A woman identified in court filings as Jane Doe alleges that seven members of Cornell’s Chi Phi fraternity drugged and sexually assaulted her in October 2024. Cornell conducted a separate Title IX process and disciplined students. After the woman filed a civil lawsuit in September 2026, the Tompkins County district attorney reopened the criminal investigation; on October 2, New York Governor Kathy Hochul appointed Attorney General Letitia James as special prosecutor. As of October 3, 2026, no criminal charging decision had been announced in the reporting reviewed, and the allegations remain contested.
What the woman alleges—and what is disputed
The September 2026 civil lawsuit says Jane Doe was given ketamine and repeatedly sexually assaulted at the Chi Phi house at Cornell in October 2024. The complaint also alleges that she was incapacitated and that sexual acts were nonconsensual. These are allegations in a civil case, not findings of criminal guilt. Several men accused in the suit have denied having nonconsensual sex or said they did not touch her, according to the Associated Press (AP).
Jane Doe later described her condition to Cornell investigators at a May 2025 hearing. AP quoted her as saying: “You look like an operating human being. You don’t look dead or asleep necessarily. So, lights are on, but nobody’s home. Your brain is not functioning at its proper level.” That is her account in the university process, not an independent medical finding.
How the three proceedings differ
The university’s disciplinary process, the county prosecutor’s criminal review, and the state-led investigation are separate proceedings. They use different decision-making authorities and address different questions; Cornell’s discipline does not determine whether criminal charges should be filed.

Why the initial decision is under scrutiny
The dispute centers in part on the difference between what Jane Doe reportedly said in her campus-police interview and the shorter summary the district attorney says his office received. Van Houten said he did not see the complete transcript and that the material supplied to him did not include statements that she was sure she had been sexually assaulted, had been drugged against her will, or had been forced into sex acts.
AP’s October 3, 2026 fact check, based on a transcript obtained by CBS News, reported that the interview transcript included statements about coercion and incapacitation and that Jane Doe said she was “100% confident” she had been raped. AP described the claim that she never told police she was raped as misleading. The distinction matters: the transcript and the summary are not the same record, and Van Houten has said his initial decision was based on the summary rather than the full transcript.

After speaking with Jane Doe and her attorney and reviewing allegations in the civil suit that he said he had not previously seen, Van Houten reopened the county investigation in late September 2026. AP quoted him as saying, “Seeking justice sometimes requires us to reconsider or reopen cases when we are provided with additional evidence.” The governor’s appointment of James followed on October 2.
Timeline of the case
- October 2024: The alleged assault took place at the Chi Phi house, according to the civil complaint.
- November 2024: About three weeks later, Jane Doe reported the matter to Cornell campus police and was interviewed over two days, AP reported.
- 2024–2025: Cornell conducted its Title IX and student-conduct inquiry, including interviews and hearings.
- May 2025: Jane Doe gave testimony to Cornell investigators about her condition during the alleged incident, as reported from the university hearing.
- September 2026: Jane Doe filed a civil lawsuit against Cornell and seven former students, among others. The filing brought additional allegations into public view and prompted renewed scrutiny of the earlier criminal review.
- Late September–October 2, 2026: The county investigation was reopened, then James was appointed special prosecutor.
What Cornell’s wider survey data can—and cannot—show
A 2026 Cornell Presidential Task Force on Campus Sexual Assault report summarized the university’s 2025 SARM survey. It reported that 35% of undergraduate women and 8% of undergraduate men who responded said they had experienced sexual assault during their time at Cornell. Among the survey responses, reported locations included residence halls (29%), off-campus residences (23%), and fraternity chapter houses (17%). These are survey-response figures, not findings about Jane Doe’s case or precise estimates of prevalence across all Cornell undergraduates.

The task force reported a 13% undergraduate response rate for the 2025 survey, compared with 34% in 2023, and cautioned that the low response rate limits estimates and interpretation. The figures therefore provide limited institutional context; they cannot establish what happened in this individual case.
