What to Do When a Safety Audit Finds Violations

An internal audit finding is not an OSHA citation. Learn how to protect workers, correct hazards, document abatement and follow federal citation deadlines.

First, determine whether the finding came from an internal audit or a formal OSHA citation: they are not the same, and the steps and deadlines differ. Protect anyone facing immediate danger, understand the specific hazard and rule, assign corrective action and verify it worked. If federal OSHA issued a citation, follow the notice item by item, including its abatement, posting, documentation and contest instructions.

First identify what kind of finding you have

An internal safety audit, a customer or insurer report, and an OSHA citation are different documents with different consequences. An audit finding is not itself a formal OSHA citation. For a citation, the notice you received controls: check the cited location, each alleged violation, the standard referenced and the instructions and dates for that item.

Federal OSHA procedures are the focus here. State-plan states and regulators outside the United States may have different requirements and deadlines. If someone faces imminent danger, follow your organization’s emergency procedures to isolate the hazard and protect people while qualified staff determine a safe corrective action. Preserve the original audit report or government notice.

Read a federal OSHA citation item by item

The Occupational Safety and Health Act requires a citation to describe the alleged violation with particularity, reference the provision allegedly violated and set a reasonable time for abatement. (OSH Act Section 9(a).) For each item, identify:

  • The condition and location OSHA describes, and the standard or provision cited.
  • The classification and proposed penalty, if stated.
  • The abatement date and any instructions about how to certify or document correction.
  • Any posting and employee-communication requirements in the notice.

Do not assume one remedy fits every finding. The right correction depends on the hazard, task, equipment, exposure and cited standard. Where the technical fix is unclear, get qualified safety advice; where the legal basis or response is disputed, consider counsel.

Choose whether to correct, contest, or do both

For a federal OSHA citation, an employer generally has 15 working days after receiving it to contest the citation and/or proposed penalty. The notice explains how to contest all or individual items, penalties or abatement dates. An informal conference with the OSHA Area Director is optional and can take place during that period; it is not an adjudication and does not replace careful attention to the contest deadline. Do not assume a conference extends the deadline. See OSHA’s contest procedures and Federal OSHA employer rights and responsibilities.

Assess the dispute against the actual facts, not just the penalty amount. Consider whether the description and cited standard fit the condition, employee exposure and severity, the time and feasibility involved in correction, whether the disagreement concerns the violation, penalty or abatement date, and what evidence supports your position. Correcting a hazard while contesting a disputed citation item may be appropriate; contesting does not mean leaving employees exposed.

Employees or their representatives may have a separate process to object to an abatement period they consider unreasonable. The applicable filing process and deadline are in 29 CFR 1903.17.

Correct the hazard and prevent it from returning

Assign an accountable owner and a due date for each finding. If full correction cannot happen immediately, document interim protections and who is responsible for maintaining them. Select the final control based on the specific hazard and applicable rule; a generic equipment or PPE recommendation can be ineffective or inappropriate when the underlying condition is unknown.

Check whether the action actually eliminated the hazard and whether the circumstances that allowed it to arise have changed. Depending on the finding, that may mean checking the corrected condition in operation, reviewing the relevant work procedure, or confirming affected employees received needed information or training. Record the check and address any remaining exposure before closing the item.

Document and verify abatement

OSHA defines abatement as “action by an employer to comply with a cited standard or regulation or to eliminate a recognized hazard identified by OSHA during an inspection.” (29 CFR 1903.19(b)(1).) For a useful closure record, keep:

  • The original finding and the condition before correction.
  • The corrective action, its completion date and the person responsible.
  • Evidence of the corrected condition and the check that it remained effective.
  • Any interim protections, affected employees informed or trained, and steps taken to prevent recurrence.

For each uncontested federal OSHA citation item, the citation notice says to certify abatement by letter within 10 calendar days after that item’s abatement date, stating the date and method of correction. Submit supporting documentation if the notice requires it. Follow the instructions on your actual notice rather than treating this period as a rule for internal audits or every jurisdiction. The regulation’s abatement verification provisions also govern the applicable documentation requirements.

Post the citation and communicate the correction

The federal OSHA citation notice instructs employers to post it at or near the cited location. If that is impracticable, post it where affected employees can readily see it. Keep it posted until the violation is abated or for three working days, whichever is longer. The notice also requires effective communication of abatement activities to employees. Post the abatement certification where the violation and corrective action appeared, or otherwise effectively inform employees about the action, as the notice directs. Refer to the federal OSHA notice instructions for the requirements applicable to your citation.

Close internal audit findings without assuming immunity

For an internal audit finding, correct the condition promptly, document verified closure and investigate why the failure occurred so recurrence can be prevented. OSHA’s 1996 interpretation describes an enforcement practice under which it would not issue a citation for a self-audit condition permanently corrected before an OSHA inspection and before an accident or other event triggering an inspection, including appropriate steps to prevent recurrence. That dated interpretation is not blanket immunity: an identified condition that remains unabated may be cited if OSHA finds it during an inspection. See OSHA’s 1996 self-audit interpretation.

When to get specialized help

Bring in a qualified safety professional when the hazard, control or verification method requires technical expertise. Consider legal advice when disputing whether a standard applies, contesting a citation or proposed penalty, or handling a complex abatement date. The citation and the actual workplace conditions—not a general checklist—determine the appropriate response.
