Stay calm, do not physically resist, and treat a facial-recognition hit as an investigative lead—not proof that you are the person in an image. Keep your hands visible, ask whether you are free to leave, clearly say if you want to remain silent, and request a lawyer if you are arrested. Then preserve a private record and have local counsel examine the image, search, human review, corroborating evidence and any witness lineup. Procedures and rights differ by country and state, so the Iowa and England-and-Wales guidance discussed below is not a universal rule.
What to do during the encounter
Prioritize immediate safety
Do not run, argue physically, touch officers or interfere with what they are doing. Keep your hands visible and follow lawful instructions. A disagreement about a camera result is best handled through a lawyer and later evidence review, not on the street.

Ask whether you are free to leave
The American Civil Liberties Union of Iowa advises asking calmly whether you are free to leave. If the officer says yes, leave without arguing. This is Iowa-specific orientation, not a statement that every jurisdiction uses the same detention rules.

Invoke silence clearly
If you do not want to answer questions, say so plainly. If you are arrested, say that you wish to remain silent and ask for a lawyer. Avoid trying to explain every detail or persuade officers before speaking with counsel; statements made under stress can be misunderstood or used out of context. Requirements to provide a name or identification vary by location, and the Iowa page updated in November 2021 expressly says it is not legal advice.

What to do immediately afterward
- Write a dated account. As soon as it is safe, record the location, start and end times, names or badge numbers, the exact words used about a camera or “match,” witnesses, paperwork, booking details and what happened next. This private chronology can help a lawyer test whether the investigation moved from a computer-generated candidate to an arrest without adequate corroboration.
- Preserve every document. Keep citations, release papers, property receipts, booking records, messages, letters and contact details. Store copies in a secure place and do not alter the originals.
- Limit public discussion. Do not post sensitive case facts, images or theories before discussing the matter with counsel. Public posts can expose personal information and may complicate an investigation or later litigation.
- Contact appropriate counsel. If police suspect you of a crime or arrested you, contact a local criminal-defense lawyer promptly. If the event involved a completed wrongful arrest, discrimination or misuse of personal data, ask a local civil-rights lawyer or established rights organization about complaint routes, filing deadlines and evidence requests. The existence of a possible claim does not predict its outcome.
- Ask about records. Have counsel determine whether records can be sought concerning the source image, system and version, search parameters, candidate list, operator review, corroborating investigation, any photo lineup, warrant application and facts inconsistent with the accusation.
There is no universal evidence-retention rule established by the guidance discussed here. Act quickly because agencies, businesses and witnesses may have their own retention schedules.
A facial-recognition result is a candidate, not an identification
Facial recognition can perform two different jobs. Verification or authentication asks whether a face matches one particular image a person claims is theirs, such as a device-unlock check. Identification compares an image with a larger list of known faces and returns possible candidates for follow-up. Public-space police use generally involves identification, not a definitive declaration of identity.
The UK government’s explanation of police use in England and Wales describes a search as generating possible matches. The International Association of Chiefs of Police wording quoted by the ACLU captures the evidentiary limit: “a strong clue, and nothing more, which must then be corroborated against other facts and investigative findings before a person can be determined to be the subject whose identity is being sought.” A candidate becomes meaningful only when independent evidence supports it.

Three public-policing modes

The exact retention, deletion, transparency and human-review rules depend on the agency, system and jurisdiction. A label such as “AI match” does not answer those questions.
Why a system can misidentify someone
Image and threshold problems
Accuracy depends on the algorithm, the quality of the image and the similarity threshold chosen to flag a result. Blur, distance, lighting, pose, occlusion and compression can remove the facial detail the system needs. A grainy surveillance frame may produce a plausible-looking candidate even when it cannot reliably distinguish among similar faces. Lowering a threshold can produce more candidates and more false positives; raising it can miss people who are actually present. Ask for the threshold and the system’s operating mode rather than accepting a confidence label without context.
Training and deployment conditions
The UK government notes that training data and deployment conditions affect error patterns. A system tested on clear, front-facing photographs may behave differently on a dark, angled video frame. A result from one vendor, camera placement or database cannot establish a general error rate for every system. No system-wide rate is established by the case examples discussed here; they are individual incidents, not a prevalence estimate.

Human overreliance
The most consequential mistake can occur after the software returns a candidate. Investigators may treat a lead as an identification, seek a warrant, or look for facts that fit the candidate while overlooking contradictions. A warning that the result is “only a lead” is useful, but the ACLU’s broader analysis argues that warnings alone have not prevented overreliance or contaminated witness procedures. That is an advocacy analysis, so its conclusions should be understood as the ACLU’s assessment rather than a neutral government finding.
What your lawyer should investigate

Access to these materials is not automatic. Disclosure rules, public-record exemptions, discovery obligations and remedies differ by jurisdiction. Detroit’s settlement, for example, provides specific disclosure of search information and reliability factors for that system; it does not create the same entitlement everywhere.
How a contaminated lineup can amplify an error
A lineup built around an algorithmic candidate can compound the original mistake. The ACLU explains that a candidate selected by facial recognition may resemble the surveillance image more closely than the filler photographs. A witness who is shown that lineup can therefore be steered toward the candidate, even if the candidate is not the person in the recording. The resulting selection may look like independent confirmation while actually reflecting the way the lineup was assembled.

When reviewing a lineup, counsel should ask whether investigators had any non-biometric reason to focus on the person, whether fillers were genuinely comparable, whether the administrator knew which photograph was the candidate, what instructions the witness received, and whether the witness expressed uncertainty. The safeguards described below are specific, not universal: Detroit’s 2024 settlement prohibits a lineup conducted solely on the basis of a facial-recognition lead.

Robert Williams in Detroit
The ACLU of Michigan says Detroit police arrested Robert Williams in 2020 based almost entirely on a facial-recognition scan of store-security footage. According to that account, Williams was not the person in the footage and was nowhere near the store at the time. A 2024 settlement imposed safeguards that include a prohibition on lineups based solely on facial-recognition leads, disclosure of search details and reliability factors, and officer training. The settlement addresses Detroit’s practices; it is not a nationwide rule.
Robert Dillon in Florida
An ACLU case page says a grainy image was processed by an AI-assisted program that incorrectly identified Robert Dillon as a possible match. The page says police then used a photo lineup and sought an arrest warrant, and that the ACLU alleges relevant contrary circumstances were omitted. The lawsuit was filed June 10, 2026 and was described as ongoing on the page when reviewed. These are allegations in an active case, not a court’s final determination.
Why isolated cases matter without proving a rate
These examples demonstrate possible failure paths—poor source imagery, treating a candidate as proof and using the candidate to construct a lineup. They do not establish how often any particular system errs. Do not convert a handful of reported cases into a statistical error rate.
Jurisdiction changes your options
United States
For an active criminal investigation, local defense counsel is the priority. Counsel can assess detention, questioning, identification procedures, discovery, warrant challenges and motions under the law where the event occurred. If the arrest is complete or discrimination is suspected, a civil-rights lawyer or established rights organization can explain possible administrative complaints or civil claims, including deadlines. The Williams and Dillon matters show that litigation has been pursued, but neither predicts the result of another case.
Iowa-specific encounter guidance
The ACLU of Iowa page, updated in November 2021, provides orientation on asking whether you are free to leave, invoking silence and requesting a lawyer after arrest. It also explains that rules about providing a name vary and discusses particular Iowa rules. Readers outside Iowa must obtain advice for their own state or country.

The UK government guide concerns police use in England and Wales. It discusses the Police and Criminal Evidence Act 1984, Human Rights Act 1998, Equality Act 2010, Protection of Freedoms Act 2012 and Data Protection Act 2018. It identifies the Information Commissioner’s Office, Equality and Human Rights Commission, police oversight bodies and the courts as parts of the oversight landscape, and says members of the public may challenge police through the court system. A reader in Scotland, Northern Ireland or another country needs the framework that applies there.
A practical decision checklist
- You were approached but not arrested: stay calm, ask whether you are free to leave, avoid volunteering explanations, document the encounter and consult counsel if officers linked you to a crime.
- You were arrested or charged: invoke silence, request counsel, comply with booking and release instructions, preserve all paperwork and let the lawyer handle evidence requests and court deadlines.
- A witness identified you after a computer match: tell counsel immediately; the order of the search and lineup, filler selection and administrator instructions may be central.
- You believe data or discrimination rules were violated: ask a local civil-rights lawyer or rights organization which regulator, police-complaint body or court has authority and what limitation period applies.
- You cannot obtain the algorithm’s records: do not assume that means the case is over or that a remedy is automatic. Counsel can evaluate discovery, public-record requests, protective orders and the agency’s disclosure policy.
The central question is not whether a camera produced your name. It is whether reliable, independently checked evidence shows that you are the person sought. Treat the computer output as one lead, preserve the facts that test it, and get jurisdiction-specific legal help quickly.
