What to Do If Your Work Schedule Pressures You to Drive While Fatigued

If you feel too fatigued to drive safely, stop in a safe place, report the risk, and ask for rest or another safe way to travel. Protections vary by job and location.

If you feel too fatigued to drive safely, do not start the trip or keep driving. If you are already on the road, pull over somewhere safe, tell your supervisor or safety contact, and ask for rest or another safe way to travel. Then record the schedule, your symptoms, and the instructions you received. The exact legal protections depend on your job, vehicle, and location; there is no blanket rule that applies to every worker.

What to do right now

If you have not started driving

Tell your supervisor or designated safety contact that you do not believe you can drive safely. Ask for a specific alternative: rest before driving, a different assignment, another driver, or safe transportation. Do not treat pressure to meet a schedule as a reason to drive when you believe you are unsafe.

If you are already driving

Do not try to finish the route first. Pull over at a safe location, then contact your supervisor and agree on a safe plan. NIOSH advises workers who feel fatigued while driving to pull over, report the fatigue, and determine a safe course of action. Caffeine and a 15-to-30-minute nap may temporarily improve alertness, but they are not a cure or permission to continue while you still feel unsafe; sleep is the only cure for fatigue. Suggested wording

You could say: “I’m too fatigued to drive safely. I need to stop and arrange rest or another safe way to travel. Please confirm the plan.” This is a practical way to communicate the safety issue, not a legally required formula.

Why fatigue is a driving hazard

Fatigue can slow reaction time and impair attention and judgment. It can also cause lane drifting or microsleeps. Long wakefulness, repeated insufficient sleep, time of day, monotonous work, sleep disorders, and medications that cause drowsiness can all contribute. NIOSH states that fatigue affects safe driving whatever its source. NIOSH’s Driver Fatigue on the Job

NIOSH reports that as many as one in five fatal crashes in the general population involve driver fatigue. It also notes that most adults need 7 to 9 hours of sleep each day. These are general context, not a way to determine whether an individual is safe to drive: a driver can be impaired without crossing a particular hours-of-service limit.

OSHA’s drowsy-driving page, citing NIOSH estimates, says impairment after 17 consecutive hours awake is estimated to be equivalent to a blood alcohol content (BAC) of .05, and after 24 hours awake to a BAC of .10. Those figures are impairment comparisons, not legal intoxication thresholds. OSHA’s drowsy-driving guidance

Report the problem and keep a record

Use your workplace’s safety or incident-reporting channel as well as notifying a supervisor. Make a clear record while details are fresh. This is a practical documentation step, not a universal legal procedure.

  • Who you notified, when you notified them, and what alternative or response was offered.
  • Any near miss, incident, or delay connected with the fatigue concern.

If the first person you contact cannot address the risk, use the next available safety channel in your workplace. Keep copies of relevant schedules and communications if you can do so without compromising safety or workplace rules.

What employers should do to prevent fatigue-related driving

Fatigue is not only an individual alertness problem; schedules, staffing, and work practices can create or worsen it. OSHA recommends assessing motor-vehicle risks, using written safety procedures, reviewing operational practices, and setting workloads and schedules that allow safe driving and compliance with applicable hours-of-service rules. Its fatigue-prevention guidance also identifies staffing review, rest opportunities, education, and fatigue-risk management as prevention measures.

Can you refuse to drive while fatigued?

The answer depends on the work, vehicle, and jurisdiction. Federal hours-of-service rules cover particular drivers and operations; being within a legal driving-hours limit does not establish that you are rested enough to drive safely. Likewise, the sources cited here do not establish a universal protected right for every worker to refuse any drive because of fatigue.

RVGONOW DMS Driver Monitoring System AI Fatigue Warning Device with Face Recognition Alerts for Eye Closing Yawning Smoking Phone Use & Distraction Works for All Vehicles
  • Eye-Closing Alert: AI detects prolonged eye closure and sends a loud warning.
  • Yawn Alert: Notices repeated yawns and reminds you to stay alert.

OSHA describes protections under the Surface Transportation Assistance Act for certain drivers who report safety concerns related to commercial motor vehicle rules or refuse to operate an unsafe vehicle. That is narrower than a general right to refuse every work drive when tired. Whether a protection applies, and what remedy may be available, requires case-specific confirmation. OSHA’s motor-vehicle safety guidance for drivers

For advice about your situation, check with OSHA or the relevant state labor or safety agency, your union representative, or a qualified attorney. Explain what you drive, what work you do, where the trip occurs, and what happened after you reported the fatigue.
