If a U.S. retailer delays or cancels a physical game preorder, you can generally choose to accept a shipping delay or cancel for a full refund; if the item never arrives and the seller will not refund you, ask your payment provider about disputing the charge. Digital preorders follow the platform’s rules instead, and downloading or preloading may affect whether you can cancel.
First, identify what you ordered and what the seller has done
“Oversold” is not a separate legal category with one standard remedy. It may describe an inventory error, a delayed allocation, or a canceled order. Check the seller’s explanation and the actual order status before deciding what to do.

The key distinction is whether you bought physical merchandise—such as a disc or collector’s edition—or a digital license or download. U.S. federal shipping rules cover most online, mail, and phone orders for merchandise, but digital storefronts set their own cancellation terms. Your location, the seller, and your payment method can also affect your options.

- Save the details. Keep the order confirmation, order number, item and edition, advertised release or shipping date, receipt, payment details, current order status, and every delay or cancellation message.
- Ask the retailer for a clear status. Use the order page or the seller’s documented support channel. Ask whether the order is still active, the revised ship date, and whether you can choose between waiting and canceling for a refund.
- Choose whether to wait or cancel. If you do not want to wait, tell the seller clearly that you are canceling and request a refund to your original payment method. For a covered merchandise order, the FTC says a seller that cannot ship on time must notify you and offer the choice to agree to a delay or cancel for a full refund. If it cannot fulfill the order, it can cancel and refund it. The FTC’s Mail, Internet, or Telephone Order Merchandise Rule generally requires shipment within the seller’s stated time—or within 30 days if no shipping time was stated.
- Escalate an unrefunded, undelivered order. If the seller refuses to refund an order that never arrived, contact your card issuer or other payment provider promptly and ask about a charge dispute. FTC consumer advice identifies disputing the charge as an option, but deadlines and procedures vary by provider and payment method. Preserve your communications and refund request.
For an undelivered order, FTC consumer guidance says a refund should not be replaced only with a gift card or store credit. You can also report suspected fraud to the FTC. For other consumer disputes, the relevant state or local consumer-protection office depends on where you live.

What a shipping-delay notice should tell you
The seller’s first delay notice should give a definite revised shipping date or say that no date is available, and explain your right to cancel for a prompt full refund. If no definite date is available and you agree to wait indefinitely, you can still cancel any time before shipment. A further delay requires the seller to offer the delay choice again. The FTC business guide explains these notice requirements.
For most payment methods, required refunds generally must be made within seven working days; when the seller extended credit, the guide says the refund is generally due within one billing cycle. These are rule-specific timeframes, not a promise that every platform or payment provider will process a refund on the same schedule. The transaction and payment method matter. See the FTC guide’s refund timing details.

Digital preorder cancellations depend on the platform
Do not assume that physical-shipping rules apply to a digital preorder. Check the storefront’s current terms for your account region, when payment was or will be taken, and whether the game has begun downloading, streaming, or preloading.
PlayStation Store in the United States
Under PlayStation’s U.S. preorder policy, if you paid more than 14 days before release, you may cancel before release if the main product has not started downloading or streaming. If you paid 14 days or less before release, the stated cancellation window is up to 14 days after payment, subject to the same no-download-or-streaming condition. Automatic downloads can affect eligibility.

Nintendo eShop in the United States
Nintendo’s U.S. eShop FAQ says you can cancel a preorder before payment is processed and the game is preloaded, up to seven days before release. Its cancellation support page lists insufficient eShop funds when payment is due as one possible reason for cancellation. These are platform-specific examples, not universal digital-store rules; check the current terms for your platform and region.
Deciding whether to wait or cancel
If the retailer gives you a choice, weigh the practical trade-offs before responding:
Rank #4
- An Epic Games account is required to redeem an Epic Games Store Card code
- If playing on a console platform (PlayStation Network, Xbox Live, Nintendo Switch or Mobile) you need to link your Epic Games account to that gaming platform (one time) to redeem your gift card code
- The 16 digit code on the back of the card WILL NOT work if redeemed directly through your gaming platform (PlayStation Network, Xbox Live, Nintendo Switch, Mobile, etc.)
- Note: Nintendo devices do not support Fortnite Shared Wallet, so V-Bucks purchased using your account balance will not show up on your Nintendo device. However, if you purchase items in the web Item Shop — or another platform where you play Fortnite — those items will be available in your Locker across all platforms.
- Redemption: Online
- Revised date: Is the new shipping date definite, and is the wait acceptable?
- Refund terms: Will you get money back to your original payment method, and what timing has the seller communicated?
- Edition or bonus: Is the specific edition or preorder bonus important enough to justify waiting? Do not assume the seller must preserve a bonus or honor a particular price unless the applicable terms or law say so.
- Replacement options: What would buying elsewhere cost, and could you lose the current price or bonus by canceling?
- Digital status: If it is a digital order, has payment been taken, or has downloading, streaming, or preloading started?
Records to keep if you need to complain or dispute a charge
Keep your order number, the item’s format and edition, order date, promised release or shipping date, amount and payment method, seller notices, your reply, and any refund confirmation. These records help show what was promised, what changed, and what you requested if you contact the retailer, payment provider, or consumer-protection agency.
