In the United States, a rule effective May 12, 2025, requires covered lodging sellers to show known, calculable mandatory charges in the upfront total—but taxes and optional extras can still be disclosed separately before payment.
Why a hotel search is not like adding an item to a cart
A typical shopping cart totals products whose identity and quantity are already set. A hotel search is a quote for a future service, and the quote depends on details that can change the offer: property, check-in and check-out dates, room type, guest count, availability, and booking channel. A room on one set of dates is not the same offer as a room on another, even at the same hotel.

Availability is limited, and booking sites can present different prices or terms for a comparable stay. A study by Debashrita Mohapatra, Debi Prasad Mohapatra, and Ram Sewak Dubey, published in 2023, reported an average 9% variation around mean hotel-room prices across platforms. The authors analyzed selected one-night stays for two guests in one room at 200 popular London hotels, using prices observed for November 2017 stays. Prices tended to converge as check-in approached, but differences remained. This is a historical London sample, not a current global average or evidence that one booking channel is always cheaper. The offer may not match
Before treating a changed price as a fee, check whether the search and checkout still refer to the same dates, room, guest count, cancellation conditions, and payment terms. A change in any of these can mean you are looking at a different offer. Availability and price can also vary by booking channel and when you check.

The price may include different charges
A displayed nightly rate may not represent the full cost of the stay. Mandatory fees, government charges, and optional goods or services may appear at different points in the booking process. Separating a mandatory resort fee from the room rate can make it harder to compare offers: in a January 2017 economic analysis, FTC staff concluded that showing such a fee separately without first showing the total is likely to increase consumers’ search and cognitive costs. That analysis concerns disclosure practices; it is not a measurement of current booking-site behavior. Read the FTC economic analysis.
What the U.S. lodging-fee rule requires
The FTC Rule on Unfair or Deceptive Fees took effect May 12, 2025. Its short-term lodging provisions apply to businesses that offer, display, or advertise lodging prices, including hotels, vacation rentals, online platforms, resellers, and travel agents. When a covered business displays a lodging price, the upfront total must include charges it knows and can calculate, including mandatory charges required as part of the transaction. The rule governs price disclosure; it does not prohibit hotels from charging fees. See the FTC staff FAQ.

The FTC staff guide gives this example: “A resort charges a nightly rate of $199, plus a mandatory resort fee of $39 per day. The required resort fee must be included in the total price.” It is an explanatory example, not a report of a current hotel’s rate. The FAQ describes FTC staff’s view and says it is not binding on the Commission.
What may be shown separately
Government charges and genuinely optional goods or services may be excluded from the upfront total under the FTC staff guide. They must still be disclosed before payment, with their nature, purpose, and amount; the final amount due must be shown before the business asks for payment. For example, an optional trip-protection plan can be presented separately. A required resort fee—or a fee automatically billed as part of the stay—is not optional merely because it appears as a separate line.

How one platform documents its U.S. display
Booking.com’s Demand API documentation says its U.S. traveller display includes mandatory resort, service, and destination fees in the total price, while certain government-imposed taxes and optional services may be disclosed separately before payment. This is an implementation example from Booking.com’s documentation, not proof that every platform presents every offer identically. See the Booking.com developer guidance.

How to compare two hotel offers fairly
Compare the same stay and the full cost, rather than relying on the first nightly rate shown. Use this checklist for each offer:

- Compare the total for the entire stay, including known mandatory fees.
- Check government taxes and charges separately, including whether the amount is estimated or payable at the property.
- Look for optional extras and confirm whether they were selected or preselected.
- Match cancellation and refund conditions, payment timing, and other booking terms.
- Note the booking channel and when you checked; availability and displayed offers can differ.
The FTC rule supports upfront disclosure of known mandatory charges and disclosure of excluded charges before payment; the exact total and terms remain specific to the offer. A comparison site can help you locate alternatives, but the evidence here does not establish that any channel will always have the lowest total.
