The connection is broader: the Irish case and the rules governing App Store fees and services are separate examples of EU scrutiny of Apple. Recent changes to developer fees, payment options and app distribution stem from separate competition and Digital Markets Act (DMA) proceedings—not from the Irish tax ruling.
What the Irish tax case decided
On 10 September 2024, the Court of Justice of the European Union (CJEU) set aside an earlier General Court judgment and gave final judgment in the case. It upheld the European Commission’s finding that Ireland had granted Apple unlawful state aid through tax rulings and had to recover it. The Commission’s 2016 recovery decision concerned €13 billion; that figure is historical state aid, not an App Store fee, a current annual tax bill or an amount shown to have changed consumer prices. The CJEU’s case summary describes the rulings as concerning Apple Sales International and Apple Operations Europe, and the determination of the tax base for their Irish branches.

The legal dispute centered on how profits associated with intellectual-property licences were attributed when calculating the Irish branches’ taxable profits. It was a state-aid case about selective tax treatment—not a ruling on App Store commissions, developer contracts or prices paid by app users. The Court’s summary explains the case and its outcome.
What governs App Store fees and services instead
App Store business terms are addressed through separate EU competition and DMA proceedings, alongside Apple’s developer agreements. Apple says it has introduced EU options that include alternative payment processing, alternative app marketplaces, distribution directly from a developer’s website and alternative browser engines. These choices can affect how an app is distributed or paid for, and which developer terms apply. They do not follow from the Irish tax judgment. Apple’s EU DMA developer guidance describes the options and related terms.

On 18 August 2026, Apple announced that its new terms replace the Core Technology Fee with a 5% Core Technology Commission on digital transactions for apps distributed outside the App Store. This is a specified term in Apple’s announcement, not a universal App Store commission. Which terms apply depends on the distribution model, the developer’s agreement and the live rules; check Apple’s current EU developer terms before relying on a rate or effective date.
How separate EU proceedings shape the context
DMA enforcement and alternative distribution
The Commission’s DMA enforcement has addressed Apple’s rules for developers and distribution options. In June 2024, it said Apple’s then-current rules impeded steering and opened a non-compliance procedure concerning the Core Technology Fee and other terms. In April 2025, it reported preliminary concerns about terms for alternative distribution, including that the fee could discourage developers from using those channels. These were DMA matters, distinct from the Irish state-aid judgment. See the Commission’s June 2024 announcement and April 2025 update.

In explaining the DMA’s steering rationale in June 2024, then-competition-policy Executive Vice-President Margrethe Vestager said: “Steering is key to ensure that app developers are less dependent on gatekeepers’ app stores and for consumers to be aware of better offers.” The statement was about steering and competition, not Apple’s tax treatment in Ireland. The Commission’s announcement provides the context.

A separate antitrust decision on music streaming
In 2024, the Commission fined Apple more than €1.8 billion in a separate competition case concerning anti-steering provisions affecting music-streaming services. The Commission said those restrictions may have led users to pay higher prices for music subscriptions. This decision offers context for how App Store rules can affect developers and consumers, but it is not the Irish tax case and does not establish that the tax ruling changed App Store fees. The Commission’s decision announcement describes the case.

Corporate tax and transaction taxes are different
The Irish case concerned the tax treatment of Apple group companies and the profits attributed to their Irish branches. A developer’s tax duties on individual app transactions are a different matter. Apple’s guidance says developers using alternative payment processing are responsible for collecting and remitting applicable taxes on those sales. It also says developers must report relevant transactions for commission calculations and collection. Those obligations relate to transactions and developer terms, not the historical corporate tax rulings. Apple outlines them in its EU developer guidance.

The documented link is regulatory context, not a demonstrated price effect: EU institutions have addressed Apple’s tax treatment, competition practices and DMA compliance in separate proceedings. The available figures—€13 billion in the 2016 state-aid recovery decision, more than €1.8 billion in the 2024 music-streaming fine and Apple’s announced 5% commission for specified transactions under its August 2026 terms—refer to different cases or rules. They cannot be combined to calculate an effect of the Irish tax case on app fees or prices. The sources cited here do not quantify such an effect.
