What to Do If Your Utility Proposes a Rate Increase for Data Center Power Demand

If your utility cites data center demand in a proposed rate increase, check the live state docket, examine the cost and risk allocation, and comment with record-based questions.

Start with the state utility commission’s live docket—not with the claim on a bill insert alone. Check the filing, deadlines and hearing dates, then examine what costs the utility wants approved and how it proposes to assign them among customers. Submit a focused comment through the commission’s official process, asking whether the data center or other large customer will cover the costs and risks it creates. A utility’s request is a proposal for regulators to review; it does not, by itself, establish that data centers caused a particular increase in your bill.

Where should you start?

For a household rate increase from a regulated electric utility, begin with the relevant state public utility commission or equivalent regulator. Search its website for the utility’s name and terms such as “rate case” or “rate increase.” If the notice or bill insert gives a docket number, search that exact number. The docket—not an older news story or general announcement—is where to confirm the filing, current procedural stage, comment instructions, and any deadlines or hearing dates.

  1. Find the docket. Use the commission’s official search and open the case record for the utility’s filing.
  2. Check what is happening now. Note the filing title, comment deadline, public-hearing schedule, and instructions for submitting comments. Procedures and permitted formats vary by state and case.
  3. Save the relevant documents. Look for the utility’s application, testimony, proposed tariffs or settlement, hearing notices, and commission orders. Record the docket number and the document or page that supports each point you plan to raise.
  4. Return to the docket before submitting. A deadline or event described in an older notice may have passed, and the commission may have updated the instructions.

A rate increase requested by a utility is not automatically approved. The regulator reviews the record and may approve, change, or reject requested spending and rates under the rules that apply in that jurisdiction.

What exactly is the utility asking regulators to approve?

Separate the proposed costs from the proposed way of collecting them. A filing can ask regulators to approve system spending, decide how justified costs are divided among customer classes, or change the rates used to collect approved revenue. Those are related but distinct questions: a customer may accept that some investment is needed while disputing who should pay for it or how the bill is structured.

California provides one example, not a template for every state. In the California Public Utilities Commission’s general rate case process, one phase determines the utility’s justified revenue requirement; a later phase allocates approved revenue among customer groups. The allocation phase does not approve new costs. Use the docket and applicable state process to find out what is actually before your regulator.

What should you look for in the data center evidence?

Read the utility’s forecasts and cost-allocation proposal for the large load—its electricity demand—rather than relying only on a broad claim that data centers are driving investment. The U.S. Department of Energy identifies fair cost allocation, stranded-asset risk, and resource adequacy as important issues in rate design for data centers and other large electricity users.

  • New investment: Which generation, transmission, or local distribution upgrades does the utility propose, and what evidence connects each investment to the forecast demand?
  • Timing and utilization: When is the load expected to arrive and ramp up? What utilization does the forecast assume, and how does the plan account for a slower ramp or lower-than-expected use?
  • Payment commitments: Does the proposed rate or contract require payment for reserved or contracted capacity even when actual usage is lower? Does it cover the incremental system costs attributed to the customer?
  • Delay, cancellation, and exit: What deposits, collateral, termination charges, or other protections apply if the project is delayed, reduced, or cancelled—or if the customer leaves after the utility has made investments for it?
  • Reliability and flexibility: Are there ramp schedules, curtailment provisions, backup-power arrangements, or other protections relevant to resource adequacy and reliability?
  • Transparency: Can the public or participating parties inspect the assumptions and cost evidence needed to assess the proposal?

Some details may not be public. The Minnesota Public Utilities Commission notes that customer demand, infrastructure costs, schedules, and rates may be treated as trade secrets. If the record does not disclose an assumption, identify what is missing and ask the commission to explain how it can evaluate the proposal; do not state an unverified figure as fact.

How can you tell whether costs or risks could shift to other customers?

Compare the utility’s alternatives, tariff terms, or proposed settlement on the points that determine who pays if actual demand differs from the forecast. The questions below are useful prompts for reading the record; they are not claims that every tariff contains each kind of protection.

What to compare Question for the filing
Cost causation Which costs are assigned to the large customer, and which are spread across residential or other customer classes?
Minimum payment and contract term Must the customer pay for reserved or contracted capacity if it uses less? For how long?
Credit and exit risk What deposits, collateral, termination fees, or other protections apply if the project is delayed, reduced, or cancelled?
Forecast and construction risk Who bears the cost if forecast demand does not arrive or an investment is underused?
Reliability and flexibility Do the proposal’s ramp schedules, curtailment terms, backup arrangements, or resource-adequacy provisions address the system’s needs?
Transparency Are the assumptions and cost evidence available for review, or are important details withheld?

The DOE’s technical brief and actions by the Federal Energy Regulatory Commission (FERC) address issues such as allocation, stranded assets, reliability, and transmission. They do not establish that any particular household increase was caused by data-center demand. Make a causal claim about your utility’s proposal only when the docket record supports it.

What should you say in a public comment?

A useful comment identifies the case, states the concern, and connects it to evidence in the record. Focus on questions the regulator can consider, not on claims about the utility or customer that the documents do not establish. For example:

“I am commenting on the rate case for [utility name], docket [docket number]. The filing forecasts additional large-customer demand and proposes [identify the relevant cost, tariff, or allocation]. Please explain how the commission will determine which proposed investments are necessary for that demand and whether the large customer’s payments cover the incremental costs attributed to it. The filing should also address who bears costs if the customer’s load arrives late, is lower than forecast, or is cancelled, and what protections apply to other customers. Replace each bracketed instruction with the actual utility, docket, proposal, and record citation before submitting. If a relevant detail is missing or confidential, say what you could not verify and ask a specific question; do not assert an unsupported household-bill impact.

How do you submit a comment—and is that the same as intervening?

Follow the current instructions on the official docket. Use the commission’s public comment portal or the filing format specified in the case, and keep a copy of what you submitted. The participation route matters: an ordinary public comment is not necessarily the same as becoming a formal party, or intervenor, in the proceeding.

California’s commission allows members of the public to file comments without becoming parties; a person seeking party status must follow the formal intervention process. In an Ohio case, the Office of the Ohio Consumers’ Counsel (OCC) describes hearing testimony as entering the case record and provides a route for docket comments. The process in those examples does not establish the procedure or eligibility rules in other states. Check the live docket for your case, especially before relying on an old hearing date or deadline.

If the case is technical or formal party status matters, check whether a state consumer counsel, citizens’ utility board, community group, or legal-aid provider is active. A public comment does not make such a group your representative, and formal intervention may bring procedural obligations. The participation and assistance available depend on the jurisdiction and case.

What do state examples show—and what do they not prove?

Minnesota: state-level protections and limited disclosure

The Minnesota Public Utilities Commission describes state requirements for large customers to bear necessary electrical-upgrade costs and for utilities to propose special rates for large customers. It also cautions that some information about demand, infrastructure costs, schedules, and rates may be treated as trade secret. These statements describe Minnesota; they do not establish protections or disclosure rules elsewhere.

Ohio: a reported minimum-capacity payment and an appeal

OCC reported that the Public Utilities Commission of Ohio adopted a settlement on July 9, 2025, requiring new large data centers to pay for at least 85% of the capacity they contract for, for up to 12 years, even if they use less. OCC also reported an industry appeal in November 2025. That account does not establish the appeal’s later status or whether the reported terms are currently operative; check the current Ohio docket and court record before treating them as the rule now in force.

California: separating cost approval from allocation

In the California general rate case example, determining justified total costs and allocating approved revenue among customer groups occur in different phases. That distinction can help you identify whether your concern is about the spending itself or the proposed division of approved revenue, but other states may use different procedures.

When is FERC the right forum?

For a household’s retail electricity rate, start with the state commission’s retail docket. FERC’s 2026 fact sheet says its actions concerning large-load interconnection and interstate transmission do not displace state authority over retail rates, terms, and conditions. FERC’s work can address interstate transmission and cost shifting between transmission customers, which is a different question from a state utility’s retail rate case.

FERC describes large loads generally as demand greater than 20 megawatts on its RM26-4-000 docket page, reviewed October 7, 2026. The docket concerns a federal process for interstate transmission interconnection and invites comments through eComment, eFiling, or paper filing; it asks commenters to reference RM26-4-000. Use that route only when the federal docket is relevant to the issue you are raising. It is not a substitute for commenting on a state retail-rate filing.
