When do I have to file sales tax after nexus rules change? There is no single national date: a state’s change can affect whether you must register, when collection begins, and how you report sales. Re-check the effective date, threshold and sales it counts, measurement period, marketplace treatment, physical presence, and the state’s registration and filing instructions. Confirm the result with that state’s revenue department before acting.
Why a rule change can alter your filing duties
Economic nexus rules are state-specific. A change may revise the dollar threshold, remove or add a transaction-count test, redefine which sales count, or change the measurement period. It can therefore change when a seller crosses a threshold without creating one nationwide registration or collection date. The Streamlined Sales Tax (SST) state guidance and tables are useful comparison aids, but SST says its summaries do not override state law; consult the current guidance from the state at issue. See Remote Seller State Guidance and State Tables.

Also distinguish the threshold test from the steps that follow it. Meeting a state’s test may mean you need to register, but the state’s instructions determine the registration deadline, when collection must start, and when the first return is due. A threshold change alone does not establish those dates.

#1 Best Overall
| Rule detail | What to verify |
|---|---|
| Effective date | When the change takes effect and whether the state provides a transition rule. |
| Threshold | The current dollar threshold and whether a transaction-count test remains, changed, or was removed. |
| Sales included | Whether the state measures gross sales, gross receipts, taxable sales, or another defined base. If the measure is gross sales, exempt, nontaxable, and resale sales may still count; check the state’s definition rather than assuming they are excluded. See Remote Seller Threshold Terms. |
| Measurement period | Whether the test uses the current or previous calendar year, a preceding twelve-month period, or another period. SST’s agreement recognizes different state approaches. See Streamlined Sales and Use Tax Agreement, Article I. |
| Sales channel | How the state treats direct sales, marketplace sales, and sales made only through a marketplace facilitator. |
| Registration and returns | When to open an account, when collection starts, how often to file, and how to report transactions for which a facilitator collected tax. |
Recent state examples show why dates and definitions matter
These are examples from SST’s state guidance, not universal rules. Confirm each current requirement with the relevant state revenue department before relying on it.
| State and effective date | SST’s listed change | What it illustrates |
|---|---|---|
| Illinois — January 1, 2026 | SST lists a threshold of $100,000 or more in cumulative gross receipts from Illinois sales of tangible personal property. Its table records earlier rules separately. See SST state guidance. | Check both the effective date and the exact sales measure; a dollar amount without its definition is incomplete. |
| Alaska — January 1, 2025 | SST lists a $100,000 statewide gross remote-sales threshold in the previous or current calendar year, with the prior separate transaction test removed. See SST State Tables. | A rule change can affect the test itself, not only its dollar amount. |
| Indiana — January 1, 2024 | SST records a change to a $100,000 gross-revenue threshold and describes transition handling for sellers that previously met only the transaction test. See SST State Tables. | Where a prior test is removed, check the state’s transition instructions instead of assuming when an existing obligation ends. |
How marketplace sales affect the review
A marketplace facilitator may collect and remit tax on transactions it facilitates, but that does not necessarily remove the seller’s registration or return obligations. A seller’s own direct sales should be assessed under the state’s remote-seller rules. SST also says marketplace sales can count toward a remote seller’s threshold; verify the applicable state rule and guidance. See Marketplace Sellers, Marketplace Facilitator, and Article I of the agreement.

Keep the channel distinction clear in your records: facilitator-collected transactions, your own direct sales, and any other sales the state says count toward the threshold. Then follow the state’s return instructions for reporting facilitator-collected transactions; do not assume that collection by the marketplace means no return is required.
Check physical presence separately
Do not rely only on a remote-seller threshold if the business has in-state staff, property, inventory, or another form of physical presence. SST says sellers with physical presence are generally required to register regardless of sales amount. The state’s own rules determine how a particular presence applies. Its marketplace and remote-seller overview provides context, but the state revenue department is the authority to check for the business’s circumstances.

Use this sequence after a rule change
- List the states to review. Include states where you make sales and states where the business may have staff, property, or inventory.
- Capture the rule and effective date. Record the state’s exact threshold language, sales definition, measurement period, and any transition provision.
- Reconcile sales data to the state’s test. Use the required period and include direct, marketplace, exempt, resale, or other transactions where the state says they count.
- Assess physical presence independently. Do not treat a remote-seller threshold as the complete test if the business has an in-state presence.
- Confirm registration and collection timing. Check the state’s account-opening deadline and first collection date before deciding when to begin collecting.
- Verify filing treatment and preserve the record. Confirm filing frequency and treatment of facilitator-collected transactions, then save the official guidance and the date/version you relied on with the workpaper.
Registration date is not a substitute for state instructions
The SST Remote Seller Threshold Terms page states: “You are responsible for collecting and remitting sales tax to each state beginning with your ‘registration date’.” Read that guidance alongside the specific state’s registration and timing instructions; it does not establish a universal deadline for registration, first collection, or the first return. See SST Remote Seller Threshold Terms and the Remote Sellers FAQ.
Some remote sellers required to remit solely because they meet a state’s economic nexus threshold may be eligible for free Certified Service Provider services through SST. Eligibility and availability depend on the program’s terms; check SST Free Services for details.
