What to Do If You Accidentally Keep an Undersized or Protected Fish

If a fish may be undersized, protected, out of season, or over your limit, stop retaining it and check the rules for the exact place and species. Here’s how to release it and what to do if it is dead or already in your possession.
Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

If the fish is not legal to retain, stop keeping it and release it promptly into the water where you caught it, if it is alive. Handle it as little as possible, keep it wet, and do not delay a required release to take photos or ask for informal advice. The exact rule depends on your location, the species, the waterbody, the season, and the type of fishery. If the fish is dead, already in a cooler, or has been transported, do not assume you may possess it; contact the responsible fisheries or wildlife agency for instructions.

If you are asking, “Can I keep a protected fish if I caught it by accident?” the safe answer is not to assume that an accident creates an exception. First establish what the rule for that exact catch requires. The steps below explain what to do immediately, how to minimize harm during release, and what to do when the fish is already dead or retained.

Act first: stop retaining a fish that may be illegal to keep

If you realize a fish may be undersized, protected, out of season, or over your limit, stop treating it as a catch you can keep. Check the applicable official rule, and if it requires release, return a live fish promptly to the waters where it was caught. Do not move it to another waterbody.

In Ontario, the Ontario Fishery Regulations, 2007 require a person who catches a fish they are not permitted to retain to “immediately return the fish to the waters from which it was caught and, if the fish is alive, release it in a manner that causes the least harm to that fish.” The regulation is current on Canada’s Justice Laws site through September 21, 2026, and was last amended March 1, 2025. Read section 12 of the Ontario Fishery Regulations.

Ontario’s provincial guidance also identifies protected fish, fish below the legal size, fish caught during a closed season, and fish caught over the limit as fish that must be released immediately. These are Ontario examples, not rules that automatically apply elsewhere. Check Ontario fishing rules or the rules for the jurisdiction where you are fishing.

Do not spend time trying to settle a legal question through a fishing forum, a guess based on another waterbody, or a long photo session while a fish that must be released is out of the water. If you can check the official rule without delaying a required release, do so; if the applicable rule is clear, follow it. If identification or the rule is genuinely uncertain, use an official species guide or contact the regulator, but do not treat uncertainty itself as permission to retain the fish.

How to release the fish with the least harm

Once you know release is required, keep the handling brief. Keep the fish wet, minimize time out of the water, and unhook it in the water when feasible. The right handling can depend on the species and circumstances, so avoid forcing a technique that could cause more harm. The goal is to return the fish promptly while causing as little additional harm as practical, not to pursue a single handling method regardless of conditions.

  • Do not delay release for photographs or prolonged identification efforts. If identification is uncertain, use an official species guide or contact the local agency without keeping the fish longer than necessary.
  • If a hook is swallowed, do not tear it out. The U.S. Fish & Wildlife Service advises: “Simply cut the line as close to the mouth as possible.” See the USFWS guide to fishing.
  • The USFWS also recommends releasing an undersized fish quickly. Its guide mentions wet hands or gloves and a rubberized net as handling options; such equipment does not replace the legal duty to release or guarantee a fish will survive.

NOAA discusses circle and barbless hooks as catch-and-release gear. Gear choices may help reduce handling in some situations, but they do not resolve whether a fish is legal to retain, and no single tool is suitable for every species or protected-fish situation. Read NOAA’s catch-and-release best practices.

Practical release tools, such as fish dehooking pliers, may be useful to have available, but a tool is not a substitute for checking the rules or acting promptly. Equipment is an optional aid: the cited guidance does not establish that a particular tool suits all fish, that buying gear fixes an accidental retention, or that any equipment guarantees survival. Follow official handling advice for the species and situation rather than trying to use a tool in a way that prolongs handling.

If the fish is dead or already in your possession

Do not assume that a fish becomes legal to keep because it died before you could release it. In Hawaiʻi, the Division of Aquatic Resources says it is unlawful there to take or possess undersized or out-of-season fish, and recommends release even if the fish has died. That is a Hawaiʻi-specific rule and should not be treated as a nationwide statement. See the Hawaiʻi Division of Aquatic Resources FAQ.

If the fish is dead, in a cooler, or has already been transported, do not assume you may keep, eat, sell, or transport it. The legal consequences and required next steps depend on local rules. Contact the agency responsible for fisheries or wildlife in the place where the fish was caught and explain what happened; ask what to do with the fish. Do not discard, transfer, or continue transporting it based on a guess.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

This is a point where location matters especially: the Hawaiʻi FAQ gives a clear answer for that jurisdiction, while the cited Ontario provision addresses returning a prohibited fish to its capture waters and releasing a live fish with least harm. Neither example supplies a universal process for every place or every already-retained recreational catch. If you have moved away from the capture site, or the fish is no longer alive, tell the regulator that when asking for instructions rather than improvising a disposal or possession decision.

Check the rule for the exact place and species

Size limits and retention rules may vary by jurisdiction, zone, waterbody, species, and season. Verify the rule for where you actually caught the fish, not simply the general rules for a nearby region. Official regulations and agency species guides are preferable to a fishing forum or an old summary because exceptions and special provisions may apply.

  1. Identify the jurisdiction and waterbody. Note the country, state or province, and the specific lake, river, coastal area, or management zone.
  2. Identify the fish as accurately as you can. Use the relevant agency’s official species guide. If you are unsure, do not make a retention decision based on a guess.
  3. Check the current rule. Look for minimum or maximum size, protected status, open season, daily or possession limits, and any local exceptions.
  4. Follow the release requirement immediately. If a rule requires release and the fish is alive, return it to its capture waters promptly and handle it with the least harm feasible.

For Ontario, the provincial rules page links to current recreational fishing rules. For another location, consult the official fisheries or wildlife authority responsible for that waterbody.

Make the check specific rather than relying on a broad label such as “undersized fish” or “protected species.” The issue may be a size limit, a closed season, a retention or possession limit, or a species protection; the rule may also be tied to a particular zone or waterbody. No single size threshold or list of protected fish applies to all locations. An official local source is therefore essential before making a decision about any fish that is not clearly legal to keep.

If you may already have violated a rule

If you retained or transported a fish before discovering the restriction, or you are unsure whether a reporting duty applies, contact the responsible agency promptly and ask for instructions. Share the facts you know, such as the species if identified, where and when it was caught, whether it is alive, and what has happened to it. Do not invent a reporting deadline or assume that a single procedure applies everywhere.

Reporting requirements are not universal for every recreational angler. Hawaiʻi’s agency recommends reporting violations to its Division of Conservation and Resources Enforcement (DOCARE). NOAA’s cited mandatory reporting requirements concern accidental protected-species bycatch in specified commercial fisheries; they should not be generalized to ordinary recreational catches. Follow the rules and contact channels for your jurisdiction and fishery.

If you are in Hawaiʻi, consult the state FAQ for agency guidance and DOCARE reporting information. For other places, use the official local regulator’s contact or reporting channel. Hawaiʻi Division of Aquatic Resources FAQ · NOAA information on protected-species bycatch reporting.

When you contact an agency, distinguish what you know from what you are unsure about: for example, describe the location, timing, identification if known, and whether the fish is alive, dead, retained, or transported. These are useful facts to explain the situation, not a universal legal checklist or a substitute for any official reporting form or deadline. Ask which official procedure applies to your fishery and location. If this involved a commercial fishery or a potentially protected species, do not assume the recreational guidance is enough; use the applicable official contact or reporting instructions.

Quick decision guide

  • Alive and release is required: Return it promptly to the water where it was caught; keep it wet and minimize handling.
  • Dead or already retained: Do not assume possession is allowed. Check the local law and contact the relevant agency for instructions.
  • Species or rule uncertain: Consult an official local guide or agency; do not keep the fish while guessing.
  • Protected species or possible violation: Contact the official local authority or reporting channel. Do not apply commercial bycatch reporting rules to all recreational fishing.

Frequently Asked Questions

Can I keep an undersized fish if it died before I released it?

Do not assume that death makes possession legal. Hawaiʻi’s Division of Aquatic Resources says possession of undersized or out-of-season fish is unlawful there and recommends release even if the fish has died. Elsewhere, local rules control; contact the responsible agency for instructions.

What if the fish is already in my cooler or I took it home?

Do not assume you may keep, eat, sell, discard, or continue transporting it. Tell the fisheries or wildlife agency where it was caught and what has happened, then ask what to do. The cited sources do not establish a universal process for every jurisdiction.

Do I have to report an accidental recreational catch of a protected fish?

There is no universal reporting requirement established by the cited official guidance. Hawaiʻi recommends reporting violations to DOCARE. NOAA’s cited mandatory rules apply to accidental protected-species bycatch in specified commercial fisheries, not automatically to all recreational anglers. Check your local agency’s instructions.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

What if I cannot identify the fish or find the size rule?

Use an official species guide and check the rule for the exact location, zone, waterbody, season, and fishery. If you cannot resolve it, contact the responsible agency. Do not treat uncertainty as permission to keep the fish, and do not delay a required release to seek informal advice.

Should I remove a swallowed hook before releasing the fish?

The U.S. Fish & Wildlife Service advises not to tear out a swallowed hook; cut the line as close to the mouth as possible. Keep handling brief and follow any more specific official guidance for the species and situation.

The Bottom Line

When a fish may not be legal to keep, stop retaining it and check the current rule for the exact species and waterbody. If release is required and it is alive, return it promptly to its capture waters with minimal handling. If it is dead, retained, or transported, do not guess about possession or disposal—contact the local fisheries or wildlife agency. Accidental capture does not establish a universal exception, and reporting requirements depend on jurisdiction and fishery.
