The case involves three separate processes: Jane Doe’s civil lawsuit, a reopened criminal investigation, and Cornell’s disciplinary proceedings. The lawsuit’s allegations have not been established as criminal findings. Reuters reported on October 2, 2026, that no criminal charges had been filed and that New York had appointed a special prosecutor.
What Jane Doe alleges happened
Jane Doe, a pseudonym used in court documents, alleges that she was drugged and sexually assaulted at the Cornell Chi Phi fraternity house in October 2024, when she was a 20-year-old student. Reuters reported that her September 2026 civil lawsuit named seven former fraternity members, the fraternity, Cornell, a local bar and her sorority as defendants. The allegations in the complaint are not findings of fact.

According to Reuters’ account of the complaint, Jane Doe went to the house on October 19 after drinking earlier. She alleges that she was given alcohol, marijuana and ketamine, became incapacitated and was assaulted.

Jane Doe said an initial sexual encounter with two men was acceptable to her, but that she became uncomfortable as events changed and more men entered the room. She also described thinking that if she passed out after taking ketamine, the men could be charged with rape. The lawsuit says she lost consciousness at about 5:45 a.m. These details are accounts attributed to Jane Doe, not independent findings that establish what occurred.

What happened after she reported the incident
- October 19, 2024: Jane Doe alleges that the assault took place at the Chi Phi house.
- November 8, 2024: She reported the incident to Cornell police. Reporting on her interview transcript says she told investigators, “I can say with 100% confidence I was raped.”
- Later in 2024: Tompkins County District Attorney Matthew Van Houten did not file charges.
- September 2026: Jane Doe filed a civil lawsuit against seven former fraternity members and other defendants.
- By October 2, 2026: The district attorney had reopened the criminal investigation, and Governor Kathy Hochul had appointed New York Attorney General Letitia James as special prosecutor. Reuters reported that no criminal charges had been filed by that date.
Why the district attorney’s 2024 decision was questioned
The disagreement centers in part on what information reached the district attorney. According to the Associated Press, Van Houten relied on a statement prepared by campus police and signed by Jane Doe. He did not receive a full transcript of the interviews or speak with her directly.
Van Houten said the statement did not include her assertion that she was sure she had been sexually assaulted, or allegations that she had been drugged against her will or forced into sex acts. Reporting that later compared the statement with the interview transcript highlighted the omission of her statement to police that she was certain she had been raped. Reuters reported that this sentence appeared in the transcript but not in the shorter sworn statement sent to the DA.

Van Houten defended his decision not to seek more evidence. The transcript and the shorter statement offer different records of what investigators documented; that difference does not itself determine whether a crime occurred or whether a charge can be proved.

Cornell conducted its own university investigation and disciplinary process after the report. The Associated Press reported that the inquiry included 50 interviews with 32 witnesses and 12 days of hearings, and produced a 99-page panel report. Those figures describe the university process; they do not establish the truth of the criminal allegations or indicate how common sexual assault is on campus.

The university said that some students were expelled or suspended but has not disclosed individual disciplinary outcomes, citing privacy laws. The Chi Phi chapter remains barred from campus. At a May 2025 university hearing, Jane Doe described the experience by saying, “I felt like bait. I felt like lions around me. It just was a totally debilitating place to be in,” according to AP reporting.
How the different proceedings relate
| Process | What it addresses | What its outcome does—and does not—mean |
|---|---|---|
| Civil lawsuit | Jane Doe’s claims against the named defendants in court. | The complaint sets out allegations; filing it is not proof of them and is not a criminal charge. |
| Criminal investigation | Law enforcement’s inquiry into whether evidence supports criminal charges. | Reopening an investigation is not the same as filing charges, obtaining a conviction or resolving the allegations. |
| Cornell disciplinary process | The university’s response under its own procedures and rules. | Suspension or expulsion is a university disciplinary outcome, not a criminal conviction. |
| Outside review of Cornell | The governor called for an outside review of Cornell’s handling and campus culture. | The reporting reviewed does not establish the review’s full scope, timetable or findings. |
Cornell said it supported reopening the criminal investigation and stated that its own process had resulted in discipline or expulsions. Hochul said, “No student should ever be left wondering whether the institutions meant to protect them will listen and act,” AP reported when she called for an outside review.

What is known about the case’s status
As of Reuters’ October 2, 2026 report, the criminal investigation had been reopened, Letitia James had been appointed special prosecutor and no criminal charges had been filed. The reporting available through that date did not establish whether the special prosecutor later filed charges, convened a grand jury or completed the investigation. The appointment and reopened inquiry therefore mark procedural developments, not a determination of guilt.
