That does not automatically make the same person eligible to apply for a permit or the right person to be named as permit holder. Those questions depend on the project, ownership documents, state rules and local building department requirements.
Start with who owns the property
Check the deed or other title record to identify the legal owner: an individual, co-owners, a trustee, or a business entity. The person who signs for the owner must have authority to bind that owner. For a trust, LLC, corporation or partnership, confirm that authority in the relevant documents rather than assuming that a resident, employee or family member may approve the work.

As one local example, Rancho Palos Verdes, California, describes documentation it uses to verify authority for trustees, executors, company officers, partners and managing members. Its process is local guidance, not a nationwide document standard. Rancho Palos Verdes Building & Safety Division FAQs.

Put the authorization in writing. Identify the property, the authorized person, the work covered and what that person may do—for example, approve a contract, submit a permit application or communicate with the building department. A verbal go-ahead may not meet an office’s requirements. West Covina, California, gives a local example requiring a notarized authorization letter for an owner’s agent; California Contractors State License Board materials also include an owner-agent authorization form. Neither example is a universal form or rule. West Covina: Who Can Pull a Building Permit? California Contractors State License Law & Reference Book, 2023 Edition.

Contract approval and permit authority are separate
A person may be able to arrange or sign for work without being eligible to file the permit application. Likewise, being permitted to apply does not settle who should be named permit holder. Ask the local building department who may apply for this project, what signatures and proof it requires, and who it expects to be listed as permit holder. Check state licensing requirements as well, particularly for regulated trade or structural work.
Local procedures illustrate why a national yes-or-no answer would be misleading. West Covina says owners, California-licensed contractors and agents for owners or contractors may pull a permit when they provide the required paperwork. Rancho Palos Verdes identifies owners, licensed contractors and authorized agents. These are examples from California cities, not rules that apply everywhere. Who should be the permit holder?
The permit holder is a role in the permit record, not simply another name for the person who owns the house or signed the contract. Arlington County, Virginia, recommends identifying the contractor performing the work as permit holder and warns that code enforcement against a contractor can become difficult when the owner is listed instead. Follow your jurisdiction’s instructions, and make sure the contract and permit application accurately identify who is doing the work and who will handle permit responsibilities. Arlington County Permit Authorization Affidavit.
Special cases that can change who must authorize the work
Renters and tenants
Living in a house does not by itself establish authority to approve substantial improvements or apply for a building permit. A tenant’s rights to request or arrange repairs under a lease or landlord-tenant law are a different question from authority to make improvements or file permits. West Covina says a tenant may not pull a permit there unless acting as an agent for the owner or contractor; that is a local example, not a universal tenant rule. Get the owner’s written authorization and check the lease and local permit requirements before proceeding. West Covina permit guidance.

Condominiums and shared property
A unit owner may not have unilateral authority over common areas, building exteriors or other property controlled by a homeowners association. Check the declaration, bylaws and association approval process, then confirm what the building department requires. Rancho Palos Verdes, for example, asks for HOA authorization and meeting minutes for certain condominium common-area or exterior work. The exact requirements depend on the governing documents and local process. Rancho Palos Verdes Building & Safety Division FAQs.
Owner-builder permits
An owner-builder route does not make an otherwise unlicensed contractor permissible. State statutes set different exemptions and conditions, including limits on who may perform work and the owner’s responsibilities. South Carolina’s cited owner-improvement exemption expressly does not authorize hiring a person or entity that must be licensed or registered. Florida’s owner-builder provisions also include conditions concerning use, supervision and licensing. Review the current law for your state and project rather than treating an owner-builder permit as a workaround. South Carolina Code of Laws, Title 40, Chapter 59 Florida Statutes, Chapter 489 (2025) Oregon Revised Statutes, Chapter 701.

Before work starts: confirm the roles
- Verify title and signing authority. Identify the legal owner and any co-owners. If a trust or entity owns the property, establish which person can sign for it.
- Write down the scope of any delegation. If an agent will approve the work or handle permit steps, specify the property, person, work and authorized acts. Ask the permit office whether it requires a particular form or notarization.
- Describe the project accurately. Tell the building department whether the work is an ordinary repair, structural work, regulated trade work, owner-builder project or work on a condominium common area. The project can affect licensing, signatures and review.
- Confirm permit roles with the local office. Ask who may apply, who should be listed as permit holder, and what owner, contractor or agent documents are required. Do not assume the person signing the construction contract should also be the permit applicant or holder.
- Check licensing rules with the state. Verify that the contractor is properly licensed or registered for the work and that any claimed owner-builder exemption applies to the project and arrangement.
- Align the paperwork. Make the contract, written authorization and permit record consistent about who approved the work, who will perform it and who is responsible for permit-related steps.
Check the rules where the house is located
Permit eligibility, required forms and owner-builder conditions vary by state and locality. The examples above are jurisdiction-specific and should not be substituted for current local instructions. Before work begins, contact the local building department and the relevant state licensing board with the property address, project scope and proposed contractor arrangement. If there is a dispute about who can bind the owner or approve the project, consult a qualified local attorney.
