If the offer conflicts with something a recruiter or manager told you, identify both versions and request a corrected offer or written clarification. Don’t treat a target bonus, commission estimate, or verbal figure as guaranteed pay unless the written terms make that clear.
Ask for the complete offer in writing
Start calmly: thank the recruiter, say you’re interested, and explain that you need the full terms to evaluate the offer. The U.S. Department of Labor’s 2026 TEAMS Salary Negotiation Participant Guide recommends not deciding on the spot and suggests asking, “I want to make sure I understand all the components of the offer; will you send me an email outlining the proposed terms?” Read the guide.

Tailor your request to the role. Ask for the details that affect what you will earn, pay, or give up:
- Base salary or hourly wage, pay frequency, and expected hours.
- Bonus, commission, equity, or signing payment, plus the written plan or terms that govern each.
- Benefits and employee costs, such as health coverage and retirement contributions.
- Paid time off, work location, schedule, travel expectations, and remote-work arrangements.
- Start date and any probationary period or eligibility condition that affects compensation.
The Department of Labor guide advises looking beyond salary to benefits, hours, flexibility, vacation time, and retirement plans. Those details can materially change how an offer fits your needs.

Resolve conflicting figures before you accept
Quote the mismatch neutrally rather than accusing anyone of changing the deal. For example, state the amount shown in the offer and the different amount or promise discussed, along with the date of the conversation if useful. Ask which amount is correct and request an updated offer or written supplement that reflects the agreed terms.
Ask which written documents apply—for example, whether a separate bonus or commission plan is part of the offer. A practical request for written clarification is not a universal conclusion about which document controls or whether an oral promise is enforceable; those questions can depend on the documents and applicable law.
Separate guaranteed pay from conditional compensation
Base pay and conditional compensation should not be treated as interchangeable. A target bonus, on-target earnings figure, discretionary award, or commission estimate may depend on eligibility, performance, quota, or other conditions. Ask for the governing plan and confirm:

- Who is eligible and when eligibility begins.
- When payment is made and what conditions must be met.
- Whether any guarantee or ramp period discussed is written into the terms.
Until those terms are clear, compare conditional amounts separately from guaranteed cash. A target or verbal estimate alone does not establish that you will receive that amount.
Compare the whole package, not just the headline salary
For one offer, or when comparing several, lay out the components in a way that keeps certainty visible. This is a practical comparison framework, not an official scoring system.
| Area | What to compare |
|---|---|
| Guaranteed cash | Base pay, signing payment, and any guaranteed first-year bonus. |
| Conditional cash | Target bonus or commission, how it is calculated, and the conditions required to earn it. |
| Benefits and costs | Health coverage, retirement contributions, leave, and your out-of-pocket costs. |
| Time and flexibility | Expected hours, schedule, location, travel, and remote-work terms. |
| Certainty and documentation | Whether material promises appear in the offer or a referenced written plan, and whether inconsistencies have been explained. |
| Fit and timing | Start date, role scope, and the factors that matter most to you. |
Pay-disclosure rules depend on where and how the job is advertised
A missing salary in an offer letter does not, by itself, establish that the employer broke the law. Pay-transparency rules often govern job advertisements or specified hiring situations, which are distinct from the contents and legal effect of an individual offer. Coverage depends on location and circumstances.
Rank #4
- European Union: The European Commission’s June 5, 2026 explainer says employers must inform job seekers of the starting salary or pay range in the vacancy notice or before interview, and cannot ask about pay history under the rules it summarizes. Member-state implementation and individual circumstances matter. See the Commission explainer and the directive text.
- Ontario, Canada: Government requirements effective January 1, 2026 cover public job postings, subject to exceptions. The province describes an exception where expected compensation or the upper end of a range exceeds CAD 200,000 per year. The posting rules do not require an employer to make an offer within the published amount or range. Check Ontario’s guidance.
- New York: State Labor Law §194-b covers certain job advertisements for work performed at least partly in New York, including some positions performed elsewhere that report to a New York supervisor, office, or work site. Review the law’s current text and scope.
- Illinois: State guidance describes applicant access to pay scale and benefits before an offer or compensation discussion in specified situations where no posting was made available, as well as wage-history protections. Read Illinois Department of Labor guidance.
- Washington: State guidance says covered job postings must include a wage scale or salary range and a general description of benefits and other compensation, and describes salary-history restrictions. Applicability depends on coverage and current rules. Check Washington L&I’s guidance.
These examples are not a determination of your rights. Check the current rules for the place where the job is covered, and seek local employment-law advice if the answer could affect whether or how you accept.

Use a clear message and set a realistic response date
You can adapt this note to the details of your offer:
Best Value
Thank you for the offer. I’m excited about the role and want to make sure I understand the full package before I respond. The offer lists [written term], while our conversation on [date] covered [other term]. Could you confirm the correct amount and send the complete written terms, including the applicable bonus or commission plan and benefits summary? Once I have that, I can review the offer and get back to you by [date].
Set the response date after confirming when the employer needs your answer. If a material term remains undocumented or you are pressured to accept without clarification, pausing and seeking advice from a labor agency or employment lawyer in the relevant jurisdiction are prudent options; they are not guaranteed legal remedies.
