A clearly defined yes-or-no outcome does not make a trade safe: if your position loses, you can lose the amount you paid, and you may not be able to exit early at a favorable price.
How prediction-market contracts work
The Commodity Futures Trading Commission (CFTC) describes event contracts as commonly structured as swaps. Many ask a yes-or-no question, have a fixed payout that is usually $1, and expire at a specified time or when the event concludes. Other contracts have multiple outcomes or partial-payout ranges, so the terms for one market cannot be assumed to apply to another.

A contract’s price is the price at which participants are willing to trade; it is not a guaranteed probability or return. In the CFTC’s illustration, buying a “yes” contract for 70 cents that pays $1 if the event occurs would produce 30 cents in gross profit before fees and taxes. If the prediction is wrong, the buyer loses the amount invested. That example illustrates the arithmetic, not a typical result or a promise of profit. Risks to understand before funding an account
You can lose the purchase amount
For a contract where the buyer pays upfront, an incorrect prediction can wipe out the amount paid for that position. A capped, clearly stated loss is still a loss; do not treat defined outcomes as evidence that a trade is safe. The overall risks also include the operator, the ability to trade out, and how a contract is resolved.

Costs reduce returns
Commissions, fees, penalties, taxes, and other charges can change the break-even point and reduce or eliminate a potential return. Check the current fee schedule for the particular platform and contract, and include applicable taxes in your own calculation. Costs vary, so a fee figure for one operator or market should not be treated as universal.
An early exit may be costly or unavailable
You may be able to sell or offset a position before settlement, but the price is the market price available at that time. A working order is not a promise that another participant will take it, or that you can exit quickly without accepting a lower price. The CFTC notes that complex contracts can attract fewer participants and have comparatively lower liquidity.

Settlement terms can differ from the headline
Read the contract rules, not just the market title. The rules determine what counts as the event, which source is used to resolve it, who makes the determination, when the deadline falls, and how the payout is calculated. A familiar headline may not match the contract’s defined outcome.

Regulatory status and customer protections depend on the legal entity, the services it provides, your location, and the account arrangement. CFTC-regulated exchanges and intermediaries are subject to oversight and rules, and certain intermediaries must follow customer-fund protection requirements. That does not prevent trading losses or mean every account has identical safeguards. The CFTC warns that unregistered entities outside the United States may provide little or no protection.

Integrity problems can affect a market
Misuse of nonpublic information, fraud, manipulation, wash sales, and other prohibited conduct can undermine market integrity. In an advisory dated February 25, 2026, the CFTC’s Division of Enforcement described two cases handled by Kalshi: a candidate apparently traded a contract on their own candidacy, and a YouTube-channel editor likely traded with advance knowledge of videos. Kalshi imposed financial penalties and suspensions in those cases. The CFTC said it has authority to police illegal trading practices on designated contract markets and noted exchanges’ audit-trail, surveillance, and enforcement duties. The cases show that incidents occur; they do not establish how common such conduct is. CFTC Enforcement Division advisory, February 25, 2026
Scams and counterfeit apps are a separate risk
Be wary of promises of large payoffs, “free money,” celebrity endorsements, glowing reviews, and investment recommendations from recent online acquaintances. Verify the platform’s identity and registration rather than trusting an ad or app listing; when in doubt, navigate to the operator’s official website and follow its app links. CFTC consumer guidance

Deposits can encourage overspending
Decide on a firm limit before trading. Use only risk capital: money remaining after living expenses and savings needs, not funds needed for bills or financial goals. The CFTC cautions consumers to watch for enticements that encourage risking more than intended.
What to check before you deposit
- Verify the entity and availability. Identify the exact legal entity operating the service, check its registration using official information, and confirm that its services are available where you live. Do not assume one operator’s status applies to another.
- Read the contract’s resolution rules. Find the event definition, resolution source, decision maker, deadline, and payout. Make sure the written terms match what you think the market is asking.
- Calculate costs and downside. Review the current contract-specific fee schedule, account charges, and relevant tax obligations. Work out the amount at risk and how costs affect the price at which a trade would break even.
- Assess the exit, not just the entry. Review current bids and asks and available market depth. Consider whether you could close the position without accepting a substantial price concession; liquidity can change, and an order may not fill.
- Understand the account and customer-fund arrangements. Read the account agreement and learn how funds are held, what protections apply to that particular arrangement, how you access funds, what statements or records you receive, and how to submit a complaint. Protections vary by entity and account structure.
- Check integrity rules. Look for rules on trading with confidential information, trading when you can influence an outcome, prohibited conduct, surveillance, and enforcement. Do not trade a contract if you have access to relevant nonpublic information or influence over its outcome.
- Set your deposit limit. Decide in advance how much risk capital you are willing to lose, and do not increase the limit because of promotions, a losing streak, or pressure to act quickly.
The CFTC summarizes the core uncertainty plainly: “All speculation involves risk.” CFTC consumer guidance
