Start by identifying which decision is actually pending. An H-1B registration that was not selected, a USCIS petition that is delayed or denied, and a visa application refused by a consular officer are different events handled by different agencies. Find the exact selection notice, Form I-797/USCIS notice, refusal sheet, or appointment message before deciding what to do. The correct response may be to provide documents, submit an official inquiry, reapply, or obtain case-specific legal advice—not to file an automatic appeal.

Your ability to remain in the United States or work while a case is pending depends on your current status, I-94, employment authorization, filing history, and dates. First, locate the stage and decision-maker
The same phrase—“my H-1B is delayed” —can describe three separate processes. The employer generally handles the cap registration and files the petition; U.S. Citizenship and Immigration Services (USCIS) adjudicates the petition; the Department of State (DOS) handles visa interviews and visa issuance at a consulate. A petition approval does not itself issue a visa, and a consular refusal does not automatically mean USCIS denied the petition.

Keep copies of every notice, upload confirmation, courier receipt, payment receipt, passport page, and prior submission. Record the date you received each document and every deadline printed on it.

If your H-1B registration was not selected
A cap-subject registration selection is permission to file a cap-subject Form I-129 petition; it is not approval of a petition or a visa. USCIS describes the registration process and selection-to-filing relationship in its H-1B Electronic Registration Process guidance. A nonselection notice is therefore not a petition denial.
Verify the result through the petitioner
- Ask the employer or authorized petitioner to open the official USCIS registration account and confirm the beneficiary’s exact status. Do not rely only on an email, a screenshot, or a third party’s description.
- Ask whether the registration was submitted correctly and whether USCIS issued any separate notice. The petitioner, not the beneficiary acting alone, is normally the party with the registration record and responsibility for a cap-subject filing.
- Ask immigration counsel to assess lawful alternatives, such as a cap-exempt H-1B position, another available nonimmigrant or immigrant category, continued work authorization under an existing status, or a future registration.
Do not assume an appeal, a later selection, or a new employer registration is available. USCIS registration rules also warn that duplicate registrations by the same registrant for one beneficiary may be invalid. The employer’s immigration team must determine whether a separate, lawful option exists for your facts.
If USCIS has not decided the H-1B petition
Use the receipt number on the Form I-797 receipt notice. USCIS’s e-Request service and Processing Times FAQs explain how to check a case and when an inquiry may be accepted.

- Enter the receipt number in the USCIS online case-status tool. Check that the form, classification, service center or field office, and filing date on your records match the case you are tracking.
- Open USCIS’s processing-time tool and select the exact form, category, and office shown for the petition. The displayed estimate reflects prior processing experience; it is not a guaranteed decision date.
- If the tool says your case qualifies for an inquiry, submit the e-Request with the requested information. Save the confirmation number, submission date, and a copy of what you sent.
- If the petition was filed with premium processing, use the contact information and instructions on the receipt notice or USCIS premium-processing materials. Premium processing does not make a consular interview appointment available and does not replace visa issuance.
- Ask the petitioner or counsel to investigate notices that did not arrive, a returned filing, a request for evidence, a change of address, or a mismatch in the receipt information.
Repeated inquiries do not guarantee faster adjudication. Do not treat a posted estimate as permission to work, remain in the United States, or travel. Those consequences depend on your underlying status and filings.

If USCIS denied the petition
Read the entire decision, not just the first page. Highlight the factual and legal grounds, the decision date, any deadline or response instructions, the petitioner named in the case, and whether USCIS identifies a missing document or eligibility element.
Coordinate with the petitioner
The employer or other petitioner filed the Form I-129 and is central to any response. Send the complete notice to the petitioner’s immigration team promptly. Counsel can determine whether the notice supports a motion, an appeal where available, a new petition, or no further filing. There is no single review or motion deadline that applies to every H-1B denial, so do not rely on a generic deadline found online.
- Do not assume that an approved labor condition application, prior H-1B, or prior approval resolves the grounds in this decision.
- Do not automatically file a duplicate petition; it may create cost, timing, and status complications.
- Do not conclude that you must immediately leave the United States without reviewing the I-94, current status, grace-period rules, and any other pending filing with counsel.
USCIS petition review and DOS visa review are separate. A petition denial does not become a visa refusal, and a visa refusal does not create a universal USCIS appeal right.
If the consulate gives a 221(g) refusal
The Department of State explains that a refusal under INA 221(g) means the applicant had not established eligibility to the officer’s satisfaction at that stage. It can involve a request for missing information or administrative processing. It is not automatically a final, permanent visa ineligibility.

When documents are requested
- Read every line of the refusal sheet and the consulate’s delivery instructions. Use only the specified portal, email address, courier, or appointment channel.
- Submit a complete response, including translations or formatting required by the post, as soon as practical. Keep a copy and proof of delivery.
- Track the case through the official channel identified by the post. A CEAC status of “refused” can appear in a 221(g) case and, by itself, does not establish that the case is permanently ineligible.
DOS states that requested information should be provided within one year of the refusal. If it is not provided within that year, the applicant must reapply and pay another visa fee. The one-year period is not a promise that a decision will be made within a particular number of days.
When administrative processing is required
The official guidance states: “The duration of the administrative processing will vary based on the individual circumstances of each case.” There is no universal timeline. DOS’s appointment wait estimates exclude administrative processing, so an interview estimate cannot be used to predict when a 221(g) case will finish.
Follow the post’s instructions and avoid sending repetitive inquiries that add no new information. If a genuine, documented hardship exists, you may raise it with the consular section through its stated contact method; do not promise that hardship requests will accelerate a case.

If the visa was refused under 214(b) or another ground
Start with the INA section printed on the refusal sheet. Consular officers decide visa applications, and the petition approval does not override a consular refusal.

INA 214(b)
DOS’s Visa Denials guidance says, specifically for a 214(b) refusal, “There is no appeal process.” Reapplication is possible, but it requires a new application and a new fee. It is most useful when you can present materially relevant information that was not previously available or a significant change in circumstances. Repeating the same application without addressing the officer’s concern is unlikely to solve the problem.
Other refusal grounds
Do not apply the 214(b) rule to every refusal. Other grounds can have different procedures, including possible waivers, additional evidence, or consequences that may be long-lasting or permanent. Have counsel interpret the exact section and any waiver eligibility before submitting another application.

Appointment availability varies by post and changes over time. Check the embassy or consulate’s own instructions and the DOS Global Visa Wait Times page immediately before making travel plans. The page is updated monthly and shows estimates by location, including a petition-based H/L/O/P/Q interview column; those figures concern appointment availability, not USCIS petition processing or administrative-processing duration.

Applying elsewhere can mean longer waits, additional qualification difficulty, and fees that do not transfer. A wait estimate is an estimate, not a guaranteed appointment date.
Can you keep working or remain in the United States?
There is no safe one-size-fits-all answer. The result can turn on the status shown on your I-94, the expiration date, an extension or change-of-status filing, whether employment authorization is tied to a particular employer, and whether you left the country for visa stamping. A pending petition, an approved petition, and a pending visa application each have different effects.
Before working, changing jobs, traveling, or allowing an I-94 to expire, give the employer’s immigration counsel or another qualified attorney:
- your passport biographic page and current visa;
- your most recent I-94 and all USCIS receipt and decision notices;
- the registration or selection record, if relevant;
- your employment start date, payroll records, and any termination or leave dates;
- travel history and the dates of every filing or notice.
USCIS directs people who are uncertain about forms or applications to consider advice from an authorized service provider. A lawyer can give advice based on your actual status and deadlines; a general online answer cannot.

A practical document-and-deadline checklist
- Identify whether the document is a registration result, USCIS receipt, USCIS denial, consular refusal sheet, or appointment notice.
- Write down the issuing agency, case number, decision date, and every response deadline.
- Save the online status page, inquiry confirmation, courier tracking, and document-upload receipt.
- Use the exact agency or consulate channel named in the notice; do not send sensitive documents to an unverified address.
- Ask the employer or petitioner to confirm who is responsible for each next filing.
- Get individualized advice before assuming you can work, stay, travel, appeal, refile, or submit a second registration.
The Bottom Line
Do not treat every H-1B problem as a visa denial. Confirm the exact stage and notice, follow the responsible agency’s instructions, preserve every deadline and receipt, and have the employer or qualified immigration counsel review status and strategy before you act.
