Do you need permission to fly a camera drone for recreation? Sometimes. In the U.S., the rules depend on why and how you fly, the drone and its registration status, and the location. A hobby label, small aircraft, FAA registration, or airspace authorization does not by itself make every flight legal.
This guide covers U.S. federal requirements and selected federal land-management guidance current to October 4, 2026. State and local rules may also apply.

First, choose the right operating route
The FAA describes two main routes: the limited statutory exception for recreational operations or operation under Part 107. The decision depends on the intended operation and applicable rules—not simply on whether the drone has a camera, whether you own it, or what you call the flight. The FAA’s guidance does not decide every mixed-purpose or edge-case scenario; consult FAA guidance or qualified advice if your plans do not clearly fit either route.
| Question | Recreational exception | Part 107 |
|---|---|---|
| Purpose and eligibility | Must qualify as a recreational operation and follow the applicable community-based safety guidelines and other conditions (FAA). | Applies to operations conducted under Part 107; follow that rule’s requirements (FAA). |
| Preparation | Pass TRUST before the first flight (FAA). | Have an FAA Remote Pilot Certificate, or operate the controls under the direct supervision of its holder (FAA). |
| Registration and Remote ID | A drone weighing 0.55 pounds or less may be exempt from registration only when flown under this exception; registration and Remote ID rules still depend on the aircraft and operation (FAA). | Registration is required under the applicable rules; registered drones must comply with Remote ID (FAA). |
| Controlled airspace | Get FAA authorization before flying in controlled airspace (FAA). | Get airspace authorization for operations that require it (FAA). |
| Night flight or flight over people | Follow the requirements applicable to the recreational exception and location. | May be possible only when the relevant Part 107 conditions are met (FAA). |
What must you do before your first flight?
If you are flying recreationally
Take and pass the FAA’s The Recreational UAS Safety Test (TRUST) before your first flight. Keep proof of completion available when flying. You must follow the applicable community-based safety guidelines, keep the drone within visual line of sight, give way to manned aircraft, and meet any airspace authorization requirements.

If you are operating under Part 107
Obtain the applicable FAA Remote Pilot Certificate, or make sure the person operating the controls is under the direct supervision of a certificate holder. Part 107 has its own operating requirements; a recreational test does not substitute for the certificate.
Does your camera drone need registration and Remote ID?
The FAA says drones must be registered except those weighing 0.55 pounds or less (less than 250 grams) and flown under the Exception for Limited Recreational Operations. This is a narrow registration exception, not a general exemption from flight rules. For example, it does not remove the recreational pilot’s TRUST, visual-line-of-sight, airspace, or location obligations.

The FAA says drones required to be registered, or that are registered, must comply with Remote ID. That includes recreational, business, and public-safety drones. A drone registered under the recreational exception cannot be flown under Part 107, and registration cannot be transferred between those operation types.
The FAA registration page lists a $5 fee and three-year validity for Part 107 registration per drone, and a $5 fee and three-year validity for recreational registration covering the owner’s inventory. These are the amounts and terms the FAA currently states; check the registration page when registering in case they have changed.

Can you fly near an airport or in controlled airspace?
Do not assume that an airport’s distance from your takeoff point tells you whether a flight is allowed. Check the airspace for the exact location and planned operation. Recreational flyers need prior FAA authorization to fly in controlled airspace; Part 107 pilots also need authorization for covered operations there.

- Check the airspace close to the flight. Restrictions, maps, and temporary limits can change.
- Request authorization for the planned location, time, and altitude. Where LAANC is available, approved service suppliers can provide near-real-time authorization at mapped altitudes. Some requests above mapped altitudes may need further coordination.
- Use FAA DroneZone where LAANC is unavailable. The FAA describes DroneZone requests as manually processed, so allow time for review.
- Read the authorization’s limits. It applies to the approved request; it does not replace other flight, property, or land-manager rules.
An airspace authorization and a waiver are different processes. If an operation requires both, you must obtain both.

Night operations under Part 107
Part 107 allows night operations only when its requirements are met. The remote pilot must complete the updated knowledge test or recurrent training, and the drone must have anti-collision lighting visible for at least three statute miles with a sufficient flash rate, as described by the FAA.

Operations over people under Part 107
Permission depends on the drone’s category and the specific operation; it is not a blanket allowance for camera drones. For example, FAA Category 1 requirements include a weight limit of 0.55 pounds or less, including attached items, and no exposed rotating parts likely to cause lacerations. Other categories have additional aircraft and operational requirements. Assess the actual aircraft and planned flight against the applicable rule before operating over people.
Can you fly a camera drone in a national park?
Check the specific park’s current rules and exceptions before launching, landing, or operating. National Park Service Policy Memorandum 14-05 directed park superintendents to prohibit launching, landing, or operating uncrewed aircraft from NPS-administered lands, subject to specified conditions and exceptions. The NPS says this policy does not modify FAA requirements. It should not be read as a claim that FAA airspace over every park is categorically closed.
What privacy and local rules apply to drone cameras?
FAA flight rules do not amount to a universal federal privacy rule for camera-drone recording. FAA aeronautical information recognizes that state and local governments may generally address matters such as privacy, voyeurism, trespass, land use, and photography, subject to limits. Which rules apply depends on your jurisdiction and circumstances.
Recommended Free Tools
- Check state and local laws before recording, and before sharing footage when relevant.
- Respect privacy; avoid harassment or intrusive recording.
- Get permission where required and check property rules before taking off, landing, or operating from private or managed land.
What to verify for your particular flight
- Whether the intended operation qualifies for the recreational exception or must follow Part 107.
- Whether you have completed TRUST or hold the required remote pilot certificate or direct supervision, as applicable.
- Whether registration and Remote ID requirements apply to your aircraft and operating route.
- Whether the exact location, altitude, and time require FAA airspace authorization.
- Whether night or over-people requirements apply to the planned operation.
- Whether the land manager, park, state, city, or property owner imposes additional restrictions.
The FAA’s Part 107 operating requirements put the core air-safety instruction plainly: “Always avoid manned aircraft.”
