In the United States, the answer depends on the service’s terms, what the user authorized, what the agent actually did, and the kind of dispute or harm involved. A platform’s contract may allocate responsibility between it and its user, but it does not automatically settle claims involving other people or every legal question.
What determines responsibility?
Start with the terms of the service the agent accessed and the permissions in force at the time. Then establish whether the user approved the agent and its specific actions, whether the agent stayed within the authority granted, and what happened as a result. A mistaken purchase, a disputed account access, and harm to a third party may raise different questions.

- Authorization: Did the service permit that agent, and did the user enable or approve it?
- Scope: What actions, accounts, spending limits, or other boundaries did the user grant?
- Conduct: Did the agent act within those boundaries, or take an unexpected or out-of-scope action?
- Claim and jurisdiction: Which terms and laws apply to the particular dispute?
Federal law recognizes that software can take action without a person reviewing every step, but that recognition does not itself determine whether a particular action binds a particular account holder.
What does U.S. law say about automated actions?
E-SIGN recognizes electronic agents, but does not decide every dispute
The federal E-SIGN Act defines an “electronic agent” as an automated means used independently to initiate an action or respond to electronic records or performances, in whole or in part, without review or action by an individual at the time. That definition describes a kind of automated activity; it is not a general AI-liability rule and does not automatically validate every contract, purchase, or other action an agent takes.

DOJ guidance on the CFAA is about federal prosecution
The U.S. Department of Justice’s Justice Manual says a federal prosecution under the Computer Fraud and Abuse Act (CFAA) should not be based solely on violating a public website’s terms of service. The manual separately discusses circumstances such as accessing someone else’s account or continuing to access an account after an authorizer expressly revokes permission. This is DOJ prosecutorial guidance: it does not erase contractual duties, decide every civil claim, or establish that all automated access is lawful.
The 2026 Amazon–Perplexity ruling has a limited procedural scope
On August 4, 2026, the Ninth Circuit vacated a preliminary injunction Amazon had sought against Perplexity and remanded the case. In considering whether Amazon was likely to succeed on CFAA and California Comprehensive Computer Data Access and Fraud Act (CDAFA) claims on the record before it, the panel said the user accessed Amazon with the assistant’s help. That preliminary-relief decision does not establish that users always bear responsibility, that agent developers never can, or how every account dispute should be resolved.

The opinion’s summary describes at least $5,000 in aggregated loss during a one-year period as an element for a CFAA claim. That is a threshold associated with the claim described in the opinion, not a statistic about AI-agent incidents or consumer losses.

| Service and terms | Agent authorization and attribution | User obligations described |
|---|---|---|
| Circle Agent Platform, terms dated May 11, 2026 | Circle says a responsible user must accept the terms before an agent accesses the platform. It attributes actions taken by an agent under the user’s authority to that user. Its terms state: “You agree that any action taken by an electronic agent you use or authorize is attributable to you and has the same legal effect as if performed directly by you.” | Circle places responsibility on the user for agents using the user’s credentials, directed or controlled by the user, or using access the user provided or enabled. The terms also address delegated agents. |
| Target Terms & Conditions | Target says only its own agents or third-party agents it expressly approves and authorizes may interact with its site. It treats actions within permissions approved by the user as user-authorized. | Target tells users to review activity, report suspected actions outside the approved scope, and revoke access when appropriate. It says it does not guarantee an agent will act exactly as intended. Target says: “Target will evaluate disputes involving an Approved Agent based on the permissions in effect at the time of the transaction, applicable account protections, relevant evidence of authorization, and applicable law.” |
| BILL Spend & Expense | BILL says an AI-capability action within authority granted by the user is attributed to the user and may be treated as binding as if the user acted directly. | BILL assigns users responsibility for defining and limiting authority, reviewing activity, and promptly reporting actions they did not intend or that exceed the authority granted. |
These terms can matter to a dispute between a user and a service, but they do not by themselves establish that an agent acted within its permissions or resolve every claim by a third party.
What to check before connecting an agent
- Confirm it is allowed. Check whether the service permits the agent you plan to use or requires a named, approved agent.
- Limit its authority. Grant only the accounts and actions needed for the task, with spending or other limits where available. Avoid ongoing access if a narrower permission will work.
- Look for confirmation controls. Find out whether you can require a person to approve purchases or other consequential actions before they occur.
- Check the audit trail. Determine whether the service records permissions, approvals, actions, and failures, and how you can retrieve those records.
- Know how to revoke access. Locate the revocation control and any steps the service says to take if the agent acts unexpectedly.
- Read dispute and account-protection terms. Check how the service handles disputed actions and what evidence it considers.
What to do if an agent acts unexpectedly
Secure the account and stop further access where possible, then preserve the evidence before it disappears or changes.

Account security helps, but does not answer the liability question
A FIDO2/WebAuthn security key can provide an additional sign-in control for compatible services. Yubico’s Security Key Series describes FIDO2/WebAuthn and U2F support, with USB and NFC options; compatibility depends on the account service. A key helps authenticate a user, but it does not define an agent’s authority, prevent every misuse of an already authenticated session, or determine who is legally responsible for an agent’s actions.
