report documents a notice and removal; it does not establish a judicial ruling, and it does not determine the status of every fan-made browser port.

Rights-holder policies add another layer
Nintendo’s published intellectual-property policy says that it removes content that appears to infringe intellectual-property rights “in appropriate circumstances and at our sole discretion,” referring to the U.S. DMCA, European Union law and other applicable law. That statement describes Nintendo’s enforcement policy. It is not the legal standard applied in every country and is not a neutral adjudication of a particular project.
Does fair use cover a free fan game?
Not automatically. The Copyright Office describes criticism, comment, news reporting, teaching, scholarship and research as examples of purposes that may qualify for fair use. Section 107 directs decision-makers to weigh four factors:
- Purpose and character: whether the use is commercial or nonprofit and whether it adds new expression, meaning or purpose.
- Nature of the copyrighted work: highly creative games generally receive stronger protection than factual material.
- Amount and substantiality: how much was taken and whether the portion used is qualitatively central.
- Effect on the potential market: whether the use substitutes for the original or harms a market the copyright owner could reasonably exploit.
The statute calls these factors part of an inquiry into “any particular case.” They are not a scorecard in which one favorable answer guarantees fair use. A noncommercial or free project may still use a highly expressive game, reproduce substantial portions of it and offer a substitute way to play. Conversely, a project built for criticism, teaching or scholarship may present a different analysis if the amount and presentation are genuinely suited to that purpose.
Only a court can finally resolve a contested fair-use claim. A disclaimer, a fan label, an educational description or the absence of a paywall does not create permission by itself.

New implementation code is important evidence, but it is not a complete answer. The U.S. Copyright Office’s Compendium gives writing new computer code for a published videogame so it can run on another platform as an example in its discussion of derivative computer programs. That indicates that platform conversion can raise derivative-work questions even where the replacement code is original.

The rest of the project still matters:
- Assets: Original or licensed art and music present a different issue from copied sprites, sound effects, textures, dialogue or level files.
- Game data: Recreating rules and general ideas is different from distributing a copied ROM, executable, asset archive or other protected expression.
- Branding and characters: Names, logos and fictional-character depictions can create additional intellectual-property concerns.
- Distribution: A private local experiment differs from a public site that supplies files or lets thousands of visitors play.
- Permission: A licence or written authorization can change the rights analysis; attribution alone usually does not substitute for one.
Do not treat “all code was rewritten” as a legal safe harbor, but do not treat it as proof of infringement either. The exact assets, interfaces, purpose and permissions must be examined.
Are emulators illegal, or is it the game file?
“Emulators are illegal” is an overbroad statement. Copyright infringement and anti-circumvention are separate legal questions.
Copyright and access controls are distinct
Section 1201 of the DMCA generally prohibits circumventing technological measures that control access to protected works, including software and videogames. A project could face an access-control allegation even when the copyright analysis is separately contested. Conversely, the existence of an emulator does not by itself answer whether the software, keys, firmware or game files being used were lawfully obtained or distributed.
Narrow U.S. preservation exemptions
Current U.S. regulations contain limited videogame exemptions. One permits certain lawful owners of complete games whose authentication server has ceased operation to access and modify those games for personal, local gameplay. A separate preservation route applies to eligible libraries, archives and museums under specified noncommercial and access restrictions. Other game-preservation exemptions similarly limit access to qualifying institutions and their premises.
These provisions are not a general licence to publish ROMs, keys or a browser-playable copy for the public. Conditions such as lawful acquisition, complete-game status, local rather than online play, noncommercial purpose, institutional eligibility and limits on distribution all matter. A project that falls outside one condition cannot simply rely on the existence of an exemption in the abstract.
What a recent emulator notice does—and does not—show
A Nintendo notice preserved in GitHub’s archive and dated September 30, 2026 alleges that identified repositories offer, link to or provide access to Switch emulators and alleges use of unauthorized keys and game copies to circumvent Nintendo’s technical measures. Those statements are allegations made in a notice. They are not independently established facts about every repository and are not a ruling about fan-made browser ports generally.

The notice illustrates why a rights holder may combine copyright theories with anti-circumvention allegations when asking a platform to remove material. A platform can act on that request under its process even while the factual and legal merits remain disputed.

Is a browser port legal if you own the original game?
Buying a physical cartridge, disc or digital download normally gives you ownership of that copy or a licence to use it under the applicable terms. It does not transfer the copyright in the game or automatically authorize public distribution, online hosting or sharing a browser-accessible copy.
Ownership can matter to a narrowly written statutory exception, such as certain preservation or local-access rules, but the conditions must be met precisely. The available U.S. rules do not establish a broad permission for an individual to upload a game, its keys or its files so that anyone can play online.
For a real project, separate the questions: how the owner acquired the copy, whether a complete game is involved, whether access controls were bypassed, where the files are stored, who can access them and whether the rightsholder granted permission. A purchase receipt alone cannot answer those questions.

Use the following as an issue-spotting checklist, not a legality score:
- Inventory every component. Identify implementation code, game data, artwork, music, dialogue, characters, logos, firmware, keys and downloadable files.
- Record the source. Mark each item as original, licensed, lawfully obtained, reverse-engineered, copied or unknown. Do not publish material whose provenance cannot be explained.
- Describe the delivery method. Distinguish private local use, a hosted demonstration, public streaming, downloadable files and a service that lets visitors play a complete game.
- Check technical measures. Determine whether authentication, encryption, platform checks or other controls were bypassed, and analyze that issue separately from copyright.
- Define the purpose. Explain whether the project is entertainment, criticism, teaching, scholarship, research or preservation, and use only the amount needed for that purpose.
- Assess market substitution. Ask whether the port replaces an authorized release, competes with a current product or affects a market the owner could reasonably serve.
- Confirm permission and territory. Keep licences, agreements and notices in writing, and remember that U.S. conclusions may not apply elsewhere.
- Plan for a notice. Preserve source records, identify a responsible contact and understand the platform’s appeal or counter-notice procedure before launch.
What to do after a takedown
If you agree the material should come down
Remove the identified files and links, stop mirrors that you control and review whether cached copies or build artifacts remain publicly accessible. Keep a copy of the notice and your project records so you can understand what triggered the complaint.
If you believe the notice is mistaken
Read the notice carefully: it should identify the work, the allegedly infringing material and the complaining party’s required statements. Compare the claim with your actual code and assets. If you submit a counter-notice, understand that it is a formal legal communication, may disclose your contact information and can lead to restoration only under the statutory timetable if no court action is reported. Consider advice from a qualified attorney before making factual or jurisdictional assertions.
If the platform acted under its own rules
A service may enforce terms that are broader than copyright law or may suspend an account while investigating. Follow the service’s appeal channel separately from any DMCA counter-notice. Winning an internal appeal does not settle the underlying copyright or anti-circumvention questions.
Common claims that are too broad

What the evidence cannot tell you
There is no reliable figure establishing how many fan-made browser ports are taken down, what percentage are lawful or how often projects in this category win fair-use defenses. The 10-to-14-business-day period is a procedural window, not a statistic about outcomes. For an unnamed project, no responsible source can give a definitive legal conclusion without examining its code, assets, access controls, permissions, distribution, purpose and location.

Does a DMCA takedown mean a court found infringement?
No. A compliant notice can lead a service provider to disable access under Section 512 before any court decides the merits. A counter-notice starts a statutory process; it does not guarantee restoration or establish fair use.
Can a preservation project put an old game online for everyone?
Not merely because it is old. U.S. preservation exemptions are narrowly conditioned and may require lawful acquisition, a complete game, noncommercial institutional activity, local access and restrictions on distribution. Public browser hosting may fall outside those conditions.
Are fan games always illegal?
No categorical rule applies. The result depends on what the project copies or adapts, whether it circumvents controls, its purpose and market effect, permissions, distribution method and jurisdiction.
The Bottom Line
A fan-made browser port is judged by what it uses and how it is delivered, not by the word “browser.” In the United States, copied expression, derivative adaptations, public distribution and circumvention can each create separate problems; fair use is a fact-specific defense, and a host’s takedown is not a court judgment.
