There is no universal answer. The service’s terms may say who owns or receives rights to an AI tool’s output, but that contract language does not decide whether copyright law protects the output. In the United States, the Copyright Office says a prompt alone is not enough: protection may apply when a human contributes expressive material or creatively arranges or modifies generated content.
Who owns what I write in an AI writing tool?
“Ownership” can mean two different things: the rights the service contract allocates between you and the provider, and whether copyright law protects a particular piece of writing. Check both. Contract terms vary by tool, account type, region, and date; copyrightability depends on the human contribution to the specific work.

A service’s ownership language is not a guarantee that the text is unique, copyrightable, free of third-party rights, or safe to publish without review.

Does the AI own my writing?
That depends on the provider’s terms, but “the AI” is not itself the whole legal question. A contract may allocate rights between you and the company that provides the service. Separately, copyright law determines whether the material qualifies for protection. A provider promising that you own output does not, by itself, establish that copyright exists in every generated sentence.

If the terms say I own the output, can I copyright it?
Not automatically. The U.S. Copyright Office’s January 29, 2025 summary of its AI report says output may be protected when a human author determines sufficient expressive elements. It identifies human-authored material perceptible in the output and creative arrangement or modification of generated material as possible examples. Merely supplying prompts is not enough on its own. AI assistance, or including AI-generated material in a larger human-created work, does not automatically prevent that larger work from being copyrightable. U.S. Copyright Office, January 29, 2025.
Copyright generally protects original expression fixed in a tangible medium, not facts, ideas, systems, or methods of operation as such. The expression of an idea may be protected even when the idea itself is not. U.S. Copyright Office copyright FAQ.

If protection matters, keep the human-authored source material and a record of substantial creative edits or arrangement. That is practical documentation, not a guarantee of copyright protection or registration. The Copyright Office’s January 2025 announcement said its report’s Part 3, on legal implications of training models on copyrighted works, was forthcoming at that time; it does not resolve that issue or later developments.
What do the cited provider terms say?
These are examples, not a complete, same-date comparison of every consumer and business plan. Read the current terms that apply to your account before relying on them.

Can the company use my draft to train its AI?
Check the data-use terms and account controls separately from the ownership clause. The cited OpenAI terms say content may be used to provide, maintain, develop, and improve services and offer a way to opt out of model training. The cited Anthropic terms concern customer content in the specified commercial services on Amazon Bedrock and say it is not used to train Anthropic models. These statements apply to different service contexts, so they should not be treated as a direct comparison of all plans.
Before entering unpublished work, client-confidential text, or workplace material, review the current data controls and terms for the account you are using. With an employer-managed account, check whether the organization can administer or access it, and follow workplace and client agreements. Provider terms do not override your separate confidentiality obligations.

What should I check before publishing AI-assisted writing?
- Confirm the applicable contract: identify the product, plan, account type, region, and current terms; do not assume a provider’s commercial terms cover its consumer service.
- Separate rights questions: look for terms on input rights, output allocation, similar or non-exclusive output, retention, and model-training controls.
- Keep track of human authorship: preserve source material and document substantial creative writing, selection, arrangement, or revision if copyright protection matters.
- Review the result: verify factual claims, check for similarity and third-party material, and do not assume provider ownership language makes the text accurate or safe to publish. The cited OpenAI terms warn that output can be inaccurate and should not be the sole source of factual information.
- Check other agreements: employer, client, confidentiality, or publication terms may impose obligations beyond the AI service’s own contract.
