The right route depends on who held the data and which rules apply; a disclosure alone does not establish that a law was violated.
Preserve the evidence before contacting the organization
Keep a record of what you saw and when. Save the original notice, email, text, relevant screenshots and URLs, and the version of the privacy policy or other statement that described sharing. Write down the exact claims the organization made about anonymization, along with the dates and names of people you contacted. Avoid forwarding or reposting sensitive records while documenting the issue.

Ask what was shared and how identification risk was assessed
Contact the organization’s privacy officer or privacy contact in writing. Ask for a plain-language account of:

- Which health information was disclosed, including whether it contained direct identifiers or unusual details that might identify someone.
- When it was disclosed, who received it, and for what purpose.
- Whether the recipient could combine it with other information, and whether further sharing has stopped.
- What steps the organization took to contain the disclosure, whether it considers the incident a reportable breach, and what notice or support process it offers.
- If HIPAA applies, which de-identification method it used and whether an expert documented an identification-risk assessment.
These questions can help clarify what happened; they do not mean you are automatically entitled to every underlying assessment or internal document.

“Anonymous” is not a de-identification method
For protected health information subject to HIPAA, HHS recognizes two methods of de-identification. HHS’s de-identification guidance explains that context matters: information may be easier to identify when combined with other available data, and risk depends in part on the anticipated recipient.
Safe Harbor
This method requires removing the identifiers specified by the rule and meeting its conditions. Calling a dataset “anonymous” does not show that those requirements were met.

Expert Determination
A person with appropriate knowledge and experience applies accepted statistical and scientific methods, determines that identification risk is very small in the circumstances—including considering reasonably available information and the anticipated recipient—and documents the methods and results.

Ask which route the organization used and whether the recipient and possible data combinations were considered. There is no single de-identification solution that makes every dataset safe in every context.

Identify the organization and the likely reporting route
HIPAA does not cover every organization that handles health-related information. It generally applies to covered entities such as health plans, certain health care providers and clearinghouses, and to business associates in relevant circumstances. Some health apps and personal health record services outside HIPAA may instead fall under FTC rules. Do not assume an app is covered by HIPAA—or that it has no obligations because it is not.

The available facts about a suspected disclosure may not be enough to determine jurisdiction or whether it was unlawful. State laws, contractual promises, research rules, and incident-specific details can affect the analysis.

File with the regulator that matches the situation
HHS OCR for suspected HIPAA or Part 2 violations
HHS OCR accepts complaints from anyone who suspects noncompliance with HIPAA or Part 2. Describe the conduct and identify the entity; OCR says it does not investigate anonymous complaints. You may ask OCR to keep your contact details confidential during an investigation.

FTC for a health app or other potentially FTC-covered organization
The FTC directs consumers who believe a company misused or mistreated their health information to ReportFraud.ftc.gov. The FTC’s Health Breach Notification Rule form on that page is for covered organizations to report breaches; it is not the consumer complaint form. The rule may apply to certain health apps and personal health record vendors outside HIPAA, depending on the service and facts. See the FTC’s Health Breach Notification Rule guidance for the scope of the rule.

Keep the two deadlines distinct
For an HHS OCR complaint, the general filing deadline is 180 days from when you knew of the act or omission. OCR may extend the deadline for good cause, but do not rely on an extension without a reason to do so.
A separate deadline applies to certain breach notices, not to deciding whether a particular disclosure was a breach: when a covered entity has a reportable breach of unsecured protected health information, HIPAA requires notice to affected individuals without unreasonable delay and no later than 60 calendar days after discovery. Whether a disclosure triggers that rule depends on the facts, including whether it was impermissible and whether the information was unsecured. See HHS’s breach notification guidance.
Track the outcome and assess practical risk from the data exposed
Keep copies of complaints, confirmation numbers, the organization’s written response, and any notices. Assess identity-theft or personal-safety concerns based on the specific information exposed and the organization’s account of the incident; a health-data disclosure does not create the same risk in every case.
